Notice To Bidders
The City of Borger will receive sealed bids for the FY 2027 Vehicle Package, RFB-2027-01. Bids
must be received by 3:00 PM on Thursday, October 1, 2026. Bids received after the deadline
will not be accepted and will be returned unopened.
Bids shall be clearly marked "DO NOT OPEN - FY 2027 Vehicle Package, RFB-2027-01" and
mailed to the City of Borger, Attn: Purchasing Agent, P.O. Box 5250, Borger, Texas 79008-5250,
or delivered to City Hall, 600 N. Main Street, Borger, Texas 79007. Bids will be publicly opened
and read aloud at 3:00 PM on Thursday, October 1, 2026, in the City Council Conference
Room at City Hall, 600 N. Main Street, Borger, Texas.
Specifications and bidding documents may be obtained from the City of Borger Purchasing
Agent at 600 N. Main Street, Borger, Texas 79007, by telephone at (806) 273-0912, or through
the City's published procurement posting location.
The City intends to award this solicitation by individual vehicle item and may award one,
multiple, or all items to one or more bidders. The City reserves the right to reject any or all bids,
waive minor informalities that do not affect price, quantity, quality, delivery, or competitive
standing, and make awards in the manner determined to provide the best value to the City in
accordance with applicable law.
Pursuant to Texas Local Government Code 252.043, the City may award to the lowest
responsible bidder or to the bidder that provides the best value to the City based on the
criteria stated in this solicitation. Any local bidder preference will be considered only to the
extent authorized by Texas Local Government Code 271.9051 and the terms of this
solicitation.
Anticipated newspaper publication dates are September 10 and September 17, 2026. The City
may also provide additional electronic or direct notice to prospective vendors. The published
notice controls if any publication date changes.

Instructions To Bidders
1. Preparation And Submission
Submit one signed original bid and one copy unless otherwise stated in an addendum. Bids
must be complete, legible, and signed by an authorized representative. Electronic or facsimile
bids will not be accepted unless the City issues a written addendum expressly authorizing
electronic submission.
2. Questions And Addenda
Questions regarding this solicitation shall be directed to the Purchasing Agent at (806) 273-
0912. Any interpretation, clarification, or modification that changes the solicitation will be
issued by written addendum. Oral explanations are not binding. Bidders are responsible for
acknowledging all addenda on the Bidder Certification page.
3. Bid Deadline
The bidder is solely responsible for ensuring the bid is actually received at the designated
location before 3:00 PM on October 1, 2026. Mailing, shipping, or dispatch before the deadline
does not constitute timely receipt.
4. Bid Validity
Bids shall remain firm and may not be withdrawn for ninety (90) days following the bid
opening, except as allowed by law.
5. Award By Item
The City may award any item separately, combine items when advantageous, or make no
award on an item. The City is not obligated to award the entire package to a single bidder.
6. Brand Names And Equivalents
References to a manufacturer, model, trade name, or vehicle class establish the minimum
desired level of quality, capability, configuration, and performance. "Or equal" products will
be considered unless a specification expressly states that a particular factory package is
required for operational compatibility. The bidder bears the burden of demonstrating
equivalency.
7. Exceptions And Deviations
All deviations from the specifications must be identified on the Bid Exceptions and Deviations
Form. Failure to identify a deviation may be treated as the bidder's agreement to fully comply.
The City may reject a material deviation or determine that a proposed equivalent meets or
exceeds the stated requirement.

8. Pricing
Prices must be firm and all-inclusive through the stated delivery period. The City is exempt from
Texas sales and use taxes and federal excise taxes to the extent permitted by law. Freight,
destination, dealer preparation, required inspections, title documentation, and similar charges
must be included in the bid price.
9. Delivery And Acceptance
Vehicles shall be delivered FOB Destination to the City of Borger Vehicle Service Center, 801 N.
Florida Street, Borger, Texas 79007, unless otherwise directed. Risk of loss remains with the
vendor until City acceptance. Acceptance is subject to inspection for specification
compliance, damage, proper documentation, and satisfactory operation.
10. New Vehicle Requirement
Unless the City expressly approves otherwise in writing, each vehicle must be new, current or
next available model year at time of delivery, never placed in retail or commercial service,
and not previously titled except for a manufacturer-to-dealer or dealer-to-dealer transfer that
does not impair the full manufacturer warranty. Demonstrator, rental, prior fleet-service, or
used vehicles are not acceptable.
11. Warranty
Each vehicle must include the full original manufacturer new-vehicle warranty beginning no
earlier than the date of delivery and City acceptance. The bidder shall identify the warranty
term and any material warranty limitations. Optional extended warranties may be listed
separately and will not be included in the base price unless specifically requested.
12. Dealer Markings
No dealer advertising decals, emblems, badges, license plate frames, or other dealer
identification may be affixed to the vehicles.

Purchasing Terms And General Conditions
1. Governing Law And Venue
This solicitation and any resulting contract are governed by the laws of the State of Texas and
applicable City requirements. Venue for any permitted legal proceeding shall lie in Hutchinson
County, Texas, unless controlling law requires otherwise.
2. Best Value Award
The City will evaluate responsive bids under Texas Local Government Code 252.043 and the
evaluation criteria published in this solicitation. The lowest price does not automatically
determine award when the City uses best value.
3. Responsive And Responsible Bidder
The City may consider whether the bid materially complies with the solicitation and whether
the bidder has the capability, financial and operational resources, dealer authorization,
service support, and performance history necessary to fulfill the award.
4. Reservation Of Rights
The City reserves the right to reject any or all bids; reject an individual item; waive minor
informalities that do not prejudice competition; request clarification of an apparent clerical or
nonmaterial issue; and cancel this solicitation when determined to be in the City's best
interest. Competitive sealed bids will not be negotiated in a manner inconsistent with Chapter
252, Local Government Code.
5. Corrections
Erasures, strikeouts, or corrections must be initialed by the person signing the bid. In the event
of a mathematical discrepancy, the stated unit price will control over the extended price
unless the City determines from the bid that another interpretation is clearly intended.
6. Public Information
Bids and associated materials are subject to the Texas Public Information Act. Information
submitted to the City may be disclosed unless it is confidential by law. A bidder asserting that
information is confidential should clearly identify the material and state the legal basis for the
claim; the City cannot guarantee confidentiality merely because material is marked
proprietary.
7. Payment
Payment will be made in accordance with the Texas Prompt Payment Act and City
procedures after complete delivery, acceptance, and receipt of a proper invoice. No
payment constitutes acceptance of nonconforming goods.

8. Default And Remedies
Failure to deliver conforming vehicles within the accepted schedule, absent an approved
extension, may constitute default. The City may cancel the affected award, obtain the item
from another source, and pursue remedies available under the contract or law.
9. Assignment
The successful bidder may not assign the award or material obligations without prior written
City approval, except that manufacturer financing or customary dealer arrangements that do
not change the bidder's responsibility may be approved by the City.
10. Compliance With Law
The successful bidder and vehicles supplied must comply with all applicable federal and Texas
laws, rules, safety standards, emissions requirements, registration and titling requirements, and
any legally applicable vehicle inspection requirements in effect at delivery.
11. Indemnity
To the extent permitted by Texas law, the successful bidder shall be responsible for claims,
damages, losses, and expenses arising from its negligent or wrongful acts or omissions in
connection with performance of the contract. Nothing in this solicitation waives any
governmental immunity or defense available to the City.
12. No Collusion
By signing the bid, the bidder certifies that its prices were independently determined without
collusion, consultation, communication, or agreement with another bidder for the purpose of
restricting competition.

Best Value Evaluation And Local Preference
The City intends to evaluate each vehicle item independently. Each responsive bid will be
scored using the criteria below. The City may verify information supplied by a bidder and may
consider documented City experience with the bidder, manufacturer, or substantially similar
vehicles.

Local Bidder Preference
For an individual item that is a qualifying purchase under Texas Local Government Code
271.9051, a bidder whose principal place of business is within the City of Borger may receive
the 10 local-preference points only if (1) the local bid is within five percent (5%) of the lowest
bid price received from a nonresident bidder, (2) the applicable item contract is within the
statutory dollar limit, and (3) the City Council makes the written best-combination
determination required by law. If 271.9051 is not applicable to an item or no bidder qualifies
for the statutory local preference, the 10 local-preference points will be reallocated to
Purchase Price, making Purchase Price worth 70 points for that item. This provision is intended
to preserve the City's local-purchasing objective without extending a residency preference
beyond the authority provided by state law.
For purposes of this provision, "principal place of business" will be interpreted consistently with
applicable Texas law. A branch, sales territory, mailing address, or service location within
Borger does not by itself establish eligibility if the bidder's principal place of business is
elsewhere.

Texas Ethics And Statutory Contract Requirements
Conflict Of Interest Questionnaire - Chapter 176
A bidder must file a Conflict of Interest Questionnaire (Form CIQ) only when required by
Chapter 176 of the Texas Local Government Code. Submission of a CIQ is not a blanket
condition of responsiveness for every bidder. A vendor that is required to file must do so with
the City Secretary within the time required by law. The current form and instructions should be
obtained from the Texas Ethics Commission.
Certificate Of Interested Parties - Form 1295
If a resulting contract is subject to Texas Government Code 2252.908, the selected business
entity must complete the Texas Ethics Commission electronic Form 1295 process and provide
the required signed certification and completed disclosure to the City at the time required by
law. Form 1295 is not required to be submitted with every bid unless the City specifically
requests it after selection. The City will provide the contract identification information needed
for the filing.
Other Required State Contract Verifications
Before execution of an applicable award, the successful bidder shall provide any written
verifications or certifications required by Texas law for the particular contract, including, when
applicable, Government Code Chapter 2271 (boycott of Israel), Chapter 2274 (discrimination
against firearm entities or firearm trade associations), Chapter 2276 (boycott of certain energy
companies), and other state-law restrictions or certifications then applicable to the vendor
and contract. A statutory certification will be required only when the applicable definitions,
employee thresholds, contract value thresholds, and exceptions are met.
No Waiver
The inclusion or omission of a particular statutory clause in this solicitation does not waive a
requirement imposed by controlling law. If a statute changes before award or contract
execution, the City may require the successful bidder to execute a conforming certification or
contract addendum as a condition of award.
