1. GENERAL INSTRUCTIONS FOR PROPOSERS:
1.1 Artificial Intelligence (AI) Disclosure:
Portions of this solicitation may have been prepared or modified with the assistance of Artificial Intelligence (AI)
technologies. All such content has been reviewed, verified, and approved for accuracy and compliance by the
Purchasing Agent prior to issuance.
1.2 Cooperative Use
Other governmental entities may piggyback on the award of this solicitation, assuming the award vendor is
amenable, and should contact Larimer County Purchasing for any necessary procurement documents. The
entity will deal directly with the award vendor concerning the placement of Purchase Orders, freight charges,
contracting and disputes, invoicing, and payment. Larimer County will not be held liable or responsible for any
liability, claims, costs, damages, demands, actions, losses, judgments or expenses incurred by the vendor or
any government entity relating to such use.

1.4 Payment:
Payment for work performed or goods sold to Larimer County can be expected within 30 days after receipt of
the invoice and satisfactory acceptance by the Department receiving the service or goods (unless otherwise
stated and agreed to by County).
1.5 Proposal Consideration:
Larimer County reserves the right to reject any and or all proposals, to further negotiate with any and/or all
qualified proposers and to waive informalities and irregularities in proposals received, and to accept any
portion of the proposal if deemed to be in the best interest of Larimer County to do so. If, in the sole judgment
of the Board of County Commissioners, the proposals are substantially equal, the Board may grant the contract
to companies located in Larimer County, however this is not applicable in the case that Federal funds are
used.
1.6 Proposal Preparation:
Proposers will not be compensated for generating, producing, or duplicating any proposal materials associated
with this RFP. Proposals must be furnished exclusive of any Federal, State, or Local taxes; Larimer County is
tax exempt.
1.7 Proposal Submission:
Proposers must be registered with BidNet in order to submit a proposal; registration is free. Larimer County
strongly recommends proposers register well in advance of the submittal deadline to ensure they have
adequate time to upload and submit their proposal.
It is the sole responsibility of the Proposer to ensure all required Proposal documents are submitted through
BidNet by the submission deadline. Proposals will be time-stamped by BidNet upon receipt; BidNet does not
allow for uploading or submitting Proposal documents after the Proposal submittals deadline has passed, so
allow adequate time to upload and submit your Proposal prior to the deadline. Larimer County will not accept
uploads that are "saved" but not "submitted". To verify that a Proposal has been submitted successfully,

Proposers are required to submit one (1) non-redacted proposal. All parts of the proposal should be
combined and submitted as one (1) single .pdf file; proposals comprised of multiple separate files are
not acceptable and your proposal may be rejected.
Proposers may choose to also provide one (1) redacted .pdf proposal (as one single file), excluding any
information that is not subject to disclosure under the Colorado Open Records Act ("CORA"), such as trade
secrets, privileged information and confidential commercial, financial, geological or geophysical data exempt

will not be honored. After the Notice of Award has been issued, all information submitted in response to this
request for proposal (RFP) may be publicly disclosed if required under the CORA. If provided, the redacted

copy will have their non-redacted electronic copy used to satisfy CORA requests. Larimer County will
endeavor to keep the non-redacted proposal, separate and apart from the redacted proposal subject to the

Proposers are required to submit one (1) non-redacted proposal. All parts of the proposal should be

By submitting a proposal, the proposer agrees they may not rescind their proposal on or after the closing date
and time identified in the RFP or as modified by addendum. No delivery will become due or be accepted until
an agreement has been completed either in the form of a formal executed contract, or a purchase order issued
by the Purchasing Manager of Larimer County. Prices and terms will remain in effect until a contract has
been executed.
1.8 Public Records:
Proposers may choose to also provide one (1) redacted .pdf proposal (as one single file), excluding any
information that is not subject to disclosure under the Colorado Open Records Act ("CORA"), such as trade
secrets, privileged information and confidential commercial, financial, geological or geophysical data exempt
from public disclosure under C.R.S. 24-72-204(3)(a)(IV). Statements that the entire proposal is confidential

Recovered Materials Requirement (2 CFR 200.323):

amended by the Resource Conservation and Recovery Act). This requires purchasing EPA-designated items
(40 CFR Part 247) that contain the highest practicable percentage of recovered materials, consistent with
satisfactory competition. This applies when the item's purchase price exceeds $10,000 or when County
purchases of that item exceeded $10,000 in the previous fiscal year. Covered categories include paper
products, vehicular products, construction and transportation products, park and recreation products,
landscaping products, non-paper office products, and miscellaneous products.
The Proposer certifies that by submitting an offer, neither the contractor nor subcontractors, the organization
nor its principals are suspended or debarred or otherwise excluded from procurement by the Federal
government and do not appear on the Excluded Parties List System (EPLS) maintained by the General

2. PROJECT OVERVIEW:
Larimer County is seeking one (1) or more qualified Consultant(s) to perform geotechnical consulting and
materials testing for various Larimer County projects. There is no guaranteed minimum amount of work to be
ordered; work will be on an as-needed basis. In addition to geotechnical consulting and materials testing, the
Consultant may perform the following tasks:
1. Field inspections.
2. Construction materials sampling.
3. Structure design information and recommendations.
4. Make recommendations with respect to testing frequencies, sub-grade stabilization, pavement designs,
etc.
5. Consult with Larimer County staff regarding a wide variety of Geotechnical and Construction related issues.
6. Perform field inspections for all phases of heavy highway and commercial building construction, as
requested by Larimer County.
7. Subsurface investigations for pavement with emphasis on the following:
7.1. Determine the underlying soil profiles and groundwater conditions.
7.2. Determine the physical conditions of the materials encountered.
7.3. Make recommendations regarding suitable pavement structures for pavement design.
7.4. Explore and evaluate the subsurface conditions relative to the proposed construction.
7.5. Make recommendations regarding selection, design, and placement of the substructure types.
7.6. Make recommendations regarding bearing capacities and culvert bedding requirements.
7.7. Recommend precautions that should be taken due to adverse soil and/or groundwater conditions.
8. Services may also be used in the event of a disaster.
Some projects may be federally funded, and services covered by federal funds must meet the requirements for
reimbursement of that federal agency. Examples of federal agency funding the County has received in the past
include:
* Federal Highway Administration (FHWA).
* Natural Resources Conservation Service (NRCS).
* Housing and Urban Development (HUD).
* Federal Emergency Management Agency (FEMA).

Past projects using Federal funds have required some or all of the following forms to be used:

* DBE Definitions & Requirements (DBE goals will be set by CDOT on a project specific basis if federal
funds are expected in the design phase).

3. QUALIFICATIONS:
Qualifications, at a minimum, include the following:
1. Consultant's field and laboratory testing of Hot Mix Asphalt (HMA) must be by a certified Laboratory for
Certification of Asphalt Technicians (LabCAT) with the appropriate-level certificate for the work to be
completed.
2. Consultant's personnel performing field and laboratory testing of concrete must be American Concrete
Institute (ACI) certified with the appropriate level certificate for the work to be completed.
3. Consultant's personnel responsible for sampling, testing, and reporting of soils must be certified through
Western Alliance for Quality Transportation Construction (WAQTC) in the Embankment and Base
Modules.
4. Throughout the duration of the agreement, Consultant must have in place, and maintain in place, a fully
equipped materials testing laboratory within 30-mile radius of Larimer County main office at 200 W. Oak
Street, Fort Collins, Colorado; this laboratory must be capable of performing all testing as defined in the
Fee Schedule (Attachment B - Fee Schedule).
5. Consultant must be able to provide field testing within 24-hours of receiving request (Larimer County
strives to provide as much advance notice as possible; however, at times urgent response for field testing
will be required).
4. SCOPE OF WORK:
The Consultant, at a minimum, will provide, perform, and/or furnish the following:
1. Larimer County strives to provide as much advance notice as possible; however, at times it will be
necessary for the Consultant to provide field testing within a maximum of 24-hours' notice.
2. Conduct laboratory and field testing as requested by Larimer County.
2.1. Results, with respect to the following tests, must be reported to Larimer County via telephone or email
within 24-hours of the sample being submitted to the lab. Results must be followed up with a typed
report within five (5) working days, and include the following information:
2.1.1. Asphalt Content.
2.1.2. Asphalt Content/Gradation.
2.1.3. Theoretical Maximum Specific Gravity (RICE) Value Determination.
2.2. Results, with respect to the following tests, must be reported to Larimer County via in-person,
telephone or email notification as soon as results are available and within time frame established by
Larimer County prior to start of project. Results must be followed up with a typed report within five (5)
working days, and include the following information:
2.2.1. Concrete Cylinder Break Results (A copy of the physical properties results, in a legible format,
must be left with the Larimer County representative in the field at time of test).
2.2.2. Proctor - Standard (T-99).
2.2.3. Proctor - Modified (T-180).
2.2.4. Concrete Beams.
2.2.5. Nuclear Field Density (Asphalt and Soil) a field copy of the test results, in a legible format, must
be left with a Larimer County project representative in the field at time of test.
3. Prepare and submit written reports for all laboratory and field testing performed.
3.1. The reports must list each test and the results individually and include information regarding location of
the test (horizontally and vertically), date of test, time of test, Consultant's name, Larimer County
project number, ticket number, and test method used.

3.2. The report should also contain an interpretation and analysis of the test results and when appropriate
should include the specification the results are to be compared against.
3.3. The Consultant will email one (1) typed and stamped copy of all reports and supporting documentation
within five (5) working days of the date of the test.
3.4. As stated above, all reports must reference the Larimer County project number and have a unique
identifier assigned (i.e. Project No. ####, Report No. ###) which will then be referenced on all
invoices.
3.5. Larimer County reserves the right to request "wet stamped" original reports.
4. Provide appropriate professional staff to consult with, and make recommendations to, the Larimer County
Engineering Department and other County departments when needed.
5. Provide recommendations in writing when requested.
6. Provide qualified personnel to perform field inspections for the construction of soils, concrete, asphalt, and
structures.
7. Subsurface Investigations:
7.1. Meet with the County Project Manager or designee at the site before fieldwork begins to review the
drilling, sampling, and testing program.
7.2. Drill, log, and sample test holes to depths and locations as agreed upon by the County and the
Consultant prior to commencing work.
7.2.1. A qualified geotechnical engineer or geologist must be present during drilling to make
continuous observations of all soils and rock formations encountered.
7.2.2. All test hole locations must be referenced by station and offset from the project centerline by the
Consultant.
7.2.3. All test holes must have the surface elevation tied into a project datum.
7.2.4. All test holes must be backfilled and compacted.
7.2.5. All test holes drilled into an existing asphaltic surface must be backfilled with flowable fill and
resurfaced with a minimum of three (3) inches of bituminous pavement material.
7.3. Conduct laboratory testing of the boring samples to determine, at a minimum, the following:
7.3.1. Moisture content and dry unit weights.
7.3.2. American Association of State Highway and Transportation (AASHTO) classifications, including
Atterberg limits and gradations.
7.3.3. Unconfined compressive strengths.
7.3.4. Consolidation and/or swell characteristics.
7.3.5. Water soluble sulfates.
7.3.6. Resistivity.
7.3.7. Conduct Hveem Stabilometer R-value and soil expansion pressure tests.
7.4. Prepare final written report.
7.4.1. The report should contain an interpretation and analysis of the data as well as definite
engineering recommendations for design based upon the various factors.
7.4.2. The materials and conditions that can be encountered during construction should also be
discussed.
7.5. Recommendations made by the Consultant should be brief, concise, and, where possible,
definite. Reasons for recommendations and their supporting data should always be included.
7.6. The written report may include the following specific items:
7.6.1. Structure Foundations.
7.6.1.1. Pile Support (if applicable).
7.6.1.1.1. Method of Support - friction or bearing, in rock or soil or both.
7.6.1.1.2. Suitable pile type or types - reasons for choice and/or exclusion of types.
7.6.1.1.3. Pile Tip elevations:
7.6.1.1.3.1.1. Estimated - average values with range or variation if desirable.
7.6.1.1.3.1.2. Specified - explain reasons, such as driving through fill, negative skin
friction, scour, underlying soft layers, piles uneconomically long, etc.
7.6.1.1.4. Allowable pile loading.
7.6.1.1.5. Settlement considerations - requirements of structure vs. soil conditions.
7.6.1.1.6. Lateral pile loading recommendations.

5. INSURANCE:
BEFORE submitting your company proposal, confirm with your insurance carrier that your company can meet
the insurance requirements published in the solicitation. Your company insurance coverages should be
correctly noted in the most current EOC. NOTE: All Larimer County contracts require that the Award Vendor
possess appropriate insurance at all times during the contract; these coverages are purchased at the
company's expense. The County's insurance requirements may necessitate a company adding or increasing

5a. INSURANCE REQUIREMENTS:
Prior to commencement of any work, contractor/vendor shall provide a Certificate of Insurance issued to
Larimer County, 200 West Oak St., Suite 4000, Fort Collins, Colorado 80521 as the Certificate Holder. The
insurance required herein shall be procured and maintained in full force and effect for the duration of the
Contract or Agreement and shall be written for not less than the following amounts, or greater if required by
law. Such certificate shall be delivered to InsuranceCert@larimer.org.
1. Workers' Compensation and Employers' Liability (waiver available if no employees)

in conjunction with primary insurance policies if necessary.
9. General Liability and Automobile Liability insurance policies shall include Larimer County and its
elected and appointed officials and employees as additional insureds as their interests may appear.
10. The County reserves the right to reject any insurer it deems not financially acceptable by insurance
industry standards. Insurance Companies shall be licensed to do business in the State of Colorado and
shall have an AM Best rating of not less than A- VII.
11. Notice of Cancellation: Each insurance policy required by the insurance provision of this Contract or
Agreement shall provide the required coverage and shall not be suspended, voided, or canceled. Should
any of the required policies be cancelled before the expiration date, notice shall be delivered to Larimer
County, 200 West Oak St. Suite 4000, Fort Collins, CO 80521 or InsuranceCert@larimer.org.
12. Subcontractors: If subcontractors are used by contractor/vendor in the performance of contracted
services, all subcontractors are required to carry insurance coverage consistent with the limits as listed in
this document and the subcontractor must include Larimer County an additional insured as described in
section VI.

A formal agreement will be awarded to the vendor with the most responsible, responsive, reasonable proposal,

The term of the agreement will be one (1) year from the date the agreement is executed. The County, at its
sole option, may offer to extend this Contract for up to four (4) additional one-year terms. The extension option

This agreement is an annual service contract. There is no guaranteed minimum amount of work to be
ordered; work will be on an as-needed basis. The Consultant's equipment and labor rates shall not be
allowed to be adjusted, regardless of actual quantities ordered, except by mutual agreement between the
parties if and when the renewal option is exercised.
The term of the agreement will be one (1) year from the date the agreement is executed. The County, at its
sole option, may offer to extend this Contract for up to four (4) additional one-year terms. The extension option

4. Colorado Constitution Article XI, 1 and 2 prohibit the County from pledging credit, providing aid, and
accepting debt/liability of another. Because of this, the County is unlikely to accept a Limitation of Liability

A Sample of Larimer County's "Professional Services Agreement" is included with this Request for Proposal as
Attachment A - Professional Services Agreement. Any exceptions or requested additions to the attached
agreement must be stated and submitted with your Proposal; these requests will not be accepted after the
Proposal has closed. The County makes no guarantee of any changes or concessions but will review and
consider all requests submitted.
Exhibit D - CONTRACT PROVISIONS FOR NON-FEDERAL ENTITY CONTRACTS UNDER FEDERAL
AWARDS found at the bottom of Attachment A - Professional Services Agreement may not be changed and
will be part of the contract. Additionally, these contract provisions must be present in any contract between the
Award vendor and any subcontractor performing any portion of the scope of services.
Upon Notice of Award, the Award Vendor will be required to submit a valid Certificate of Insurance (COI) that
meets, at a minimum, the Insurance Requirements published in the solicitation (see example COI below). This
valid COI must be received by Larimer County within 10 calendar days of the Notice of Award and must
include Larimer County listed as Additional Insured and Certificate Holder.
PAYMENT:
The Consultant will be paid based upon the Fee Schedule submitted with their proposal (Attachment B - Fee
Schedule). The Fee Schedule will be part of the agreement. The amount of such payment must be based
upon a certified progress report and billing covering the work performed.
Invoices must be submitted to the contract administrator by mail or e-mail as identified in the agreement, for
approval. The agreement is expected to cover multiple projects; therefore, the Consultant must complete a
separate monthly invoice for each project. Each monthly invoice must include the Larimer County project
number and a unique identifier that will be used during the billing process to tie each charge to a specific
report. It is expected that each project will be invoiced separately and each invoice will reference the Larimer
County project number and each individual charge will refer to the unique identifier
8. PROPOSAL SUBMITTAL REQUIREMENTS:
Please submit your proposal, addressing each of the following items in the order as outlined
below. Following submission directions detailed starting on page two (2) of this solicitation, submit only the
two (2) files identified below:
* 1 - ORIGINAL proposal - Addressing all of the items provided below. This version will be scored by
each member of the Evaluation Committee.
* 1 - REDACTED proposal - This version will be used to satisfy public records requests. This redacted
file may be the same as the original proposal if your original proposal contains nothing that is
confidential.
Vendor's Original Proposal is to be no more than 30 pages; any pages beyond this maximum will be deleted
and will not be evaluated (i.e. pages 31 through the end of your proposal will be deleted with no review of
content).
Incomplete proposals, proposals that do not adhere to the maximum page, or proposals that do not address
each of the following items in the order as outlined below may be rejected.
