Intention

Indian Head Theater and Community Arts Inc. also know at The Grand Theatre (Purchasing Entity) intends to contract with JCK Engineering and their sub-consultants on the basis that they are the only supplier able to provide the services that meets Indian Head Grand Theater’s requirements for this procurement, as described below.

Invitation to Respond

Suppliers that consider themselves able to meet the requirements identified in the Scope of Work section below and are able to provide the services can challenge this action by submitting a written statement of the capabilities that clearly demonstrates how they meet these requirements. All statements of capabilities that are received will be evaluated to determine if one or more suppliers are capable of meeting the requirements.

In the event that one or more suppliers are capable of meeting Purchasing Entity's requirements, Purchasing Entity may conduct a competitive process before making any final award.

If no written statements of capabilities are received, or if Purchasing Entity determines, based on its evaluation, that no other supplier is capable of meeting the requirements, the Purchasing Entity intends to proceed to award the contract and no further procurement process will be undertaken.

Until a formal written agreement is finalized and accepted by both Purchasing Entity and a supplier, the Purchasing Entity does not intend to create any contractual relationship (either expressed or implied) or create any other legal duties or obligations with any supplier submitting a response to this ACAN.

Without limiting the generality of the above statement, Purchasing Entity reserves the right, in its sole discretion at any time and for any reason, to:

A. reject or accept any and all responses to this ACAN; and

B. cancel this ACAN process at any time for any reason (with or without commencing a
new process in its place).
