NOTICE TO BIDDERS / INVITATION TO BID
Notice is hereby given that the governing board (“Board”) of the Orinda Union School District
(“District”) will receive sealed bids to construct the following project:
Glorietta Elementary School Transitional Kinder/Kindergarten Play Yard (DSA#01-122865)
(“Project” or “Contract”)
The Project consists of: Transitional and Kinder Play Yard Replacement including : Replacement of
flatwork including Asphalt, Rubber surfacing and Sandbox in Play Area. Install of two new play structure
(OFCI-owner furnished, contractor installed) over poured-in-place safety surfacing, Replacement of
fences and gates, Addition of wood fence at the toe of the hill, The addition of Trees, Plants and
associated irrigations, 18” concrete Seat walls, Installation of Site Furniture and Alternates maybe
selected by District.
The contractor will be responsible for receiving, as well as staging and safe keeping of OFCI items until
installation.
Contractors must submit sealed bids on or before 2:00p.m., March 26, 2026, at the District Office, located
at 8 Altarinda Drive, Orinda, California, at or after which time the District will open the bids and publicly
read them aloud. Any claim by a Bidder of error in its bid must be made in compliance with Public
Contract Code § 5100, et seq. Any bid that is submitted after this time shall be non-responsive and
returned to the Bidder. The District is not responsible for Bids that are received after the deadline noted
above.
Contractor shall possess at the time of it bid, the following classifications(s) of the Contractor’s
California State license(s): B License
Mandatory bidder’s conference and site walks will be held on:
Mandatory Site Walk # 1: Thursday, February 19, 2026 @ 9:00AM
Mandatory Site Walk # 2: Thursday, February 26, 2026 @ 9:00AM
Potential Bidders to meet at Glorietta Elementary School, located at 15 Martha Rd, Orinda, CA
94563 for mandatory site walks. Group will meet in front of school. Parking is free for all visitors.
All prospective Bidders are required to sign in with the Construction Manager. The Site Visit is expected
to take approximately 1 hour. Failure to attend or tardiness will render bid ineligible.
Note: Potential bidders only need to attend one (1) of the Mandatory Site Walks to meet the
requirement.
Contract Documents are available for review at on District office. In Addition, Contract Documents are
available for review at the Orinda Union School District website https://www.orindaschools.org under
Departments-Facilities-Invitation to Bid.
Each bid shall be made on the Bid Form prepared by the District in the Contract Documents and must
conform and be fully responsive to all documents comprising the Contract Documents.
The successful Bidder and its subcontractors shall pay all workers on the Project not less than the
general prevailing rate of per diem wages and the general prevailing rate for holiday and overtime work as
determined by the Director of the Department of Industrial Relations, State of California, for the type of
work performed and the locality in which the work is to be performed within the boundaries of the
District, pursuant to Labor Code § 1770 et seq. Prevailing wage rates are on file with the District and are
available to any interested party on request or at www.dir.ca.gov/oprl/statistics_and_databases.html.
Bidders and Bidders’ subcontractors shall comply with the registration and qualification requirements
pursuant to Labor Code §§ 1725.5 & 1771.1
The successful Bidder may substitute securities for any monies withheld by the District to ensure
performance under the Contract, in accordance with the provisions of Public Contract Code § 22300.
Bonds. A bid bond by an admitted surety insurer on the form provided by the District, Cash or cashier’s
check or a certified check, drawn to the order of the Orinda Union School District, in the amount of ten
percent (10%) of the total bid price, shall accompany the Bid Form, as a guarantee that the Contractor
will, within seven (7) calendar days after the Notice to Proceed or other direction, enter into a contract
with the District for the performance of the services as stipulated in the bid.
In, Addition, a hundred percent (100%) Performance Bond and a one hundred percent (100%) Payment
Bond will be required of the successful bidder.
The District’s Board reserves the right to reject any and all bids and/or waive any irregularity in any bid
received. If the District awards the Contract, the security of unsuccessful Bidder(s) shall be returned
within sixty (60) days from the time the award is made. Unless otherwise required by law, no Bidder may
withdraw its bid for ninety (90) days after the date of the bid opening.
The District shall award the Contract, if it awards it at all, to the lowest responsive responsible Bidder
based on:
