I. Introduction
The City of Bangor (City) is soliciting and accepting Statements of Qualifications and Proposal from
interested and qualified firms for providing design-build construction services for the Kenduskeag
Stream Wall Reconstruction (Project) located in downtown Bangor. The portion of the retaining wall
to be reconstructed is located on the south side of the Hannibal Hamlin Mall Park between Central
Street and Hammond Street. This retaining wall was constructed in the early 1930s and lies within
the Bangor's Great Fire of 1911 Historic District. The Park was added to the National Register of
Historic Places in 1984. This section of wall is constructed with irregular stacked granite stone.
Portions of this wall have stones that have become dislodged near the bottom of the wall and have
compromised the wall stability. The Site Map (Appendix A) shows the approximate location of the
wall to be reconstructed.
In 2024, the City contracted DuBoise & King, Inc. to conduct a preliminary retaining wall evaluation
and provide recommendations for wall repair or replacement. The report prepared for the City is
attached in Appendix B.
II. General Information
Available at the following web address: www.bangormaine.gov/proposals on the City's website. By
submitting a response to this solicitation, the Proposer accepts the responsibility for downloading,
reading, and bidding by the terms and conditions set forth in the City's "General Information for
Vendors."
In your proposal, please specify whether you currently have, or are in the process of developing, a
domestic violence policy. If you do not have such a policy, let us know if you would like to receive a
copy of the City of Bangor's policy as a reference.
III. Submission
For consideration, submit the proposal Bid Form (page 24) and all materials requested in Section XII.
Qualifications electronically or in an envelope via submission methods listed below. The envelope or

subject line must be clearly marked as "Proposal No. P26-61: Kenduskeag Stream Wall
Reconstruction."
Submissions must be received by 2:00 P.M. on Wednesday, August 5, 2026.
Submission of documents can be completed by:
A. Emailing to bids@bangormaine.gov; or
B. Hand Delivery to Customer Service, 73 Harlow Street, Bangor, ME; or
C. US Post Office addressed to 73 Harlow Street, Purchasing Department, Bangor, ME 04401
(items must be received by the deadline); or
D. All Other Delivery Services to City of Bangor: Purchasing Department, 73 Harlow Street,

All submissions should reference "Proposal No. P26-61: Kenduskeag Stream Wall Reconstruction."
Proposals will be publicly opened at the time stated above in the Paul Bunyan Room (first floor by
the side elevator), 73 Harlow Street, Bangor, Maine.
A tabulation of all received proposals will be posted on the City's website as soon as possible after
the opening date. Visit www.bangormaine.gov/bids for results. The "Show
Closed/Awarded/Cancelled Bids" box must be checked to see the proposal information.
IV. Questions
Any questions must be directed in writing to bids@bangormaine.gov no later than 4:30 P.M., Friday,
July 17, 2026.
The City will provide a response by 4:30 P.M. on Friday, July 24, 2026. This response will be in the
form of an addendum, accessible on the City's website. Notifications will be sent to those who have
signed up to receive notifications at www.bangormaine.gov/bids through NotifyME. Notifications
will be sent when new addenda are released.
V. Late Proposals
It is the responsibility of the Proposer(s) to see that their proposals have sufficient time to be received
by the Purchasing Department before the submittal deadline. Any proposal, portion of a proposal,
or requested proposal revision received at the City Purchasing Department after the time and date
specified will be returned to the Proposer unopened or, if by electronic submission, deleted without
being opened.
VI. Withdrawal of Proposals
No Proposer may withdraw their proposal for a period of ninety (90) days from the date of opening.
All proposals shall be subject to acceptance by the City during this period.
To withdraw a proposal prior to the opening, the Proposer shall request the withdrawal in writing.
All costs associated with the withdrawal (i.e., mailing fees) will be borne by the Proposer.

VII. Rejection
The City reserves the right to reject any proposals, waive any informalities or defects in proposals, or
accept a higher-cost proposal if it is deemed to be in the best interest of the City. The City also
reserves the right to request clarification of any details from the successful Proposer. The evaluation
of proposals and determination of the award will be at the discretion of the City and its judgment
shall be final and without right of recourse by any Proposer.
VIII. Award and Selection
The City will select the proposal deemed most advantageous, appropriate and beneficial to the
Owner. The contract will be awarded by the City to the Proposer best able to provide the services
required.
Proposals will be scored based on the following criteria:

All bids will be opened at the bid opening. Bid opening will be held in the Paul Bunyon Room on the
first floor of City Hall at 2:00 pm on Wednesday August 5, 2026. Tabulated scoring will be posted
within a week of bid opening once the City has had the opportunity to score the technical elements
of the proposals.
The evaluation of proposals and determination of the award will be at the discretion of the City and
its judgment shall be final and without right of recourse by any Proposer.
IX.Information for Proposers
A. Tax Exclusion: All Federal and State taxes must be excluded from the proposal price. Upon
request, a tax exemption certificate for the City of Bangor shall be furnished to the successful
Proposer.
B. Bid Form and Requirements: The Bid Form (page 24) and all materials requested in Section
XI. Qualifications must be completed and returned with the proposal to be considered
responsive.
C. Required Insurance: Proposers are required to maintain the following insurance policies
throughout the life of the project and name the City of Bangor as an additional insured where
applicable and may be required to provide proof:
1. Worker's Compensation Insurance Statutory
2. Employer's Liability Insurance $500,000 each accident

X. Bonding
A. Bid Bond: Each proposal shall be accompanied by a bid bond in the amount of 5% of the total
bid price to guarantee Vendor intent to enter into a contract with the City of Bangor using
the attached Bid Bond form included herein.
B. Performance and Payment Bond: Upon award, contractor shall furnish a performance bond
and a payment bond, each in an amount at least equal to the Contract Price, as security for
the faithful performance and payment of all of the Contractor's obligations under the
Contract. Contractor shall obtain the required bonds from the surety companies that are duly
licensed or authorized in the jurisdiction in which the Project is located.
XI.Qualifications
Design Build Contractor (DBC) shall submit with their bid a qualifications package that
includes not is not limited to the following information:
* Key personnel and resumes for the General Contractor, lower tier subcontractors and
architects and engineers (A/E).
* Related project experience for GC and A/E firm
* References from GC and A/E for recent work similar to that included in this RFP
including Project Name, Location, Contact Name, Contact Phine Number and Email.
XII. Pre-Bid Meeting
A non-mandatory, informational pre-bid meeting will be held at 10:00 AM on Wednesday July
8, 2026, at City Hall in the Paul Bunyan Room (first floor by the side elevator), 73 Harlow Street,
Bangor, Maine. Though not mandatory, potential bidders attendance is encouraged.
XIII. Project Overview and Scope of Work
A. Background:
This project involves the reconstruction of approximately 115 linear feet of retaining wall on
the south side of the Hannibal Hamlin Mall Park between Central Street and Hammond

Street. The section of wall to be reconstructed begins at Central Street Bridge and extends
to the east 115 feet. The retaining wall retains the Hannibal Hamlin Parkway and acts as the
canal wall for the Kenduskeag Stream which is tidal in this area.
Based on a preliminary study completed by DuBois and King, Inc., included in Appendix A, full
replacement of the wall in this area is necessary due to instability of the existing wall and to
remediate loose and voided areas identified directly behind the existing wall.
B. Description:
The section of the wall to be reconstructed is approximately 115 feet in length and has an
average height of approximately 26 feet. The preliminary report indicates that the existing
wall is likely founded on bedrock which is estimated to be slightly below the mean low tide
elevation along the wall. The proposed replacement will require connection to the upstream
and downstream portions of the existing wall which will remain in place. Design should
account for future replacement of the remaining wall sections and how a cohesive look can
be maintained for future wall replacement projects.
The park area above the wall includes mature red maple trees, landscaped gardens, street
lighting, decorative lighting and brick sidewalk within the project area. At least two trees are
within the area of impact for the wall replacement. The city would like the contractor to
replace these trees in the same locations after completion of this project. Existing
landscaping and brick sidewalk will need to be replaced after completing. The City Electrical
department will remove and reinstall the lighting in the park area. The contractor should
coordinate with the Electrical Department for this work.
The section of wall to be reconstructed falls within the Bangor's Great Fire of 1911 Historic
District. This should be considered in the design with regard to aesthetics. Based on the
preliminary evaluation, the City is proposing the wall be replaced with a precast modular
block wall with coloring and texture to match the existing granite. The city is also open to
other value engineered options if they preserve the aesthetics and provide a long-term
solution for wall stability.
For the purpose of this estimate, it can be assumed that the Hannibal Hamlin Parkway will be
closed for the duration of the construction project from State Street to Central Ave. Access
will need to be maintained for the access bridges on the north channel for Emergency
purposes only. Lane closures will need to be coordinated with the City.
C. Schedule
The work in this RFP shall be completed in accordance with the following schedule:
1. DB Design Concept Documents:
DB Design Concept Documents submitted no later than 90 calendar days after award.

City Review completed no later than 15 calendar days after submission of DB Design
Development Documents.
2. 50% Draft DB Construction Documents:
Work on 50% Draft DB Construction Documents shall continue during the DB Design
Concept Documents review and once DB Design Concept review comments are received
they shall be addressed and incorporated in the 50% Draft DB Construction Documents.
50% Draft DB Construction Documents and written responses to the City's DB Design
Concept Document Review Comments submitted no later than 60 calendar days after
submission of Design Concept Documents.
City Review completed no later than 15 calendar days after receipt of 50% Draft DB
Construction Documents.
3. 100% Draft DB Construction Documents:
Work on 100% Draft DB Construction Documents shall continue during the DB Design
Development Documents review and once DB Design Development review comments
are received they shall be addressed and incorporated in the 100% Draft DB Construction
Documents.
100% Draft DB Construction Documents and written responses to the City's DB Design
Development Document Review Comments submitted no later than 60 calendar days
after submission of 50% DB Design Development Documents.
City Review completed no later than 15 calendar days after receipt of 100% Draft DB
Construction Documents.
4. 100% Complete DB Construction Documents:
100% Complete DB Construction Documents and written responses to the City's 100%
Draft DB Construction Documents Review Comments submitted no later than 45
calendar days after submission of 100% Draft DB Construction Documents.
City Review completed no later than 15 calendar days after receipt of 100% Complete
DB Construction Documents.
5. Complete Stamped and Signed DB Construction Documents:
Complete Stamped and Signed DB Construction Documents and written responses to
the City's 100% Complete DB Construction Document review comments submitted no
later than 15calendar days after receipt of City's 100% Complete DB Construction
Document review comments.
6. Construction:

Construction completed no later than 455 calendar days after award of the contract.
7. As-Constructed Drawings:
As-Constructed Drawings completed no later than 30 calendar days after Substantial
Completion.
All DB Design Development, DB Construction Documents and As-Constructed
Drawings shall be submitted to the City's Project Manager.

complete the proposed work.
* Design site, construction staging and support of excavation systems.
* Submit DB Design Development and DB Construction Documents for review and approval,
as required.
* Provide schedule of construction work.

XVII. Definition of Contract Line Items
Contract Bid Item No. 1 - Design: This item consists of all work required to get to 100%
Complete Stamped and Signed DB Construction Documents. This item shall be a Lump Sum
fee for all design phase work to be paid in progress payments based on percent of work
complete.
Contract Bid Item No. 2 - Initial Construction Estimate: This item includes but is not limited
to all materials, labor, mobilization, inspection, permits, support of excavation, dewatering,
design of SOE and dewatering systems, and any other incidentals required to construct the
project as designed in the stamped and signed DB Construction Documents. This item should
be a good faith estimate based on the Design Build team's design concept and the known site
conditions at the time of bid. Final construction estimate will be determined as outlined in
section XXII. 100% Design Plan Construction Cost Schedule of Values.
XVIII. Progress Payments
A. Design Phase - Progress payments during the design phase of the work will be based on
submission, review, and acceptance of design deliverables.
B. Construction Phase - Progress payments during construction will be based on the percentage
of work completed on items listed on the approved schedule of values. Actual construction
completed and in place will form the basis for payment. Verification of the % complete shall
be initiated by the Contractor under the direction of a representative of the Project Manager,
unless the Project Manager waives this requirement in a specific instance. The Contractor
shall make the computations for payment based on the governments verification of work
completed and in place for any periods for which progress payments are requested.
The Contractor shall furnish the originals of all field notes and all other records relating to the
basis for payment, to the Project Manager, who shall use them as necessary to determine the
final amount of progress payments. The Contractor shall retain copies of all such material
furnished to the Project Manager.
XIX. Meetings
A. Design Meeting: After the award of the contract and acceptance of the Performance and
Payment bonds, the Project Manager will arrange a design meeting with the DBC. The
meeting agenda shall include the following as a minimum:
* Review and emphasize the City's needs and design objectives.

* Environmental Impacts
* Schedule of Values
* Design schedule
* Modifications during design
* Submittals during design
* Areas available for use by the DBC
* Payments to the DBC
B. Pre Construction Meeting: After 100% Complete DB Construction Documents are approved
and prior to the start of construction, the Project Manager will arrange an on-site
Preconstruction meeting with the DBC. The meeting agenda will include the following as a
minimum:
* Correspondence procedures
* Jobsite safety
* Roles and responsibilities
* Lines of Authority
* Progress Payments
* Submittal process
* Construction schedule (Provide a minimum of two-color hard copies and electronic
copy in pdf format)
* Labor standards
* Payroll reports
* Modifications
* Accident reporting
* Park Rules and Regulations
* Typical Work Hours
* Saturdays, Sundays, holidays and night work.
* Traffic control
C. Progress Meetings: The DBC shall participate in telephone conference calls with the Project
manager, and other project team members to update them on the following meeting agenda
items: These meetings will be bi-weekly during design phase work and weekly during
construction.

XX. Project Schedule
A. Proposal
The contractor shall provide an estimated project schedule with the proposal package. This
schedule will be used in the scoring process and will set the expectation for project schedules
post award. This schedule should provide general timelines and anticipated completion
dates of milestone items.
B. Post Award Schedule
After project award, the contractor shall generate an updated project schedule to be
submitted to the City within 30 days of award. This schedule shall include a detailed design
phase with design deliverable submission dates, review periods as well as a summary
construction schedule with important milestones included for both phases. A fully
developed design phase schedule shall be submitted the City one week prior to the
preconstruction meeting.
C. Schedule Updates
The DBC shall update the project schedule monthly at a minimum or when known delays or
expediated items are encountered. The updated schedule shall be provided to the City along
with a narrative for any significant changes that affect submissions or milestone dated.
As the Work progresses, indicate Actual Completion percentage for each activity.
If the schedule update shows a late finish date after the contract completion date, at a
minimum, include the following in the narrative with your submission:
* Any known delays.
* Actions that will be taken to get back on schedule.
* Pending modifications.
* Impediments or constraints affecting progress.
XXI. Design
Design for the project shall be conducted to meet all state and municipal codes. This work
includes the preparation of BD Design Development Documents and DB Construction
Documents. The following subsections outline the minimum required deliverables for each
submittal. See section XIII. Project Overview and Scope of Work subsection C for schedule. All
submissions shall be in native format for review and comment. Format for complete Stamped
and Signed Construction Documents shall be PDF and a copy of all native formats shall be
provided to the city for project archive and general use. This includes AutoCAD Drawings. All
Drawings Shall be in in ANSI D paper size.
