INVITATION TO BID
NOTICE IS HEREBY GIVEN that Lackawanna County is accepting sealed bids for the McDade Park Pool
Repair project located at McDade Park. Sealed bids, mailed or hand-delivered, must be received by the
Lackawanna County Controllers Office, Lackawanna County Government Center, 123 Wyoming Avenue,
Floor 2, Scranton, PA 18503, not later than 11:00 A.M., Monday, May 4, 2026, at which point they will be
opened publicly and read aloud in the Commissioners' Conference Room at 2:00 P.M., Monday, May 4,
2026. All bids are to be sealed and plainly marked with the Project Name, "McDade Pool Repair Project".
Copies of the Contract Documents will be available for download on Friday, April 17, 2026 at 5:00 P.M.,
through the Lackawanna County Website.
PA Prevailing wages apply with certified payrolls. Payment and performance bonds will be required by the
successful bidder. A bid bond, certified check, or cash in the amount of 10% of the bid amount is required
to be submitted with each bid, payable to the Lackawanna County Treasurer, as a guarantee for the bidders
willingness to execute the contract if awarded the same. The bid submittal must include the following
documents: Non-Collusion Affidavit of Prime Bidder, Bid Bond, Statement of Bidder's Qualifications,
Certificate of Insurance, Bid Form and Agreement.
Attention is directed to the fact that procurement is subject to all requirements of the Pennsylvania "Steel
Products Procurement Act, Act No. 1978-3". Bidders on this work will be required to comply with Title VI of
the Civil Rights Act of 1964.
Bids may be held by Lackawanna County for a period not to exceed sixty (60) days from the date of the
opening of Bids for the purpose of reviewing the Bids and investigation of Bidders prior to awarding the
Contract.
Lackawanna County shall (a) award the construction contract to the lowest responsible bidder therefore,
or (b) reject all bids received within sixty (60) days of the date of bid opening; provided, however that
Lackawanna County may, in its sole discretion, delay such award or rejection for up to one hundred twenty
(120) days from the bid opening date until Lackawanna County has received all required approvals from
other governmental agencies.
There is a mandatory Pre-Bid Meeting at 10:00 A.M., Wednesday, April 22, 2026 at McDade Park Pool,
1 Bald Mountain Road, Scranton, PA 18504. Bids will only be accepted from firms that attend the pre-bid
meeting.
Questions relating to the bid invitation shall be submitted jointly in writing, via email, to:

Grants Manager, opshinskysa@lackawannacounty.org. Request For Information (RFI) shall have the

Technical Specifications INSTRUCTIONS TO BIDDERS
INSTRUCTIONS TO BIDDERS
PART 1 - GENERAL
1.01. DEFINED TERMS
A. Terms used in these Instructions to Bidders shall have the same meanings as defined in the
General Conditions of the Contract Documents.
B. Certain additional terms used in these Instructions to Bidders have the meanings indicated
below which are applicable to both the singular and plural thereof.
1. Bidder- one who submits a Bid directly to the Owner as distinct from a sub-bidder, who
submits a bid to a Bidder.
2. Successful Bidder- the lowest, responsible and responsive Bidder to whom the Owner (on
the basis of Owner's evaluation as hereinafter provided) makes an award. The terms
"Successful Bidder" and "Contractor" are interchangeable.
3. Contract Documents- includes Bidding Requirements, Contract Forms, Conditions of the
Contract, Technical Specifications and Construction Drawings.
4. Days- shall have the meaning of consecutive calendar days, unless specifically noted
otherwise.
5. Owner- Lackawanna County. The terms "Owner" and "Lackawanna County" are
interchangeable.
6. Owner's Representative- One or more individuals designated in these Contract Documents
or in other notices to speak on behalf of the Owner. An Owner's Representative has no
authority to amend, alter, or waive the requirements of the Contract Documents.
7. Subcontractor- A entity which provides labor, equipment, materials, or supplies under
subcontract with the Contractor.
1.02. COPIES OF CONTRACT DOCUMENTS
A. Complete sets of the Contract Documents may be attained by visiting the Lackawanna County
website https://www.lackawannacounty.org.
B. Complete sets of the Contract Documents must be used in preparing the Bid and the bids or
proposals of subcontractors. The Owner and its representatives do not assume any
responsibility for errors or misinterpretations resulting from the use of incomplete sets of the
Contract Documents.
C. Lackawanna County and the Owner's Representatives in making copies of the Contract
Documents available on the above terms, do so only for the purpose of obtaining Bids for the
work and do not confer a license or grant for any other use.
1.03. EXAMINATION OF CONTRACT DOCUMENTS AND SITE
A. It is the responsibility of the Bidder before submitting a Bid:
1. To examine thoroughly the Contract Documents and other related data identified in the
herein (including "technical data" referred to below);
2. To visit the Project Site to become familiar with and satisfy Bidder as to the general, local
and site conditions that may affect cost, progress, performance or furnishing of the Work;

3. To consider federal, state and local Laws and Regulations that may affect cost, progress,
performance or furnishing of the Work;
4. To study and carefully correlate Bidders knowledge and observations with the Contract
Documents and such other related data;
5. To promptly notify the Owner's Representative of conflicts, errors, ambiguities or
discrepancies which Bidder has discovered in or between the Contract Documents and
such other related documents; and
6. To notify the Owner of any and all objections to any provision of the Bidding and Contract
Documents through the Lackawanna County Website, https://www.lackawannacounty.org
within seven days of when the prospective bidder knew or should have known of the
objections and in any event on or before the date RFIs are due.
7. Objections to a provision of the Bidding and Contract Documents will be considered by the
County and a decision on the objection will be determined promptly. A challenge to the
decision may be filed in the Lackawanna County Court of Common Pleas within ten (10)
days or is waived.
B. Information and data shown or indicated in the Contract Documents with respect to existing
underground facilities at or contiguous to the Project Site is based upon information and data
furnished to the Owner's Representative by owners of such underground facilities or others.
Assertion of any claim for the accuracy or completeness thereof must be asserted through the
claims procedures set forth in the Contract Documents.
C. Before submitting a Bid, each Bidder will be responsible to obtain such additional or
supplementary examinations, investigations, explorations, tests, studies and data concerning
conditions (surface, subsurface and underground facilities) at or contiguous to the Site or
otherwise, which may affect cost, progress, performance or furnishing of the Work or which
relate to any aspect of the means, methods, techniques, sequences or procedures of
construction to be employed by Bidder and safety precautions and programs incident thereto
or which Bidder deems necessary to determine its Bid for performing and furnishing the Work
in accordance with the time, price and other terms and conditions of the Contract Documents.
Requests for access to the project site must be submitted to the Owner's Representative.
D. The submission of a Bid will constitute legal representation by the Bidder that Bidder has
complied with every requirement of the Contract Documents, that without exception the Bid is
premised upon performing and furnishing the Work required by the Contract Documents and
applying the specific means, methods, techniques, sequences or procedures of construction
(if any) that may be shown or indicated or expressly required by the Contract Documents, that
Bidder has given Lackawanna County written notice of conflicts, errors, ambiguities and
discrepancies that Bidder has discovered in the Contract Documents and the written
resolutions thereof by Lackawanna County is acceptable to Bidder to indicate and convey
understanding of terms and conditions for performing and furnishing the Work.
1.04. INTERPRETATIONS AND ADDENDA
A. The Owner reserves the right to reject any or all bids and to waive any informalities in the
bidding. No bid may be withdraw without compliance with the Bid Withdrawal Act. Questions
or inquiries regarding the scope of work will be answered up until the time specified in the
Invitation to Bid. Questions must be submitted via email Paul Bechtel, Parks & Recreation
Director, bechtelp@lackawannacounty.org and Sandra Opshinsky, Grants Manager,
opshinskysa@lackawannacounty.org with the subject heading of "McDade Park Pool Repair
Project - RFI". Written responses will be published by the time set forth in the Invitation to Bid.
B. Addenda may also be issued to modify the Contract Documents as deemed advisable by the

Owner.
C. The submission of the Bid constitutes an acknowledgement that the Addenda issued are
binding on the Bidder. It is the Bidder's responsibility to ascertain what Addenda have been
issued.
1.05. CERTIFICATES OF INSURANCE
A. Contractor shall deliver to the Owner, with copies to each additional insured identified in the
Special Conditions, certificates of insurance (and other evidence of insurance requested by
Owner or any other additional insured) which Contractor is required to purchase and maintain.
1.06. LABOR STANDARDS
A. In addition to the Pennsylvania Minimum Wage Act, the Contractor agrees that contract work,
as defined by the Secretary of Labor, shall be subject to the following standard provisions as
applicable:
1. Contract Work Hours and Safety Standards, as amended
2. Civil Rights Act of 1964, as amended
3. Federal Occupational Safety and Health Act, as amended
1.07. EQUAL EMPLOYMENT OPPORTUNITY
A. Contracts for work under this bid will obligate the Contractor and Subcontractors not to
discriminate in employment practices.
1.08. SUBSTITUTE AND "OR-EQUAL" ITEMS
A. The Contract, if awarded, will be on the basis of materials and equipment described in the
Contract Documents without consideration of possible substitute or "or-equal" items unless it
is indicated in the Contract Documents that a substitute or "or-an approved equivalent" item of
material or equipment may be furnished or used by the Contractor. Approval by the Owner is
required. Application for such acceptance will not be considered by Owner until after the
Effective Date of the Agreement. The procedure for submission of any such application by
Contractor and consideration by the Owner's Representative is set forth elsewhere in the
Contract Documents.
1.09. AVAILABILITY OF LANDS FOR WORK
A. The lands upon which the Work is to be performed, rights-of-way and easements for access
thereto and other lands designated for use by Contractor in performing the Work are identified
in the Contract Documents. Additional lands and access thereto required for temporary
construction facilities, construction equipment or storage of materials and equipment beyond
those indicated in the Contract Documents are to be obtained and paid for by the Contractor.
Easements for permanent structures or permanent changes in existing facilities are to be
obtained and paid for independently by the Owner unless otherwise provided in the Contract
Documents.
1.10. LIQUIDATED DAMAGES
A. Provisions for liquidated damages, if any, are set forth in the Agreement.
1.11. CONTRACT TIMES
A. The number of days within which, or the dates by which, the Work is to be substantially

completed and also finally completed and ready for final payment are set forth in the
Agreement.
1.12. SUBMISSION OF BIDS
A. Bids shall be MAILED or DELIVERED IN PERSON at the time and place indicated in the
Instructions to Bidders. If a hard copy is mailed, it shall be enclosed in an opaque sealed
envelope, marked with the project title and name and address of the Bidder and accompanied
by all required documents.
B. The following DOCUMENTS ARE TO BE INCLUDED WITH THE BID submitted by the Bidder.
1. Bid Form fully executed.
2. Bid Bond fully executed
3. Fully executed Non-Collusion Affidavit of the Contractor
4. Fully executed Public Works Verification Form
5. Certificate of Authority or its equivalent for an out-of-state Bidder or, if a Certificate has
neither been issued or denied, the application for the Certificate
6. Operating Agreement of a Limited Liability Company (LLC), or equivalent form of business
organization Documents
C. The failure to include the Bid Bond, the Non-Collusion Affidavit, a Public Works Verification
Form, a Certificate of Authority for an out-of-state bidder, or the Operating Agreement of an
LLC, or the failure to complete one of these documents in a form reasonably satisfactory to the
Owner shall not disqualify a Bidder provided that the missing document or information is
provided to the Owner within two (2) days after notice of the deficiency.
1.13. MODIFICATION AND WITHDRAWAL OF BIDS
A. Bids may be modified or withdrawn by an appropriate document duly executed (in the manner
that a Bid must be executed) and delivered to the place where Bids are to be submitted at any
time prior to the opening of Bids.
B. Additionally, if within forty-eight (48) hours after Bids are opened any Bidder files a duly signed,
written notice with the Owner and promptly thereafter demonstrates to the reasonable
satisfaction of the Owner, at a hearing or as otherwise required, that there was a material and
substantial mistake in the preparation of its Bid, that Bidder may withdraw its Bid. Thereafter,
that Bidder will be disqualified from further bidding on the Work to be provided under the
Contract Documents.
1.14. QUALIFICATIONS OF BIDDERS
A. To demonstrate qualifications to perform the Work and the Bidder's responsibility, the Bidder
may be requested to submit with the Bid using a form provided reasonably detailed responsive
documents and information. The Owner's Representative may request additional, detailed
written evidence such as financial data, previous experience, present commitments and the
like.
B. The Company which performed the Work now being corrected, repaired, and completed, D&M
Construction Unlimited, Inc. (D&M) and its subcontractors engaged by D&M for the earlier Work
are not eligible to bid on this Project.

1.15. SUBCONTRACTORS, SUPPLIERS AND OTHERS
A. If required by the Owner's Representative, the apparent successful Bidder, and any other
Bidder so requested, shall within five (5) days after Bid opening submit to the Owner a list of
Subcontractors, suppliers and other persons and organizations proposed for those portions of
the Work for which such identification is required. Such list shall be accompanied by an
experience statement with pertinent information regarding similar projects and other evident of
qualification for each such subcontractor, supplier, person or organization if requested by the
Owner's Representative. The Owner reserves the right to approve or disapprove the use of
Subcontractors, suppliers, and other persons and organizations.
B. Obligations that apply to the Contractor also apply to its Subcontractors. Contractor's contracts
with Subcontractors shall include in its subcontracts appropriate provisions that cause the
obligations to flow-down to the Subcontractors.
1.16. AWARD OF CONTRACT
A. The Owner reserves the right to reject any or all Bids, including without limitation the rights to
reject any or all nonconforming, non-responsive, unbalanced or conditional Bids and to reject
the Bid of any Bidder if the Owner concluded that it would not be in the best interest of the
Owner to make an award to that Bidder, whether because the Bid is not responsive or the
Bidder is unqualified or otherwise not responsible, or fails to meet any other pertinent,
established standard or criteria established. The Owner also reserves the right to waive
informalities in accordance with the provisions of applicable law. Discrepancies between the
multiplication of Units of Work and Unit Prices will be resolved in favor of the Unit Prices.
Discrepancies between the indicated sum of any column of figures and the correct sum thereof
will be resolved in favor of the correct sum. Discrepancies between words and figures will be
resolved in favor of the words.
B. The Owner may conduct such investigations as the Owner deems necessary to assist in the
evaluation of any Bid and to establish the responsibility, qualifications and financial ability of
Bidders, proposed subcontractors, suppliers and other persons and organizations to perform
and furnish the Work in accordance with the Contract Documents to the Owner satisfaction
within the prescribed time.
C. If the Contract is to be awarded, the Owner will give successful Bidder a Notice of Award within
the period of time allowed in accordance with the Invitation to Bid.
D. Based on the actual conditions encountered during the performance of the work, the Owner
reserves the right, at its sole option, to either increase or decrease the amount of work on the
Project and adjust the Contract Sum using Unit Prices provided in the Bid or, if unit price
information is unavailable, other reasonable information on costs.
1.17. CONTRACT SECURITY
A. The Contract Documents set forth the Owner's requirements as to performance, payment, and
maintenance security. When the successful Bidder delivers the executed Agreement to the
Owner's Representative, it must be accompanied by the required Performance, Payment, and
Maintenance Bonds.
1.18. LIENS NOT PERMITTED
A. The Project is public work and may not be liened under applicable law. The Contractor shall
secure the removal of any mechanic's lien placed on the Project at its expense.

1.19. SIGNING OF AGREEMENT
A. When the Owner's Representative gives a Notice of Award to the successful Bidder, it will be
accompanied by the required number of unsigned counterparts of the Agreement. Within five
(5) days thereafter, Contractor shall sign and deliver the required number of counterparts of
the Agreement along with other written Contract Documents, including the required Bonds and
insurance certificates. Upon execution by the Owner's Representative, one fully signed
counterpart shall be delivered to Contractor.
