KNOW ALL MEN BY THESE PRESENTS, that by this bond, we,
whose mailing address is , hereinafter called "the Principal,"

to THE CITY OF LAKE WALES, FLORIDA, a city, whose mailing address is 201 W. Central Avenue, Lake
Wales, Florida, 33853, hereinafter called "the Owner," in the sum of:

successors and assigns, jointly and separately.
THE CONDITION OF THIS BOND is that if Principal:
1. Performs the Contract awarded on the day of 20 , between

being made a part of this bond by reference at the times and in the manner prescribed in the contract; and
2. Promptly makes payment to all claimants as defined in Section 255.05 (1) Florida Statutes,
supplying Principal with labor, materials or supplies used directly or indirectly by Principal in the prosecution in
the work provided for in the contract; and
3. Pays Owner all losses, damages, expenses, costs and attorney fees, including appellate
proceedings that Owner sustains because of default by Principal under the Contract; and,
4. Performs the guarantee of all work and materials furnished under the contract for the time specified
in the Contract, then this bond is void; otherwise it remains in force.
Any changes in or under the contract documents and compliance or non-compliance with any
formalities connected with the contract or the changes does not affect Surety's obligation under this bond.
Section 255.05.(2), Florida Statutes, provides as follows:
A claimant, except a laborer, who is not in privity with the contractor and who has
not received payment for this labor, materials, or supplies shall, within forty-five
(45) days after beginning to furnish labor, materials, or supplies for the
prosecution of the work, furnish the contractor with a notice that he intends to
look to the bond for protection. A claimant who is not privity with the Contractor
and who has not received payment for of the labor or after complete delivery of
the materials or supplies, deliver to the contractor and to the surety written notice
of the performance of the labor or delivery of the materials or supplies and of the
nonpayment. No action for the labor, materials, or supplies may be instituted
against the contractor or the surety unless both notices have been given. No
action shall be instituted against the contractor or the surety on the bond after
one year from the performance of the labor or completion of delivery of the
materials or supplies.

CERTIFICATION OF GOOD FAITH: The undersigned, as a BIDDER, hereby declares that the only
person or persons interested in the proposal as Principal or Principals are named herein and that no
other person has any interest in this proposal or in the contract to be entered into; that this proposal
is made without connection with any other person, company, or parties making a bid or proposal;
and that it is in all respects fair and in good faith, without collusion or fraud.

further proposes and agrees to commence work under the contract within five calendar days from
the date of execution and delivery of the Contract and the Notice to Proceed by the OWNER.
LIQUIDATED DAMAGES: The BIDDER further proposes and agrees that failure to execute the
said Contract and the Bond within fourteen consecutive calendar days after written notice being
given of the award of the Contract, the check or bid bond accompanying this bid and the monies
payable thereon shall be paid into the funds of The City of Lake Wales, Florida as liquidated
damages for such failure; otherwise the check or bid bond accompanying this Form of Proposal
