INVITATION TO BID
The Town of Fairfield (Town) on behalf of its Department of Public Works (DPW) is seeking competitive bids from qualified
Contractors to provide all labor, material, equipment and all else necessary for the repair of four (4) culverts as detailed in the bid
specifications.
BACKGROUND
The remnants of Hurricane Ida deposited almost 4 - 6 inches of rain in a span of a few hours resulting in stream and pipe
overflows which caused damage to the Town’s infrastructure. After a year and a half review with FEMA regarding the
documentation of the damage, and eligibility and approved cost estimates, FEMA has granted formal acceptance of these repairs
and has formally awarded funding for reimbursement of the project(s).
These projects involve stabilizing eroded slopes, scour within public right of way, and culvert / bridge foundation repairs. Please
refer to the attached scope of work details for each of the project locations listed below.

o Greenfield Hill Road
o Governor’s Lane
PRE-BID MEETING
A site meeting will commence at 10:00am at Governor’s Lane between Bronson Road and Hillside Road, on Wednesday,
February 14th, Fairfield for prospective bidders to scope the conditions.
While the meeting is non-mandatory, prospective bidders will be required to sign-in at commencement of the meeting.
The sign-in sheet will be posted on the Purchasing Department website as below. Copies will not be made available at the
meeting, nor will they be faxed out.
All requests for information will be answered in writing as specified below under Addenda.
ADDENDA / REQUESTS FOR INFORMATION (RFI)
Addenda concerning important information and/or modifications to specifications will be posted on the Fairfield Purchasing
Department website at http://www.fairfieldct.org/purchasing
It is each Bidder’s sole responsibility to monitor the above website for all updated information.
Addenda will not be mailed, e-mailed or faxed out.
Written requests for information will not be accepted after 4:30pm on Friday, 16th February, 2024.
Verbal requests for information via phone or other means will not be accepted.
Failure to comply with these conditions will result in the bidder waiving the right to dispute bid specifications and
conditions, no exceptions.

Response will be in the form of an addendum that will be posted approximately 21st February 2024 to the Town of Fairfield
website, which is www.fairfieldct.org. It is the responsibility of each bidder to retrieve addenda from the website. Any contact
about this bid between a Bidder and any other Town official and/or department manager and/or Town of Fairfield employee,
other than as set forth above, may be grounds for disqualification of that Bidder. No questions or clarifications shall be answered
by phone, in person or in any other manner than specified above.

BID BOND / BID SECURITY
A five (5) percent bid bond or equal approved security as stated per the Terms and Conditions must be submitted with the proposal.
All bonds, including payment and performance bonds when applicable, shall be written by a surety company or companies licensed
to issue bonds in the State of Connecticut, and shall have at least an A-VII policy holders rating, as reported by A.M. Best Rating
Services, or otherwise deemed acceptable by the Town. The Town always reserves the right to reject surety companies, if an
approved surety bond cannot be provided the bidder shall be deemed non-responsive.

SUPPLEMENTAL INFORMATION
1. A STOP work is required in the following instances:
National Historic Preservation Act (artifacts): STOP Work if archaeological deposits (for example Indian pottery, stone
tools, shell, old house foundations, old bottles) are found/uncovered during construction. The project proponent and/or their
contractor must immediately stop all work in the vicinity of the find, take reasonable measures to avoid or minimize harm to
the finds, secure all archaeological finds (without removing them), and restrict access to the area of the find. The project
proponent must immediately report the archaeological discovery to the State Emergency Management Agency and the FEMA
Deputy Regional Environmental Officer (Mary Shanks, 617-901-2204). FEMA will determine the next steps.
National Historic Preservation Act (human remains): STOP Work if human remains are discovered. The project proponent
and their contractor must immediately stop all work in the vicinity of the discovery and take reasonable measures to avoid or
minimize harm to the remains, project all human remains discoveries, and restrict access to discovery sites. The project
proponents and their contractor must follow all state laws associated with the discovery of human remains, including
immediately notifying the proper authorities. Violation of state law will jeopardize FEMA funding for this project. The project
proponent will inform the Office of the Chief Medical Examiner, the State Archaeologist, the State Emergency Management
Agency, and the FEMA Deputy Regional Environmental Officer (Mary Shanks, 617-901-2204). FEMA will consult with the
SHPO and Tribes, if remains are of tribal origin. Work in the vicinity of the discovery(s) may not resume until consultation is
completed and appropriate measures have been taken to ensure that the project is compliant with the National Historic
Preservation Act and the Native American Graves Protection and Repatriation Act.
National Historic Preservation Act (Inadvertent Effects to Structures): STOP work if any unanticipated damage, alteration,
collapse, or demolition (complete or partial) occurs to any structure over 45 years of age during construction. The project
proponent and their contractor shall immediately stop all work in the vicinity of the damage and take reasonable measures to
avoid or minimize additional harm to the structure and make it safe and secure. For Example, structures include, but are not
limited to culverts, bridges, stone walls [including those along water channels], and buildings) that are over 45 years of age
within or adjacent to the project area. As soon as possible the project proponent shall report the unanticipated impact to
structures to the State Emergency Management Agency and the FEMA Deputy Regional Environmental Officer Mary Shanks,
617-901-2204; FEMA will determine the next steps.

2. Potential restrictions may apply and documentation may be required:
National Historic Preservation Act (staging and access): Staging of equipment and materials and temporary access routes
must take place on existing hardened surfaces (for example paved or gravel roadways or parking lots). This includes, but is not
limited to, routes between staging and work areas. If it is not possible to limit access and staging areas to previously hardened
surfaces, then the project proponent must notify FEMA prior to the construction or use of any additional staging areas or access
routes. FEMA must review the staging area(s) and/or access route(s) for compliance with all applicable federal environmental
planning and historic preservation laws and executive orders. Non-compliance with this requirement may jeopardize receipt of
federal funding. Documentation of any staging areas used is required at closeout.
National Historic Preservation Act (borrow sources): All borrow or fill material must come from pre-existing stockpiles,
material reclaimed from maintained roadside ditches (provided the designed width or depth of the ditch is not increased), or
commercially procured material from a source existing prior to the event. For any FEMA-funded project requiring the use of a
non-commercial source or a commercial source that was not permitted to operate prior to the event (e.g., a new pit, agricultural
fields, road ROWs, etc.) in whole or in part, regardless of cost, the Subrecipient must notify FEMA and the Recipient (State
EMA) prior to extracting material. FEMA must review the source for compliance with all applicable federal environmental
planning and historic preservation laws and executive orders prior to a Subrecipient or their contractor commencing borrow
extraction. Consultation and regulatory permitting may be required. Non-compliance with this requirement may jeopardize
receipt of federal funding. Documentation of borrow sources utilized is required at closeout.
3. Permitting or documentation will be required at close-out: (Town will address the items below. These items have been
provided for informational purposes only and do not apply to the Contractor.)
Clean Water Act Section 404: Before construction begins, the Applicant must obtain any required Clean Water Act section
404 permit from the U.S. Army Corps of Engineers. A copy of the approval/permit, or documentation from the permitting
official that an approval/permit is not required, must be forwarded to the State and FEMA for inclusion in the administrative
record.
o Please let us know if you need any assistance with identifying an appropriate point of contact.
State Water and Soil Laws: Before construction begins, the Applicant must obtain a permit/authorization from the Fairfield
Conservation Commission (acting as the Inland Wetlands and Watercourses Agency). A copy of the approval/permit, or
documentation from the permitting official that an approval/permit is not required, must be forwarded to the State and FEMA
for inclusion in the administrative record.
