FRISBIE AVENUE REHABILITATION AND BICYCLE/PEDESTRIAN
INFRASTRUCTURE PROJECT

Notice is hereby given that the City of Albany will accept sealed bids for:
Frisbie Avenue Rehabilitation and Bicycle/ Pedestrian Infrastructure Project
City of Albany, Albany County, NY
PIN 1762.31
The Owner is the City of Albany, and the work site is located in the City of Albany. The projects
limits extend from: the intersection of Frisbie Avenue and McCarty Avenue and continues north on
Frisbie Avenue to its intersection with Garden Street. The project then turns east and continues on
Garden Street to its intersection with Slingerland Street. The work includes providing all labor,
materials, machinery, tools, equipment and other means of construction necessary and incidental to the
completion of the work shown on the plans and described in these specifications including, but not
necessarily limited to the following: milling and resurfacing of Frisbie Avenue and side street
approaches, full depth reconstruction, installation of sidewalk and curbing, ADA compliant curb
ramps, installation of multi-use path, pedestrian signal equipment, RRFB pedestrian beacon system,
drainage improvements, installation of highway lighting, traffic sign replacements, and pavement
markings.
This is a Federal Aid Project and NYSDOT Standard Specifications, officially finalized and adopted
on January 1st, 2026, as posted on the New York State Department of Transportation's website must be
followed by the successful bidder.
All Portland Cement Concrete used for this Project shall be "Performance Engineered Mixture (PEM)"
as specified in the Material Section of each NYSDOT Item Specification.
This project is a federal aid Group Type 2 - Highway Improvements.
Disadvantaged Business Enterprise (DBE):
Pursuant to the U.S. Department of Transportation Interim Final Rule (Federal Register Vol. 90, No.
193; October 3, 2025; Docket No. 2025-19460), the race- and sex-based presumptions in the DBE
Program have been suspended pending development of revised federal certification standards.
Until NYSDOT establishes a new approved program in accordance with the Interim Final Rule, no
DBE participation goals may be applied. Accordingly, the DBE goal for this project is 0.0
percent (0 %).

Minority and Women-Owned Business Enterprise (M/WBE) and Workforce Goals:
In accordance with the City of Albany's M/WBE participation requirements, the following goals
are established for this contract:
* 15% M/WBE subcontractor participation goal, and
* 30% minority and women workforce participation goal.
These goals are applicable to this contract in accordance with City of Albany policy.
Equal Employment Opportunity (EEO) Employment Goals:
* 3.2 % Minority Employment Goal
* 6.9 % Women Employment Goal
The use of the NYSDOT-approved civil-rights reporting software, Equitable Business Opportunities
(EBO), is required. Access authorization to EBO can be found at https://ebo.dot.ny.gov.
No residential or geographical restrictions will be in effect for this project. Applicable Federal
requirements take precedence over State and local requirements unless state and local requirements are
deemed to be more stringent.
Complete sets of the drawings, specifications and bid forms may be examined after Friday, February
20, 2026 at the Offices of the Board of Contract and Supply, City Hall Room 202, Albany, New York
12207. Digital copies of all Contract Documents, including Invitation to Bidders, Instructions to
Bidders, Wage Rates, Bid Documents, Agreement, Special Notes, Specifications, Contract Drawings,
Bid Forms, and any Addenda may be examined on the City of Albany Bid System
(https://www.bidnetdirect.com/new-york), the City Clerk's website (https://albanyny.gov/Bids.aspx),
or the New York State Contract Reporter (https://www.nyscr.ny.gov/).
Contractors that obtain Contract Documents from a source other than the issuing office must notify the
issuing office in order to be placed on the official Plan Holder List, to receive Addenda and any other
Bid correspondence. Bids received from Contractors other than those on the official Plan Holders List
will not be accepted.
Addenda will be emailed from the City of Albany to Bidders listed on the official Plan Holders List.
An emailed response from the Bidder to the Addendum sent by the City of Albany will act as proof
that the Bidder received the Addendum. In addition to an emailed response, Bidders must
acknowledge receipt of all Addenda by signing and dating each Addendum in Section 3a of the Bid
Form. Failure of any Bidder to receive any such Addendum or interpretation shall not relive such
Bidder from any obligation under this Bid submittal. All Addenda so issued shall become part of the
Contract Documents.

Consulting, Inc. of any errors, omissions, conflicts, or ambiguity within the Contract Documents
within 14 days of bid opening.

All bids must include the completed Bid Form, Non-Collusive Bidding and Disbarment Certifications,
and Lobbying Certifications. This is a unit price bid as described in the Instructions to Bidders. No
bidder may withdraw his/her bid within forty-five (45) calendar days after the actual date of the
opening thereof.
Each bid must be accompanied by security in an amount not less than five percent (5%) of the amount
of the bid in the form and subject to the conditions provided in the Instructions to Bidders.
Bids to be considered must be received in a sealed envelope by the City of Albany at: the Board of
Contract & Supply, 24 Eagle Street, Room 202, Albany NY 12207 by 2:00pm, local time, on Tuesday,
March 17, 2026, at which time they will be publicly opened and read aloud by the City of Albany at:
the Board of Contract & Supply, 24 Eagle Street, Room 202, Albany NY 12207. Bids received after
the above noted time will not be accepted. All sealed envelopes should be clearly labeled "BID: PIN
1762.31- FRISBIE AVENUE REHABILITATION AND BICYCLE/PEDESTRIAN
INFRASTRUCTURE PROJECT." with the Bidders name and address, and the date and time of the
bid opening.
The Bidder to whom the Contract is awarded will be required to furnish Performance, Payment and
Guarantee Bonds from an acceptable Surety Company for an amount not less than 100% of the
accepted bid. The successful Bidder and all subcontractors must have an approved CCA-2 on file with
NYSDOT prior to being awarded the contract. If the successful Bidder does not currently have a
CCA-2 on file with NYSDOT, the Bidder may find the CCA-2 forms and instruction for completion
online at: https://www.osc.state.ny.us/state-vendors/vendrep/vendor-responsibility-
forms?redirect=legacy#Construction.
Additionally, the Contractor cannot submit a bid or commence work on a public works project unless
the company has registered as a Public Works Contractor with the NYS Department of Labor at:
https://mpwr-public.labor.ny.gov/en/login.
The successful Bidder will be required to comply with all provisions of the Federal Government Equal
Employment Opportunity clauses issued by the Secretary of Labor on May 2, 1968, and published in
the Federal Register (41 CFR Part 60-1, 33 F.2 7804). Successful bidders will be required to pay
prevailing wage rates on this contract.
The City of Albany reserves the right to consider the bids for forty-five (45) days after receipt before
awarding any Contract, and to waive any minor informalities in, and to reject, any and all bids. All
bids are subject to final review and approval by the City of Albany before any award of contract may
be made. Receipt of bids by the City of Albany shall not be construed as authority to bind the City of
Albany.
A Pre-Bid Conference will not be held for this project.
The work will be substantially completed on 11/20/2026 and completed and ready for final payment on
12/18/2026.
