Bids for the following items will be publicly opened and read aloud at 10:00 am on Wednesday, March 11, 2026 at the
Office of the County Superintendent of Highways. All bids must be placed in a sealed envelope and shall be clearly
marked in the bottom left corner of outside envelope “SEALED BID -
”. All materials being bid must meet the
specifications of the New York State Department of Transportation. It is the bidder’s responsibility that bids are received
by this office prior to the start of the bid opening. Late submissions for any reason will not be opened. No emailed or
faxed bids are accepted. Detailed information and specifications may be obtained by visiting or contacting the Office of the

The County of Wyoming reserves the right to reject any or all bids for individual items or for items collectively.

- The County of Wyoming reserves the right to utilize National Cooperative Contracts, NYS Office of General Services
(OGS) Contracts or other Municipal Contracts to procure any supplies, commodities, services or technology that are
available under those programs, which may include items or services included in the bid solicitation.
- Crushed aggregates, stone fill and asphaltic concrete are to be hauled from source in County Trucks and/or delivered by
suppliers, as specified.
- In purchase of above materials, where County Trucks are used for delivery, the County of Wyoming reserves the right to
purchase all or part of a season’s requirements from the source requiring the shortest haul to a destination, to obtain the
most advantageous total price to the County.
- The County of Wyoming reserves the right to make purchases of materials for specific projects during the year and to
make awards for such materials on the basis of separate bids where it appears in the best interest of the County to do so.

BASE TERMS FOR ALL BID SOLICITATIONS
1. Executory Clause
Wyoming County shall have no liability under any contract or contracts or to anyone else beyond funds appropriated and
available for the purpose of this specification and resultant contract(s).
2. Assignability
The contractor shall not assign, transfer, convey, sub-contract, sublet or otherwise dispose of all or portions of this contract
(and/or work to be performed as a result of the contract) or its right, title, or interest to any other person, company,
corporation, without prior written consent of the Superintendent of Highways.
3. Extension of Contract Usage
Political subdivisions within New York State (Towns, Villages, School Districts and Fire Districts), as defined in Section
#103 of the General Municipal Law may participate in any contract awarded as a result of this bid document as long as it is
mutually agreed to by both parties. Responsibility, financial or otherwise, for purchase(s) made by other parties as a result
of the extension of this contract, shall not be borne by Wyoming County.
4. Contractor’s Failure to Comply
The contractor’s failure to perform in compliance with the bid award shall result in withholding of payment. The payment
shall be withheld until such times as the contractor fulfills its responsibilities. Compliance shall be determined by and to
satisfaction of Wyoming County. Such action would not necessarily preclude further initiatives on the part of Wyoming
County to protect and preserve its best interest.
5. Cancellation of Contract
Wyoming County reserves, as its right, to cancel the contract(s) resulting from an award of this bid solicitation at any time
during the contract period, without penalty to Wyoming County and without stated reason, by delivering a written ten (10)
day notice of intent to the contractor(s) or its representative(s). Said notification mailed to the contractor or its
representatives via the US Postal Service, First Class Mail shall be considered sufficient and delivered.
6. Contractor Registration Requirement (NYS Labor Law 220-i)
Effective December 30, 2024, all contractors submitting bids for or performing work for a municipality must be registered
with the New York State Department of Labor (NYSDOL) in accordance with Labor Law 220-i.
Contractors must be registered prior to submitting a bid or starting work. Proof of registration, in the form of a Certificate
of Registration issued by NYSDOL, must be provided to the County upon submission of each bid. Failure to comply may
result in rejection of bid.
7. Certified Payroll
Pursuant to Article 8 of the New York Labor Law, the Contractor and all Subcontractors shall maintain and submit certified
payroll records for all work performed under this Contract. Certified payroll transcripts shall be provided to the
Municipality within thirty (30) days of the first payroll and every thirty (30) days thereafter for the duration of the Work,
and as a condition of final payment. All payroll submissions shall comply with applicable New York State prevailing wage
requirements, including electronic submission requirements where mandated by law.

CONTRACT PERIOD:
May 1, 2026 to October 31, 2026
ALTERNATE SOURCE:
Where a New York State bid or a bid from another municipality results in an award for an item herein at a total price
which is more favorable than that of the bidder to whom an award is made herein, and such price is available to
County, County reserves the right to purchase from the State bid or from such other, alternate bid, notwithstanding
its award to the lowest responsible bidder herein, after offering the County bid awardee an opportunity to meet or
better the item price.
MUNICIPAL EXTENSION:
Wyoming County reserves the right to allow all municipal and not for profit organizations authorized under the
General Municipal Law of the State of New York, to purchase any goods (materials and equipment) and/or services
awarded as a result of this bid in accordance with the latest amendments to NYS GML 100 through 104. However,
it is understood that the extension of such contracts is at the discretion of the vendor and the vendor is only bound to
the contract between Wyoming County and the vendor.
SPECIFICATIONS:
All joint & crack filler/sealer furnished and/or applied, shall be in accordance with Specifications for Bituminous
Materials in the NEW YORK STATE DEPARTMENT OF TRANSPORTATION STANDARD
SPECIFICATIONS, CONSTRUCTION AND MATERIALS DATED MAY 1, 2008 or latest revisions thereof.

GENERAL:
Standard Specification for Joint and Crack Sealants, Hot Applied, for Concrete and Asphalt Pavements
(ASTM D6690 Type II)
MATERIAL REQUIREMENTS:
Use a sealant that appears on the Approved List for Joint Materials, Pavement / Highway Joint Sealants (ASTM
D 6690, Type II) (705-02). The bidder, upon request, shall submit a copy of the certification with typical test
results for the material.
Each container shall be legibly marked with the following information:
1. Manufacturer’s Name
2. Trade name of the sealant
3. Manufacturer’s lot or batch number
4. Pouring temperature
5. Safe heating temperature
The supplier shall provide the purchaser with the manufacturer’s name, the trade name of the sealant, the
manufacturer’s batch number, recommended pouring temperature, safe heating temperature, and a copy of the
manufacturer’s recommendations pertaining to heating and application. The temperature of the sealant as discharged
from the Melter shall be at least equal to or above the Manufacturer’s recommended minimum pouring temperature
and equal to or below the Manufacturer’s safe heating temperature.
Sealant material heated beyond the safe heating temperature shall not be used. Sealant material may be reheated or
heated in excess of six hours providing the manufacturer’s recommendations pertaining to heating and application
allow it.
If this is done, the Melter shall be recharged with fresh material amounting to at least twenty percent of the volume
of the material remaining in the Melter.
The County reserves the right to conduct sampling and testing to verify specification compliance.

TEMPERATURE REQUIREMENT:
All crack filling and sealing work done under this contract shall be performed when ambient temperatures are 40° F
or higher.
EQUIPMENT REQUIREMENTS:
When the filler or sealants are required to be supplied in hot oil-heated, containerized, mobile tanks, the equipment
shall consist of a double boiler type Melter.
The filler or sealant shall be heated in a Melter constructed either as a double boiler with the space between the inner
and outer shells filled with a heat-transfer medium, or with internal tubes or coils carrying the filler or sealant
through a heated oil bath and into a heated double wall hopper. Direct heating shall not be used. The Melter shall be
capable of maintaining the specific pouring temperature within +40° F. The Melter shall be equipped with positive
temperature controls, and with mechanical agitation or a re-circulation pump capable of assuring a homogeneous
blend of the filler or sealant. The Melter shall have separate thermometers to indicate the temperature of the heat-
transfer medium, and the filler or sealant material in the hopper. Before any crack filling or sealing shall commence,
the Engineer or agency representative shall inspect the Melter to ascertain the presence and working conditions of
the thermometers. Under no circumstances will the Engineer or agency representative permit any crack filling or
sealing if the thermometers are found to be defective or missing.
The application equipment shall be capable of heating 75% of the capacity of the tank in one hour when ambient
temperatures are 70° F.
The contractor shall be responsible for a safe and efficient method by which the engineer or agency representative
will be able to accurately measure the temperature of the filler or sealant as it is discharged to the applicator wand.
The proposed method must be submitted to the engineer or agency representative for their approval prior to the start
of crack filling or sealing operations. The contractor shall provide the engineer or agency representative with two
(18-inch stem) thermometers having a temperature range sufficient to meet this requirement.
The discharge hose shall be equipped with a thermostatically controlled heating apparatus or shall be insulated
sufficiently to maintain the proper sealant or filler temperature. The application wand shall be returned to the
machine if it is not thermostatically heat controlled, and material recirculated as necessary to maintain the proper
sealant or filler pouring temperature between individual crack sealing or filling operations.
When compressed air equipment (125 cubic feet per minute minimum) is required to be supplied, suitable traps or
devices shall be installed on this equipment to prevent moisture and oil from contaminating the crack surfaces. The
contractor shall maintain these devices and see that they are functioning properly.
STRIKE-OFF FLUSH APPLICATION METHOD - ASTM D6690 Type II only
Heat, haul, deliver (in hot oil-heated, containerized, mobile tanks), clean cracks (using air compressor with
minimum 125 cubic feet per minute), and seal cracks at the locations. Contractor to supply and operate all
equipment, including that required to clean and seal cracks. The municipality shall determine if traffic control is
required by the Contractor. Overall Supervision shall be provided by the Contractor.
Only well-defined single cracks shall be sealed. Sealing shall be limited to cracks from 1/8 inch to 1 inch wide, at
locations as directed by the Engineer or agency representative. Cracks with varying widths, portions of which are
1/8 inch wide or greater, shall be sealed along their entire length.
Where secondary cracking exists, seal only the primary (widest) crack. Do not seal secondary cracks, or excessive
material width and thickness will result.
All cracks shall be thoroughly cleaned of dust, dirt, foreign material, sand and any other extraneous materials by
high pressure air or a hot air lance. When using a hot air lance, care shall be taken so as not to burn, scorch or ignite
the adjoining pavement. The material and debris shall be blown from the crack and pavement to prevent
recontamination of the crack. The crack sides shall appear thoroughly clean and dry immediately prior to sealing.
The Contractor shall be ordered to re-clean cracks if, in the opinion of the agency representative, adequate cleaning
and drying is not evident. Any cracks not sealed the same day shall be re-cleaned prior to sealing.
Cracks shall be sealed by placing the applicator wand in or directly over the crack recess and carefully discharging
the sealant just to fill the crack. The material shall be struck-off flush with the pavement surface using a sealing shoe

and/or “V”- shaped squeegee pressed firmly against the roadway surface. Only a narrow, thin “film” of material
shall be permitted on the pavement surface, no greater than 4 inches wide and 1/32 inch thick. Sealant in excess of
the specified narrow, thin “film” amount shall be removed from the pavement surface and disposed of properly, at
the Contractor’s expense.
Traffic shall not be allowed on the sealant until it has cooled sufficiently and will not track. A low pressure, light
spray of water may be used to accelerate cooling of the filler or sealant. Blotting with fine aggregate will not be
allowed.
Sealant that becomes damaged from traffic or from the removal of over-applied amounts shall be repaired. The areas
shall be cleaned with high pressure air and then have additional sealant applied to the satisfaction of the Engineer or
agency representative, at the Contractor’s expense.
Deficient areas where sealant has sunk into the crack more than 3/8 inch below the pavement surface shall be
cleaned with high pressure air and additional sealant installed, to the satisfaction of the Engineer or agency
representative and at the bid price. Cleaning of damaged or deficient areas shall not require removal of the sealant
from a crack that has been sealed.
PAYMENT:
Payments shall be made at contract price per gallon for the actual quantities of crack filler/sealer furnished to and
verified by the receiving agency. This determination as to quantities involved in any contract shall be accepted as
final and binding. A delivery slip stating quantities shall accompany each shipment. Measurement shall be based
on the volume of crack filler/sealer at a temperature of 15 degrees C. The method to be used for volume corrections
shall be the method and coefficients of expansion given in the “Standard Petroleum Tables, A.S.T.M. D1250”.
DELIVERY TICKET:
A delivery ticket shall be provided with each load of crack filler/sealer stating the following:
1. Storage facility identification
2. Ticket Number
3. Date/time
4. Item Number and Type
5. Quantity
PRICE ADJUSTMENTS:
1. Price adjustments allowed will be based on the November 2025, average of the F.O.B. terminal price per metric
ton of unmodified PG 64-22 binder without anti-stripping agent (based average F.O.B. terminal price). The new
monthly average terminal price will be determined by the New York State Department of Transportation based on
prices of preapproved primary sources of performance graded binder in accordance with the New York State
Department of Transportation Standard Specification. The November 2025, average is $638.00/Ton English.
NOTE: the same grade of asphalt cement used in establishing the base average F.O.B. terminal price shall be used
in establishing the new average F.O.B. terminal price.
2. The new average F.O.B. terminal price will be determined based on the above F.O.B., terminal prices posted on
or about the 25th of each month, hereafter known as the “Adjustment Date”. However, price adjustments, in
accordance with the formula below, will be effective for deliveries made on and after the first of the month (i.e.,
March 1, 2026) following the adjustment date.
3. The unit prices of bituminous materials purchased from any award based on this
specification will be subject to adjustment based on the following formula:
