INVITATION TO BID

PART 1 GENERAL

1.1 CONSTRUCTION CONTRACT

A. Bidders are invited to bid on Construction Contract named as:

2026 Sidewalk Spot Repairs City Wide

B. For information about the award of this Construction Contract, contact:

1.2 DESCRIPTION OF WORK

A. The location of the work is: Various sites located throughout Ogden City.

B. For Purposes of bid evaluation and initial bonding only, the estimated cost of the work is

$500,000.

C. The guaranteed amount of work to be issued by approved work directive is $275,000.00

D. Any individual project Work Directive under this contract shall be “not to exceed”

$200,000

E. The combined total of Work Directives in force at any one time shall not exceed the Bond

Limit in B above.

F. The project shall be governed by these contract documents, special conditions, specifics

related to the work, and all provisions of the Manual of Standard Specifications and

Manual of Standard Plans 2026 Edition published by the Utah Chapter of the American

Public Works Association (APWA) and Ogden City’s Engineering Standards for Public

Improvements 2025 Edition which are applicable to the work are made a part of the

Contract Documents by reference.

G. The work to be performed consists of furnishing and installing the equipment, facilities,

services and appurtenances thereto as included in the Contract Documents. The Work

generally includes, but is not limited to, the following:

Repairs, maintenance and minor construction on an as needed basis, throughout Ogden

City. The repairs, maintenance and minor construction involves but is not limited to

sidewalk, curb and gutter, and other concrette flatwork as directed by Ogden City.

1.3 BIDDERS' PRE-QUALIFICATION

A. All bidders are required to be pre-qualified before submitting their bid.

B. Each Contractor intending to submit a bid shall attend the mandatory pre-bid conference

and submit a completed Contractor Pre-Qualification Form at the conference. The

Contractor Pre-Qualification Form is available by download from the Ogden City

website at https://www.ogdencity.gov/264/Purchasing. Ogden City will review each

submittal to determine whether the Contractor satisfies the pre-qualification requirements

of these Contract Documents. Following the review, Contractors will be notified by email

of their pre-qualification status. Only Contractors determined by Ogden City to be pre-

qualified shall be eligible to submit a bid.

C. All bidders SHALL furnish the following information, AND the information listed in

Qualifications of Bidders in Part 3.1, to be used in the bid evaluation process:

i. Firm’s main office is within 45 miles of the Ogden City Municipal Building.

ii. List Projects that have been terminated prior to successful completion due to

Contractor non-performance within the last five years. Give type of construction

and reasons for termination.

iii. Show that the firm has the ability to substantially complete, with their own

equipment, multiple sidewalk, curb and gutter, and drive approaches

simultaneously.

iv. List five (5) projects completed within the last three (3) years with a contract

value exceeding $50,000. The project list shall distinguish between repair and

replacement and new installation work. Include the project owner, project

location, contract amount, completion date, and owner contact information for

each project.

1.4 BASIS OF BIDS

A. Bids shall be on a unit price basis. Unsealed or segregated Bids will not be accepted.

1.5 CONTRACT TIME

A. The Contract will last for one (1) year after the date of the Notice to Proceed.

B. At the conclusion of the one (1) year contract time, the Contract may be extended up to

two additional one-year term if both parties agree in writing to such extensions.

C. A new contract amount will be determined at each extension.

D. If Bidder anticipates occurrence of Suspended Contract Time, the Bidder shall not bid. NO

SUSPENSION OF CONTRACT TIME IS ALLOWED WITH THIS CONTRACT.

1.6 SUBSTANTIAL COMPLETION

A. Substantial completion is defined as all concrete, asphalt, and landscape work (including

repairs to sprinkler systems) are completed, unless stated otherwise by the Owner.

i. Pertaining to the 2026 Sidewalk Spot Repairs City Wide Contract, bidder agrees

that the Work will be Substantially Complete and ready for Final Inspection on or

before the expiration of the Contract Time indicated in the Agreement (Document

00 50 00).

ii. Pertaining to each individual Work Directive, the work listed in the Work

Directive shall be Substantially Complete on or before the termination date the

Contractor and Owner agree upon. See 00 72 00 Exhibit C to view a draft

example of the Work Directive form.

1.7 TIME LIMIT OF WORK

A. For purposes of liquidated damages, a scope of services and a construction time shall be
