Separate sealed bids for construction of CONTRACT NO. TBD-2025 RESURFACING OF THE

LICKING VIEW NEIGHBORHOOD will be received by the MUSKINGUM COUNTY

COMMISSIONERS at their office at 401 Main Street, Zanesville, Ohio, 43701 until December 8,

2025 at 10:00 am, local time, and then at said office publicly opened and read aloud.

The Instructions to Bidders, Form of Bid, Form of Contract, Specifications and Forms of Bid

Guaranty Bond, may be examined at the following:

Resurfacing of the Licking View Neighborhood:

UNIT PRICE CONTRACT consisting of milling (pavement planing) and resurfacing of approximately

310,241.15 square feet of existing pavement to complete the work within the Licking View

neighborhood. Of that amount, 59,328.97 square feet will be milled/resurfaced on behalf of Falls

Township.

Owner anticipates that the Project’s total bid price will be approximately $738,683.50. The project has an

expected duration of 40 days to Substantial Completion and 60 days to Final Completion.

A Pre-Bid Conference for the Project will NOT be held.

The Owner reserves the right to waive any informality or to reject any and all Bids.

Each Bidder must submit with his Bid, security in the amount, form and subject to the conditions

provided in the Instruction for Bidders.

All work done under this contract shall be subject to all Federal Davis Bacon Wage rates and rules.

Each Proposal must contain the full name of the party or parties submitting the proposal and all persons

interested therein. Each Bidder must submit evidence of its experiences on projects of similar size and

complexity.

All Contractors and subcontractors involved with the project will, to the extent practicable use Ohio

Products, materials, services, and labor in the implementation of their project. Additionally, Contractor

compliance with the equal employment opportunity requirements of Ohio Administrative Code Chapter

123, the Governor’s Executive Order of 1972, and Governor’s Executive Order 84-9 shall be required.

The Contractor shall not discriminate on the basis of race, color, national origin or sex in the performance

of this contract. The Contractor shall carry out applicable requirements of 40 CFR Part 33 in the award

and administration of contracts awarded under EPA financial assistance agreements. Failure by the

Contractor to carry out these requirements is a material breach of this contract which may result in the

termination of this contract or other legally available remedies.

This procurement is subject to the EPA policy of encouraging the participation of small business in rural

areas (SBRAs).

Domestic iron and steel use requirements as specified in P.L. 113-76, “Consolidated Appropriations

Act, 2014” apply to this project. See additional information titled United States Environmental

Protection Agency Memorandum found under Document 00820 (Additional Articles) in the Contract

Documents.

The Build America Buy America Act, enacted as part of the Infrastructure Investment and Jobs Act on

November 15, 2021, established a domestic content procurement preference for all Federal financial

assistance obligated for infrastructure projects after May 14, 2022. The domestic content procurement

preference requires that all iron, steel, manufactured products, and construction materials used in

covered infrastructure projects are produced in the United States.

Federal law at 31 U.S.C. § 1352 (hereinafter “Byrd Amendment”) prohibits the use of appropriated

funds by recipients of a “Federal contract” for purposes of influencing or attempting to influence

federal officials in connection with a “Federal action,” such as the awarding of a “Federal contract.”

The Byrd Amendment prohibits contractors from using appropriated funds for lobbying in connection

with a contract, grant, loan or cooperative agreement with a Federal agency. The Byrd Amendment

additionally requires the contractor to disclose its lobbying activities to the Federal agency connected

with such contract, grant or loan when the contract amount exceeds $100,000.

No Bidder may withdraw his Bid within 60 days after the actual date of the opening thereof.
