Bids will be accepted until Thursday August 27, 2026, at 2:00 pm local time at the Churchill County Public Works,
Planning, and Building Department, 270 S. Maine Street, Suite A, Fallon, Nevada 89406. This Invitation to Bid has
been approved by the Churchill County Commission and is published as required by law.

INVITATION TO BID TO PROVIDE MATERIALS
The Churchill County Board of County Commissioners is currently accepting bids to construct the Fallon
Churchill Fire Department Maintenance Shop. The "Work" to include the following:
- Prepare and pour concrete building footings and pad.
- Purchase and erect new metal building, including insulation, siding, and roof.
- Install mechanical, electrical, plumbing, and communications.
- Construct interior offices, storage, bathroom, mezzanine, and stairs.
- Purchase and install freestanding gantry.
- Site grading.
- Site utilities.
- Site concrete sidewalk and paving.
- Striping, signage, and bollards.
Project plans are included in the specifications attached as Exhibit A.
1) RECEIPT AND OPENING OF BIDS: Bidders shall note the difference between the bid receiving, bid
opening, and bid award times:
A. It is mandatory that bids be received at the Churchill County Public Works, Planning, and Building
Department, 270 S. Maine Street, Suite A, Fallon, Nevada 89406, before 2:00 p.m. on Thursday
August 27, 2026.
Bids received after the above-indicated time shall be deemed non-responsive and shall not be given
consideration, in the subsequent bid evaluation and award recommendation process.
B. To ensure that all bids will be considered, proposals shall be forwarded in an opaque envelope and
marked "BID ON FALLON CHURCHILL FIRE DEPARTMENT MAINTENANCE SHOP
PROJECT" in bold lettering.
C. Bids will be opened, read aloud and analyzed on Thursday August 27, 2026, at 2:00 pm at the
Churchill County Public Works, Planning, and Building Department.
D. Bids shall be awarded on September 16, 2026, during a regular meeting of the Board of County
Commissioners at 155 N. Taylor Street, Churchill County Administration Building, Commission
Chambers, Fallon, Nevada 89406.

E. Bids may be mailed or hand delivered to the office of the Churchill County Public Works, Planning,
and Building Department in accordance with the provisions of Sec. 1.0 A above. Regardless of the
method of delivery, the bids must be received by the close of bidding to be considered.
2) OPEN MEETING LAW: This invitation and bid, the award of the bid and ensuing performance is
subject to Nevada's Open Meeting Law found in NRS Chapter 241, and Nevada's Purchasing Law
found in NRS Chapter 332. Bidders should note that all public business will be conducted in an open
meeting, and challenges to the bid process or award must comply with those statutes. Violations of any
portion of the relevant Nevada or federal law may result in the contract being declared void.
3) EQUIVALENCY: All items requested to be sourced under this bid must meet the specifications set forth
in Exhibit A. Should any item to be sourced be identified by a particular manufacturer, the item may be
met by an equivalent item from another manufacturer. The Churchill County Board of County
Commissioners shall have the sole authority to determine whether an item is equivalent.
4) TIME OF COMPLETION: The contractor shall achieve substantial completion of the entire work no
later than one hundred and eighty (180) calendar days from the Notice to Proceed.
5) PUBLIC WORK: This Work is a public work as defined in NRS 338.010. All invitation and bid, the
award of bid, and ensuing construction of the Work are subject to Nevada's laws related to public works
found in NRS Chapter 338. The successful bidder will comply with all requirements of NRS 338
including the payment of prevailing wage.
6) MANDATORY PRE-BID MEETING: A mandatory pre-bid meeting and review of the worksite shall
be conducted on Thursday August 13, 2026, at 2:00 pm. Any person wishing to bid on this project
must have at least one representative attend the mandatory pre-bid meeting. The meeting will be held at
the Churchill County Public Works, Planning, and Building Department, 270 S. Maine Street, Suite A,
Fallon, Nevada 89406, if necessary, a visit to the site will follow.
7) PREPARATION OF BID
a) Bidders are expected to examine the drawings, specifications and all instructions of this Invitation and
Bid. Failure to do so will be at the bidder's risk.
b) Any irregularities or lack of clarity in the Invitation to Bid should be brought to the attention of the
Director of Public Works for correction or clarification. Unless ambiguities or irregularities existing in
the Invitation and Bid are brought to the attention of the county department, they shall be construed in
favor of Churchill County.
c) Any addendum issued shall become a part of the bid and Contract. Bidder shall be required to
acknowledge the addendum by signing and returning it with the original bid documents.
d) This entire document and any addendums thereto must be returned as part of the bid. Failure to comply
with this requirement may be grounds for non-acceptance of the bid.

e) Bidder shall furnish the required information typed or written in ink on this form. COPIES ARE NOT
ACCEPTABLE.
f) The person signing this bid must initial erasures or other changes in ink.
8) SUBMISSION OF BIDS
a) Bids shall be submitted in DUPLICATE on the forms provided by Churchill County.
b) Bids and addenda thereto shall be submitted in an enclosed envelope to the Churchill County Public
Works, Planning, and Building Department, 270 S. Maine Street, Suite A, Fallon, Nevada 89406, before
2:00 p.m. on Thursday August 27, 2026. Churchill County must receive all bids and addenda prior to
the receiving time specified to be considered. All envelopes containing bids must have the name and
address of the bidder, date of opening and the invitation number on the face of the envelope.
c) Telegraph or telephone bids will NOT be considered.
d) When a bid surety is required, such surety will be acceptable only in the form of a bid bond, certified
check, or cashier's check in the amount prescribed. This surety must accompany the bid. After the
Board of County Commissioners has made an award, the surety of the unsuccessful bidders shall be
returned. The surety of the successful bidder shall be retained until satisfactory performance has been
rendered.
9) LATE BIDS
a) Bids received after the receiving time specified in the Invitation and Bid shall be rejected.
b) BIDDER SHALL NOTE THAT THE RECEIVING TIME IS NOT THE OPENING TIME.
10) WITHDRAWAL OF BIDS
a) Bids may be withdrawn by written or telegraphic notice received prior to the bid opening time.
b) Withdrawal requests received after the bid opening time cannot be considered.
11) AWARD OF CONTRACT
a) Every contract or order for goods must be awarded to the lowest responsive and responsible bidder,
based on the factors listed in NRS 332.065 and 332.085. Churchill County shall not be obligated to
accept the lowest bid, but will make an award in the best interest of the County after all factors have
been evaluated.
b) Churchill County reserves the right to reject any or all bids, to waive any informality in the bid form,
and to hold the bids for a maximum of sixty (60) days from the date of opening before awarding or
rejecting a bid.
c) No contract awarded may be assigned to any other person without the consent of the governing body.
Requests for assignment shall be submitted to the Board of County Commissioners.
12) INCORPORATED DOCUMENTS
a) A Sample Contract is attached hereto as Exhibit B. The successful bidder shall execute a contract
substantially in line with the Sample Contract within 10 days of the Notice of Award. The Contract shall
further include this Invitation and Bid, any addendums issued to this Invitation and Bid if applicable, the

vendor's bid and all documentation contained therein, together with any subsequently issued purchase
order(s) or agreement(s) executed by a person with full power and authority to issue the same on behalf
of the County. A vendor's bid shall not contradict or supersede any County Specifications, terms or
conditions without written evidence of mutual assent to such change appearing in the Contract.
13) DEFAULT OF CONTRACT
a) In case of default by a contractor receiving a bid award, Churchill County may procure the items or
services from other sources or sell the equipment to another source and hold the bidder liable for any
excess cost occasioned thereby.
14) BONDS
a) Any bidder must enclose with its bid a bidder's bond for not less than 5% of the amount of the bid,
including any alternates.
b) Any successful bidder shall enter into and provide a performance bond for 100% of the value of the
work within 10 days of the Notice of Award.
15) SUBCONTRACTORS
a) Within two (2) hours after the completion of the opening of the bids, the Contractors who submitted the
three lowest bids must submit a list of each subcontractor who will provide labor or a portion of the
Work or improvement to the Contractor for which he will be paid an amount exceeding one percent
(1%) of the prime contractor's total bid or $50,000, whichever is greater.
16) PREFENTIAL BIDDER STATUS
a) Any bidder who wishes to receive Preferential Bidder Status under NRS 338.147 shall submit an
affidavit of entitlement to that status and a copy of the Certificate of Eligibility issued by the State of
Nevada Contractor's Board.
17) GOVERNING LAW; JURISDICTION
a) This Contract and the rights and obligations of the parties hereto shall be governed by, and
construed according to, the laws of the State of Nevada. The parties consent to the jurisdiction
and venue of the Tenth Judicial District Court, Churchill County, Nevada for enforcement of the
Contract.
18) PROTEST OF AWARD
a) Right of Protest. Any person who has submitted a bid or proposal to the County for the award of
a contract pursuant to the provisions of NRS Chapters 338 may file a written protest with the
County provided the Protester complies, as a condition precedent to consideration of such protest,
with the procedure set forth herein.
b) Filing of Protest. The written protest must be submitted in writing to the County Manager within
five (5) business days after the Notice of Award is issued by the Board of County Commissioners.
c) Protest Information. The written protest shall contain, at a minimum, the following information:

1. Bid or Request for Proposal identification number and/or title,
2. The name and address of the Protester and the title or position of the person submitting the
protest on behalf of the Protester,
3. A statement setting forth with specificity all of the reason the Protester believes the
applicable provisions of law were violated and including as a part thereof the following:
a. A detailed description explaining how the issue or issues protested created an
advantage to the other bidders, or a disadvantage to the Protester, or both,
b. A detailed statement explaining how the issue or issues protested resulted in a higher
bid being submitted by the Protester along with evidence showing the amount of the
increase, and
c. A detailed statement explaining how the issue or issues protested resulted in a lower
bid being submitted by the other bidders along with evidence showing the amount of
the increase.
d. A statement describing the relief sought by the Protester, and
e. Such other information as the Protester deems to be material.
d) The Protester shall provide such additional information requested by the County which it deems
pertinent to the consideration of the protest. The written protest shall identify all of the issues and
arguments which support the Protester's claim that the award of the contract should not be made
as proposed by the County, and any and all subsequent appeals of the decision rendered upon the
protest shall be limited solely to the issues and arguments set forth therein, and shall not include
any new or additional issues or arguments.
e) Protest Security. As a condition precedent to any consideration of the written protest, the Protester
must post a security (the "Protest Security") in the form of cash, bond, cashier's check, certified
check or money order made payable to the County. The amount of the Protest Security shall be (i)
25% of the total value of the bid submitted by the Protester to the County, (ii) 25% of the amount
of the contract as estimated by the County, or (iii) $250,000, whichever is the lesser amount. The
County Manager will deposit the Protest Security into the appropriate County account until a final
determination is made on the Protest.
f) If the Protest is upheld, or the County decides to reject all bids in connection with the Project, the
full amount of the protest Security will be returned to the Protester. If the County Manager rejects
the protest, the County will return the Protest Security within thirty (30) days of the decision after
deduction of the costs and expenses (such as the hourly wage or salary of the employees involved
in reviewing the protest) incurred by the County in considering the protest.
g) Protest Determination. With receipt of the protest and the Protest Security, the County Manager

will review the protest and, if the protest is not resolved by mutual agreement, render a written
determination within ten (10) calendar days thereof, unless the nature and complexity of the protest
requires additional time. In lieu of deciding the protest, the County Manager may forward the
protest directly to the Board of County Commissioners for their determination.
h) Appeal of Decision. The decision of the County Manager may be appealed provided written notice
thereof is provided by the Protester within three business days of receipt of the decision. Such
notice shall be given to the County Manager who, upon receipt of the notice, shall forward the
appeal for determination to the Board of County Commissioners and the matter will be placed on
its next regularly scheduled agenda.
i) No award will be made of the contract until a determination is made by the Board of County
Commissioners on the protest or until the time has expired to appeal the decision of the County
Manager. The Protester shall not seek any type of judicial intervention until the Board of County
Commissioners has made a determination on the protest and awarded the contract.
j) If the Protester seeks judicial relief from the decision of the Board of County Commissioners, the
County will retain the Protest Security until a determination is made by a court of competent
jurisdiction. If the court upholds the decision of the Board of County Commissioners, the County
may retain an amount equal to the costs and expenses incurred by the County in processing the
appeal including, but not limited to, court costs, attorney fees (including those in retaining private
counsel to defend the decision of the Board), staff time expended in processing the appeal, or costs
or retain any needed consultants or experts. If the Protester prevails on the appeal the full amount
of the protest Security will be returned to the Protester.
k) The Board of County Commissioners will not consider any protest unless the Protester complies
with the procedure set forth above.
l) Regardless of the outcome of the appeal, neither the County, nor its officer's employees or
authorized representative is liable for any costs, expenses, attorney fees, loss of income or other
damages sustained by the protester who submits a bid to the County
