Foundry Sanitary Sewer Improvements

REQUEST FOR COMPETITIVE SEALED PROPOSALS
PART 1. GENERAL
1.1 SEALED BIDS
Sealed bids for construction of Foundry Sanitary Sewer Improvements will be received
until Thursday, July 9th, 2026 at 2:30PM. Bids must be submitted electronically at
www.QuestCDN.com. No paper submissions will be allowed. Any Bid received after said
time and date will not be considered by the Owner. No Bid may be withdrawn after the
closing time for the receipt of Bids for a period of sixty (60) days except as specifically
provided in the Instructions to Bidders and/or by State Law.
1.2 PREBID MEETING
A non-mandatory prebid meeting will be held on Thursday, June 25th, 2026 at 10:00 AM
at the Cumming Utilities Department, Cumming City Hall, 100 Main Street, 4th Floor, Suite
401, Cumming, Georgia, 30041.
1.3 SCOPE OF WORK
Under this project, the Contractor must furnish the labor and materials necessary to install
the Foundry Sewer work, including approximately 2,500 LF of 18" PVC gravity sewer
main and 275 LF of 16" steel casing. Installation shall include all work shown in the
construction plans, including valves, manholes, and other appurtenances.
Time allotted for completion of work is 120 consecutive calendar days. All Work shall be
completed in accordance with the plans and specifications. The Work will be awarded in
one (1) Contract.
1.4 PLANS, SPECIFICATIONS AND CONTRACT DOCUMENTS
Plans, Specifications, and Contract Documents are available at www.QuestCDN.com. You
may view the digital documents for free by entering the Quest project number 8376468 on
the website's project search page. The fee to download the digital documents is $150.00
payable through the website. There will be a $45.00 fee to submit the bid online. Bids must

1.5 CONTRACTOR QUALIFICATIONS
Bidders MUST complete the Qualifications of Bidder (Section 00470) in order to be
evaluated for award of Contract. See Qualifications of Bidder for additional requirements.
The bidder's qualifications Section 00470 and any attachments must be submitted in an
envelope separate to the bidding documents. The envelope must include the Contractor's
name and "Bidder Qualifications." The remaining bid documents shall be provided as
instructed elsewhere in the specifications.
1.6 CONTRACTOR LICENSE
The Scope of Work as described herein is defined as "utility contracting" in accordance with
O.C.G.A 43-14-2(17) so the Contractor performing the work must provide proof of a valid
license by the State of Georgia as a "Utility Contractor" and must also employ a "Utility
Manager" certification holder who will have oversight of all the work. Therefore, the
Contractor submitting a bid must list the license number of the Contractor performing the
utility contracting on the Proposal form and provide proof of a valid license. See Instruction
to Bidders for additional requirements.
1.7 BONDS AND INSURANCE
Bids shall be accompanied by a bid bond or certified cashier's check in an amount not less
than 10% of the base bid. All bonds shall be by a surety company licensed in Georgia with
an "A" minimum rating of performance and a financial strength of at least five (5) times the
contract price as listed in the most current publication of "Best's Key Rating Guide Property
Liability". Performance and Payment Bonds, each in an amount equal to 100% of the
contract price shall be required of the successful bidder if contract is awarded. Each Bond
shall be accompanied by a "Power of Attorney" authorizing the attorney-in-fact to bind the
surety and certified to include the date of the bond.
1.8 GEORGIA SECURITY AND IMMIGRATION COMPLIANCE ACT AFFIDAVIT
All qualifying Contractors and Subcontractors performing work with the City of Cumming
must register and participate in the federal work authorization program commonly known as
E-Verify, or any subsequent replacement program, to verify the work eligibility information
of new employees. In order for a Bid to be considered, it is mandatory that the Bidder's

Affidavit of Compliance with O.C.G.A. 13-10-91 be completed and submitted with the
Bid.
1.9 PERMITS
All anticipated federal, state, or local permits required for the project shall be obtained by
the Engineer. GA DOT Permits will require involvement from the contractor to activate the
approved permits.
1.10 RIGHT-OF-WAY AND EASEMENTS
All anticipated rights of way and easements required will be obtained prior to the issuance
of the Notice to Proceed.
1.11 FUNDING REQUIREMENTS
This project will be procured using local funds.
1.12 RESERVATION OF RIGHTS
Owner reserves the right to reject any or all Bids, including without limitation, the rights to
reject any or all nonconforming, nonresponsive, unbalanced or conditional Bids and to reject
the Bid of any Bidder if Owner believes that it would not be in the best interest of the
Project to make an award to that Bidder, whether because the Bid is not responsive or the
Bidder is unqualified or of doubtful financial ability or fails to meet any other pertinent
standard or criteria established by the Owner.
