1.0 INVITATION TO BID
1.1 The Town of Orange requests bids from qualified contractors to fine grade and repave
two existing basketball courts at the High Plains Community Center, 525 Orange Center Road.
1.2 Bidders are required to comply with the instructions contained in these Bid Documents,
and to provide information where requested. Bids must be made on the forms contained herein.
1.3 This project is anticipated to be funded with town funds (no state funds are anticipated),
therefore, CHRO small/minority/women/disabled business set-aside requirements do not apply.
1.4 This project is not subject to state prevailing wage rates, unless the contract price exceeds
$100,000.

2.5 Questions All questions shall be submitted by email to the Director of Public Works at
bbrinton@orange-ct.gov. All questions will be answered by email.
2.6 Bidders must provide contact information to the town by emailing afaustini@orange-
ct.gov and bbrinton@orange-ct.gov, to ensure that they receive bid addenda and other
notifications.
3.0 BID FORMS AND SUBMISSION INSTRUCTIONS
3.1 Copies of the bid documents may be obtained from the Town of Orange Website and
State of Connecticut Contracting Portal (CTsource).
3.2 Ditto marks are not considered writing; shall not be used; and can be reason for non-
acceptance of a bid.
3.3 All bids must be submitted in a sealed envelope, clearly marked “HPCC
BASKETBALL COURT REPAVING BID” received in the Public Works office by the time
of the bid opening specified above. In addition to the BID FORM, the bidder’s PROJECT
REFERENCES, NON-COLLUSIVE AFFIDAVIT OF PRIME BIDDER, and
MANUFACTURER’S APPROVED APPLICATOR LETTER must also be enclosed in the
sealed envelope. Bids, corrections, and/or modifications received after the time the Town
officials open the first bid will not be accepted.
Bidders are responsible for checking the bid posting on the state contracting portal
https://portal.ct.gov/DAS/CTSource/CTSource or on the Town of Orange website for bid
addenda and responses to bidders’ questions, up to the time of the bid opening.
3.4 The BID FORM must be signed by an authorized agent of the submitting company.
3.5 All information submitted, must be in ink or typewritten. Mistakes may be crossed out
and corrections inserted. The person signing the bid form must initial corrections.
3.6 The inability to meet any specified requirement(s) shall be clearly stated in writing and
attached to the bid form or written on the bid form.
3.7 At the time of opening the bids, bidders shall be presumed to have inspected the site and
be thoroughly familiar with the bid documents. Failure of any bidder to inspect the project site,
ask questions, or to examine the bid documents, shall not relieve any bidder from obligations
with respect to their bid.
3.8 The specifications listed are to be interpreted as meaning those acceptable to the Town of
Orange. Substitutions that are “an approved equal,” will be considered.
3.9 Bidders MUST visit the site to observe existing conditions prior to submitting a bid.
Change orders related to conditions that could be observed on a site visit will not be approved.
3.10 The Contractor must have significant experience performing work similar in scope to this
project. References must be provided on the Bid Forms. Failure to submit references for
relevant work SHALL DISQUALIFY any person or firm from the bidding process.
4.0 TIME REQUIREMENTS
4.1 Work shall be completed by June 12, 2026.
5.0 PAYMENT
5.1 Shall be at the contract price bid per each item including all labor, materials, supplies,
equipment, tools, and incidentals necessary to complete the work. Payment shall be made after
all work has been completed and accepted.

5.2 Periodic payments may be approved by the town based on the amount of work
completed. Periodic payments shall be subject to a retainage of 5% until all work has been
completed and accepted.
6.0 MISCELLANEOUS
6.1 Bidders may withdraw their bid any time prior to the time of bid opening. No bidder
shall withdraw, cancel, or modify their bid for a period of sixty (60) days after bid opening.
6.2 The Town of Orange is exempt from Connecticut Sales and Use Taxes and Federal
Excise Taxes. Bidders shall avail themselves of these exemptions.
6.3 The Town of Orange reserves the right to accept any bid, to reject any or all bids, to
waive any minor bid informality or irregularity, to take into account the residency and business
location of bidders within the Town of Orange, and to award the bid deemed by the Town of
Orange to be in its best interest. Lowest price shall not be the sole determining factor when
awarding the bid. Bidders who are delinquent in taxes or fees to the Town of Orange will not be
considered responsible bidders. The Town of Orange reserves the right to reduce the scope of
work and award only some of the tasks to a Contractor.
6.4 The successful bidder shall obtain all required permits. Town building (including
plumbing, mechanical, and electrical) permit fees will be waived, except for the state educational
fee of $0.26 per $1,000 construction value.
7.0 TERMINATION
7.1 Failure to comply with any of the requirements herein may be considered breach of
contract and as such shall be subject to termination of the contract by the Town.
8.0 BID, PERFORMANCE, AND PAYMENT BONDS
8.1 Bid bonds are not required for this project, unless the bid price exceeds $100,000. If
required, a bid bond in the amount of 5% of the base bid price must be submitted with the bid.
8.2 Performance and payment bonds are not required for this project, unless the contract
price exceeds $100,000. If required, performance and payment bonds in the amount of 100% of
the contract price must be submitted after award of the contract.
8.3 Bonds shall be issued by a surety company licensed in the State of Connecticut and shall
be on AIA forms A310-2010 and A312-2010, or other forms approved by the Town.
9.0 INSURANCE
9.1 Contractor shall agree to maintain in force at all times during the contract the following
minimum coverages and shall name the Town of Orange as an Additional Insured on a primary
and non-contributory basis to all policies, except Workers Compensation. All policies should
also include a Waiver of Subrogation.

Insurance shall be written with Carriers approved in the State of Connecticut and with a
minimum AM Best Rating of A- (Excellent) and minimum Financial Size Category of VIII. In
addition, all Carriers are subject to approval by the Town of Orange.

If any policy is written on a “Claims Made” basis, the policy must be continually renewed for a
minimum of two (2) years from the completion date of this contract. If the policy is replaced
and/or the retroactive date is changed, then the expiring policy must be endorsed to extend the
reporting period for claims for the policy in effect during the contract for two (2) years from the
completion date.

coverage altered, 30 days’ written notice must be given to the Town of Orange.

10.0 PREVAILING WAGES
10.1 This project is not subject to state prevailing wage rates, unless the contract price exceeds
$100,000.

11.0 GENERAL WORK REQUIREMENTS
General. All bids shall contain the cost of all items and work, whether specified herein or
not, required to provide a complete project. Failure to include such items and work specifically
in the bid documents shall not be grounds for extra cost.
All materials and equipment supplied by the Contractor shall conform to the requirements of the
Plans and Specifications. No changes shall be allowed unless they are approved, in writing, by
the Town. All work shall be in accordance with Federal, State, and Town laws.
Hours of Work. The Contractor may perform work on the Project during the following
work hours:
Monday – Friday: 7:30 a.m. to 4:30 p.m.
There is no work permitted on Saturdays, Sundays, or Holidays except if permitted by the Town.
Request for weekend or holiday work must be received no later than the end of the workday on
the Thursday preceding the weekend in question, or at least 1 full business day before a holiday.
At the completion of the project, the contractor shall clean the work area and remove all debris,
materials, tools, and equipment from the site.
12.0 SCOPE OF WORK
The work consists of furnishing all labor, material, supplies, equipment, tools, and incidentals
necessary to fine grade and repave two existing basketball courts at the High Plains Community
Center, and to perform all related work (refer to attached site plan). The north basketball court is
+/- 94 ft. x 60 ft. and the south basketball court is +/- 84 ft. x 54 ft.
The contractor shall add processed aggregate base material as necessary, fine grade and compact
the base to a one percent (1%) cross slope for drainage, and repave the two basketball courts by
installing 3.5 inches (compacted depth) of bituminous concrete (2” Class 2 bottom course and
1.5” tennis court mix top course). Work shall include adding topsoil as necessary, grading,
seeding, and straw mulching around the repaved basketball courts to match existing grades.
Processed aggregate base material shall conform to the Section M.05 of the Connecticut
Department of Transportation Standard Specifications for Roads, Bridges, Facilities and
Incidental Construction Form 819.
Existing basketball poles, backboards, and hoops shall remain in place.
Removal of the existing asphalt and painting new basketball court lines and markings will
be performed by others.
