Purpose of the Amendment
The amendment to this solicitation is issued to address the following questions. This section outlines the specific concerns raised and provides clarification or responses as needed to ensure transparency and understanding regarding the solicitation process.
The solicitation includes VAAR 852.219-76 and requires an SDVOSB nonmanufacturer to supply the product of a domestic small-business manufacturer or processor unless an SBA Nonmanufacturer Rule waiver applies. Please confirm whether a class or individual Nonmanufacturer Rule waiver applies to this procurement. If no waiver applies, please confirm how an SDVOSB nonmanufacturer may comply when offering the specified Philips Neximer Laser System.
The applicable NAICS code is hereby changed to 334510 (Electromedical and Electrotherapeutic Apparatus Manufacturing). In accordance with the Small Business Administration's Nonmanufacturer Rule Class Waiver for NAICS 334510, SDVOSB offerors are permitted to furnish products manufactured by other than small business concerns.
Q. The SF 1449 and quote instructions describe the requirement as brand name or equal, while the Statement of Need identifies the Philips LAS-100 Neximer Laser System as brand name. Please confirm whether equal products will be considered or whether this is a brand-name-only requirement.
A. The solicitation is revised to correct language in the Statement of Need (SON). This is a brand-name only requirement.
Q. The quote instructions state that the Limitations on Subcontracting document is located in Section C.4; however, the certification appears in Section C.7. Please confirm that offerors are required to complete, sign, and submit the certification in Section C.7.
A. This solicitation is revised to correct the instructions to offerors. The LOS Certificate is in C.7, not C.4. Vendors are required to complete, sign and submit with their RFQ response.
Q. The SF 1449 instructions direct offerors to complete Sections B.1, B.2, C.4, E.7, and E.9. The solicitation does not appear to contain Sections E.7 or E.9. Please confirm all sections, certifications, and fill-ins that must be completed and submitted with the quote.
A. The Standard Form (SF)1449, B.1, B.2, and C.7 LOS Certification must be completed and submitted with the quote.
Q. Section E.5 does not list specific evaluation factors. Please confirm the factors that will be considered during the comparative evaluation and the technical information offerors must provide to be considered for award.
A. Evaluation Lowest Price Technically Acceptable (LPTA)
The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. A price evaluation in accordance with RFO 12.203(c)(2) will be conducted. The Government will determine the total evaluated price by adding the total price for all options to the total price for the basic requirement.
