Garbage and Recycling Removal Services
A: ADVERTISEMENT FOR BIDS
Sealed bids for the purchase of Garbage and Recycling Removal Services will be received
by Middletown Area School District until 9:00 a.m. June 4, 2026. Pricing shall be provided for a term
of three (3) and five (5) years. All bids are to be signed, sealed, properly identified by envelope,
and delivered to Middletown Area School District, 55 West Water Street, Middletown, PA 17057
to the attention of David Franklin. Bids will be publicly opened and read aloud after the specified
closing time. Bidding requirements and specifications are available at: www.raiderweb.org.
Middletown Area School District reserves the right to reject any and all bids, and to waive any
bid irregularities as permitted under Pennsylvania law.

B. INSTRUCTIONS TO BIDDERS
This bid package was prepared on behalf of Middletown Area School District (hereinafter referred to
as the "District," the "School District" or "Owner"). The bid package includes the following
documents, which along with any addenda issued by Owner before the opening of bids, and any
Change Orders or Construction Change Directives after entering this Agreement, shall be the
"Contract Documents" governing the bidding and contracting for this project:
A. Advertisement for Bids
B. Instructions to Bidders
C. Agreement with Vendor
D. Instructions for Non-Collusion Affidavit and Non-Collusion Affidavit
E. Description of Work, Technical Specifications, and Conditions
F. Deviation Form
G. Insurance
H. Bid Form
The following rules and procedures shall apply to this bid:
1. Bids must be submitted on the Bid Form supplied by the District. Each bid must be delivered
to the Business Office of Middletown Area School District, located at 55 West Water Street,
Middletown, PA 17057, prior to the time stated in the advertisement for bids. This is the
responsibility of the bidder. Bids received after the time set for bid opening, even if
postmarked earlier, will not receive consideration. Bids will not be accepted by facsimile or
email.
2. Bids shall be submitted sealed in an envelope that displays clearly the name of the project in
question, the bid date and the time of bid opening.
3. All bids submitted must be typewritten or legibly written in ink, and must be signed by the
bidder on the Bid Form supplied as part of this bid. Bids altered in any way will not be
accepted (i.e. erasures, white out, etc.).
4. In submitting a bid, a bidder represents that it has carefully examined specifications and
site(s) of the work and that from its own investigation it has satisfied itself as to the nature
and location of the work, the character, quality and quantity of surface and sub-surface
materials likely to be encountered, the character of equipment and other facilities needed
for performance of the work, the general and local conditions, and all other matters which
may, in any way, effect the work or its performance.
5. Each bid shall be accompanied by bid security in the amount of 10% of the base bid, or
utilizing a bank cashier or Treasurer's check payable to Middletown Area School District.
6. Additional rules governing bids:

a. Unless permitted by 73 P.S. 1602 to withdraw a bid within two business days after the bid
opening date due to a clerical mistake as opposed to a judgment mistake, no bid may be
withdrawn before the expiration of sixty (60) days from the date established for the opening
of the bids, or before the expiration of one hundred twenty (120) days in the event the award
of bids is delayed by the required approval of another government agency, the sale of bonds
or the award of grants. All bids shall remain valid and acceptable for the foregoing length of
time. This time may be extended by the mutual consent of the bidder and the District.
b. Bids will be publicly opened on the date, at the location and commencing at the time stated
in the advertisement of bids. Bidders or their authorized agents may be present.
c. The District intends to accept the bid of the lowest responsible bidder complying with all
bidding requirements. Bid will be awarded on the total cost of service for the entire district,
not on an individual building basis. The District reserves the right to reject any or all bids, and
to waive any bid irregularities as permitted under Pennsylvania law.
d. The bidder must demonstrate a successful track record in the performance of like work or the
supplying of like product. Three references including name, address, telephone number,
contact person, and scope of product or service provided are to be submitted with the Bid
Form. In addition, before any award is made, the District may require satisfactory evidence
to show that the bidder is a responsible bidder as contemplated under Pennsylvania law.
e. The Non-Collusion Affidavit included in this bid package must be completed and submitted
with the bid.

C. AGREEMENT WITH VENDOR
Middletown Area School District
This is an agreement (the "Agreement") dated , between Middletown Area School District
("District") and the following vendor,
("Vendor"), for Vendor to provide services to District after the award of a bid to Vendor.
The specifics of this Agreement are as follows:

3. By signing below, and intending to be legally bound, District and Vendor agree to comply with all terms in the bidding
documents (including specifications) of the bid that has been awarded to Vendor (the "Bidding Documents"), and also with the
following "Terms and Conditions," which cannot be modified except in writing and signed by District's authorized representative.
4. Failure to enforce any of the provisions in the Bidding Documents (including specifications) or in these Terms and
Conditions shall not constitute a waiver of such enforcement rights.
5. Vendor shall provide District with any documents required by law in connection with its awarded bid, including any material
safety documents, at or before the time of delivery.
6. The laws (including common law) of the Commonwealth of Pennsylvania shall apply to this Agreement.
7. Any dispute arising under or relating to this Agreement shall be resolved through binding arbitration at the sole election of
District pursuant to rules of the American Arbitration Association, or otherwise through a bench trial in the Court of Common Pleas
where the District's Administrative Office is located, with all parties waiving the right to a trial by jury.
8. Vendor may not assign this Agreement and the bid awarded hereunder without express written consent by District.
9. If payment and/or performance bonds are included with the Bidding Documents, Vendor shall provide such bonds in the
form required by the District, utilizing a surety qualified to do business in the Commonwealth of Pennsylvania and with an A.M. Best
Financial Strength rating of at least A-.

D. INSTRUCTIONS FOR NON-COLLUSION AFFIDAVIT
AND NON-COLLUSION AFFIDAVIT
1. This Non-Collusion Affidavit is material to any contract awarded pursuant to this bid. According
to the Pennsylvania Antibid-Rigging Act, 73 P.S. 1611 et seq., governmental agencies may
require Non-Collusion Affidavits to be submitted together with bids.
2. This Non-Collusion Affidavit must be executed by the member, officer or employee of the bidder
who makes the final decision on prices and the amount quoted in the bid.
3. Bid rigging and other efforts to restrain competition, and the making of false sworn statements
in connection with the submission of bids are unlawful and may be subject to criminal
prosecution. The person who signs the Affidavit should examine it carefully before signing and
assure himself or herself that each statement is true and accurate, making diligent inquiry, as
necessary, of all other persons employed by or associated with the bidder with responsibilities
for the preparation, approval or submission of the bid.
4. In the case of a bid submitted by a joint venture, each party to the venture must be identified in
the bid documents, and an Affidavit must be submitted separately on behalf of each party.
5. The term "complementary bid" as used in the Affidavit has the meaning commonly associated
with that term in the bidding process, and includes the knowing submission of bids higher than
the bid of another firm, any intentionally high or noncompetitive bid, and any other form of bid
submitted for the purpose of giving a false appearance of competition.

E. DESCRIPTION OF WORK, TECHNICAL SPECIFICATONS, AND CONDITIONS
The Middletown Area School District is requesting bids for the purchase of garbage and recycling
removal services. This bid is to service five (5) school buildings and the District's Operations
Building. Pricing should be provided for a five (5) year term. Term will begin July 1, 2026.
1. The vendor will furnish:
A. One (1) 6 cubic yard "dock style" dumpster to each school and the Operations Building.
B. One (1) 4 cubic yard "dock style" co-mingled recycling dumpster to each school and the
Operations Building.
C. One (1) 20 cubic yard "roll off" dumpster for construction debris to the Operations
Building.
D. One (1) 6 cubic yard "dock style" dumpster for War Memorial Field beginning in 2027
through the end of the contract from August through November.
All dumpsters must meet all current safety requirements with appropriate safety labels. Vendor
has full responsibility to place new, clean dumpsters at each site once the bid has been awarded.
Dumpsters must be kept clean and in good repair by the vendor. MASD reserves the right to
obtain a replacement dumpster upon request. Vendor agrees to replace each dumpster annually
on the bid anniversary.
Co-mingle recycling for this contract will mean that all recyclable materials will be placed in a
single container. Separation of materials will be conducted offsite and is the responsibility of the
vendor. Recyclable items shall be part of this contract mandated by the Municipal Waste
Planning, Recycling and Waste Reduction Act (Act 101). Recycling material shall include all items
required to be recycled in the municipalities where the District buildings are located or where
recycling materials are disposed, if different.

3. Additional Information Regarding Service Locations
Middletown Area School District is approaching the end a new school construction project and
reconfiguration of our elementary schools. Lyall Fink Elementary and John Kunkel Elementary will be
closed as of the end of this school year. The District desires to have one (1) 6 cubic yard "dock" style
dumpster beginning July 1st through an undetermined date, not to exceed one year for Fink and
Kunkel Elementary Schools. Service to these two buildings will be "On Call" only.
Beginning with August of 2027, the District would like one (1) 6 cubic yard "dock style" dumpster for

"On Call' garbage service only at War Memorial Field for the period of time from August through
November for the remaining years of the contract. District personnel will contact the successful
bidder for delivery and removal of the dumpster for these time periods.
4. Collection Schedules:
Awarded vendor will be working with three main collection schedules: School Term, Summer
Schedule, and On Call Schedule. In all schedules, DAILY refers to Monday through Friday.
Saturday, Sunday and holidays are not included on any schedule.
School Term Schedule (excluding Winter Break) service will begin two weeks prior to the first
day of school and end two weeks after the last day of school. A copy of the MASD Academic
Calendar is provided in this packet as Attachment "A". The Academic Calendar is produced
annually, and will be posted to www.raiderweb.org. For years in the contract after 2026-2027,
vendor may contact the Operations Department at 717-948-3300 for a copy of the
Academic Calendar and discuss schedule modifications.
For School Term Schedule Service - garbage shall be picked up at all locations DAILY. Recycling
shall be picked up at all locations on TUESDAY and FRIDAY. During Winter Recess garbage and
recycling shall be picked up once, in coordination with the Operations Department.
Summer and Winter Break Schedule service will begin two weeks after the last day of school and
end two weeks prior to the first day of school and also include the period of time when the District
is off for winter break.
For Summer and Winter Break Schedule Service - garbage and recycling shall be picked up at
High School, Middletown Area Primary School and Operations Building on TUESDAY and
FRIDAY. Garbage AND recycling shall be picked up every FRIDAY at all other locations.
On Call Schedule service for the roll off 20 cubic yard dumpster located at the Operations
Building, and service for Fink and Kunkel Elementary Schools. Additionally, on call service may be
requested for any dumpster or co-mingled recycle collection container, as needed.
For On Call Schedule Service - the District will contact vendor and both parties will agree on
a date for roll off dumpster pickup and replacement. MASD expects this service will be
provided in a timely manner once requested.
5. Other Terms and Conditions
A. Garbage and Recycling pickup shall occur based upon the following guidelines:
1. District Operations Building - No later than 10:00 am
2. Middletown Area High School - No later than 10:00 am
3. Middletown Area Middle School - No later than 10:00 am
4. Fink Elementary School and War Memorial Field - NOT BEFORE 6:00 am for the On-
Call Service. This is not a daily pickup location.
5. Reid Elementary School - No later than 10:00 am
6. Kunkel Elementary School - No restrictions. This is an On-Call Service location.
There will not be any daily pickups for this location.

B. Any pick up not completed on the scheduled data and times, through no fault of the
school district, may be cause for MASD to deduct a day's collection cost from the monthly
invoice of the vendor. The District has the right to alter/change the pickup windows on
an as needed basis.
C. Caution shall be exercised at all times to prevent damage to school properties. The vendor
shall be responsible for immediate cleaning and/or removal of spillage, leakage, etc.,
including oil and grease leakage from vendor's equipment.
D. Employees of the vendor shall not enter a school building without permission. Entry to a
school building must be made through the main office of each building.
E. No vulgar, profane or obscene language or gestures shall be allowed on school property.
F. The use of tobacco and/or vaping products is prohibited on school property.
G. The District has the right to alter, cancel/or add pickup dates to the schedule as needed.
One week notice will be given by phone or in writing, if any changes are made to the
current schedule. Any On Call pickups that are in addition to the regular scheduled
pickups will be charged based upon the cost provided in the vendor's bid response.
H. The awarded vendor will be required to assume responsibility for all services offered in
this bid packet and bid proposal. MASD will consider the selected vendor to be the sole
point of contact with regard to contractual matters. If any part of the required services
will be subcontracted, prior permission must be obtained by MASD. Any such
subcontracting must be detailed and explained. The vendor shall note in the Deviations
Section of their bid response if this will occur.
6. Removal/Addition of School or Schools from Contract
It may be necessary to delete or add a school or schools from the service locations that are now
being bid at a future date due to unknown conditions relative to changes in pupil enrollment or
other reasons. Therefore, it is the sole right of the District's Administration to reduce or add a
school at any time during this contract. Schools added to the contract may cause an increase in
total cost and schools removed must reduce the total cost. Any such adjustment shall be equal
to the current charge for a school of the same size and type.
7. Site Visitation
Interested bidders are encouraged to visit and inspect the service locations before submitting a
bid in order to familiarize themselves with the work requirements. Additional information, if
required, can be obtained from the office of the Director of Operations at 717-948-3300. The
Operations Department will assist with inspection tours. Failure to visit the service locations will
not relieve the vendor of their obligation to confirm their ability to perform the work as indicated
in the bid. At no time shall an interested vendor visit any service location for inspection or
review without prior arrangements being made with the District's Operations Department.
8. Questions

May 29, 2026. Answers will be provided via email and questions and answers will be posted
publicly on our website, www.raiderweb.org.

If a bid addendum becomes necessary. It will be posted on our website, www.raiderweb.org,
under "Our District" > "Business Office" > "RFPS, Bids and Tabulations". It is the responsibility of
any potential bidder to check our website for any addendums.
10. Hold Harmless and Indemnification Agreement
The bidder assumes full responsibility for its negligent acts, errors, or omissions and agrees to
hold harmless and indemnify the Middletown Area School District, its Board, Administration,
Agents, and Employees, from and against any and all claims, suits, damages, costs, losses, and
expenses resulting from such negligent acts, errors, or omissions while conducting activities
associated with this bid.
11. Compliance with Agency Mandates
Vendor shall comply with all local, State, D.E.P. and E.P.A. regulations. The vendor shall be
responsible for compliance with construction safety requirements of the PA Department of Labor
and Industry and the US Department of Labor Occupational Safety and Health Administration and
the rules and provisions relating to the avoidance, use of, handling, and disposal of hazardous
materials or waste as promulgated by federal, state, and local government entities.
12. Contract Termination
The contract with the winning vendor shall cease upon the termination date of the contract,
unless extended by both parties, in writing. Vendor's failure to comply with specifications, terms,
conditions, and regulations may result in immediate terminate of the contracted service by the
School District.
