The Town of Derry, New Hampshire is seeking proposals from qualified consultants or firms to provide
Community Power / Community Choice Aggregation consulting services. The selected consultant will
assist the Town with program design, community education, aggregation plan modification (as needed),
regulatory compliance, electric distribution company data coordination, competitive supplier solicitation,
contract negotiation, customer enrollment, program launch, and ongoing program management.
Proposals shall be submitted in accordance with the instructions in this RFP. The Town reserves the right
to reject any or all proposals, waive informalities, request clarifications, conduct interviews, negotiate
scope and compensation with one or more proposers, and select the proposal deemed to be in the best
interest of the Town.
1. PURPOSE AND OVERVIEW
The purpose of this RFP is to select an experienced, supplier-agnostic consultant to help the Town of
Derry evaluate, develop, implement, and manage a Community Power program under New Hampshire
law. The Town seeks a partner with demonstrated municipal aggregation experience, deep knowledge of
New Hampshire's Community Power framework, competitive supplier market access, strong public-
facing communication capabilities, and the operational capacity to support Derry before and after
program launch.
2. BACKGROUND
BACKGROUND:
The Town of Derry is the fourth largest population in New Hampshire with just over 34,000 residents.
The Town has four franchise areas serviced predominantly by Eversource, then New Hampshire Electric
Cooperative and a small number of customers on Liberty and Unitil. The Town would expect that the
respondent would be able to price Community Power for as many of the franchise areas as feasible.
The Town of Derry has established an Electric Aggregation Committee, and their Electric Aggregation
Plan was approved by Derry Town Council on September 5, 2023, and subsequently approved by
NHPUC under docket number DE23-069.
New Hampshire law authorizes municipalities and counties to aggregate retail electric customers to obtain
competitive electric supply and related energy services. The Town of Derry is evaluating a Community
Power program to provide eligible customers with competitive supply options, preserve customer choice,
support rate stability, improve transparency, and potentially advance local energy and sustainability
objectives. Customers would continue to receive delivery service from the electric distribution utility, and
participation would be subject to the opt-out and customer-protection requirements applicable to
Community Power programs.
3. SCOPE OF SERVICES
1. Program Assessment and Planning. Work with Town staff and any designated committee or
working group to evaluate program goals, customer impacts, rate competitiveness, renewable
product options, governance structure, implementation schedule, and required municipal
approvals.
2. Community Power Plan Development. Modify the existing Electric Aggregation Plan (as
necessary) to satisfy all applicable statutory, regulatory, and utility requirements, including
procedures for customer enrollment, opt-out, customer inquiries, supplier issues, distribution
utility coordination, and ongoing program administration.
3. Public Engagement and Education. Develop clear public-facing materials, presentations,
FAQs, website content, and meeting materials that explain the program in plain English, including
customer choice, rate options, opt-out rights, renewable options, and expected benefits and
risks.
4. Regulatory and Utility Coordination. Support all required notices, filings, data requests,
distribution utility coordination, customer data analysis, and commencement-of-service
requirements, including coordination with the New Hampshire Public Utilities Commission, New
Hampshire Department of Energy, and the applicable electric distribution utility.
5. Competitive Supplier Procurement. Design and manage a competitive, supplier-agnostic
solicitation process for licensed competitive suppliers, including bid specifications, supplier
outreach, bid evaluation, risk analysis, and recommendations to the Town.
6. Contract Negotiation and Rate Recommendation. Assist the Town in reviewing pricing
options, contract terms, renewable content, risk allocation, pass-through provisions, regulatory-
change provisions, customer protections, billing requirements, and approval procedures before
the Town authorizes any supply agreement.
7. Program Launch and Customer Enrollment. Manage launch activities, including customer
notification, opt-out and opt-in processes, coordination with the supplier and utility, call-center
and website readiness, communications support, and issue-resolution procedures.
8. Ongoing Program Management. Provide continuing market monitoring, supplier contract
oversight, customer participation reporting, performance comparison versus utility default
service, regulatory monitoring, renewal procurement support, and periodic updates to Town
officials.
9. Additional Energy Services. Describe any complementary municipal energy services the
proposer can provide, including net metering or shared solar advisory, credit reconciliation,
demand response, energy efficiency, on-site solar, battery storage, municipal energy
procurement, or other distributed energy resource solutions.
10. Integrated Service Options and Value-Added Benefits. Describe any optional service
bundles, complementary energy services, customer or municipal value enhancements, credits,
rebates, administrative efficiencies, or other cost-offset opportunities that may be available to
the Town if multiple related services are procured from the proposer. Any such options should be
clearly described, separately priced or valued where applicable, and presented in a manner that
allows the Town to evaluate them without obligating the Town to select any additional service.
4. PROPOSAL FORMAT AND REQUIRED CONTENT
1. Cover Letter. Provide a signed cover letter summarizing the proposer's interest, eligibility,
ability to complete the work with its current workload, and any conflicts of interest.
2. Executive Summary. Provide a concise overview of the firm, its Community Power / CCA
experience, and why the proposer is positioned to deliver superior outcomes for Derry.
3. Firm Qualifications and Municipal Experience. Describe the firm's experience with
Community Power, Community Choice Aggregation, municipal energy procurement, public
engagement, regulatory filings, supplier solicitations, program launch, and ongoing operations.
Identify programs taken from plan development through launch and provide current program
status.
4. New Hampshire Experience. Describe the firm's specific experience in New Hampshire,
including familiarity with RSA 53-E, Puc 2200 requirements, electric distribution utility processes,
data-request procedures, supplier market conditions, and municipal approval processes.
5. Assigned Derry Community Power Team. Identify the specific team that will be assigned to
Derry. For each individual, provide name, title, role on the project, office location, years of
relevant experience, relevant municipal or CCA experience, and a brief biography. Identify the
day-to-day project manager and the senior executive responsible for quality control and
escalation.
6. Firm Staffing and Capacity. State the proposer's total number of employees, number of
employees dedicated to energy advisory or municipal aggregation work, number of employees
located in New England, and number of employees expected to support Derry. Describe how the
firm will maintain continuity if key personnel are unavailable.
7. Program Performance and Rate Comparison. Provide at least one example of an active
Community Power or CCA program served by the proposer and compare the program's current or
most recent rate against the applicable utility default service rate for the same period and
customer class. Include product description, renewable content, term dates, CCA rate, utility
rate, net difference in dollars per kWh and percentage, and sources for both rates.
8. Supplier Market Access. List the licensed competitive suppliers the proposer has engaged
for municipal aggregation or similar solicitations in New England during the past twenty-four
months. Disclose any affiliations, financial relationships, exclusivity arrangements, or referral
arrangements with suppliers.
9. Optional Bundled Services and Value-Added Proposal. Identify any optional bundled
service offerings, cross-program efficiencies, municipal cost offsets, credits, rebates, or other
value-added benefits the proposer is willing to make available to the Town in connection with the
services requested in this RFP. Proposers should describe the conditions, limitations, estimated
value, implementation requirements, and whether the benefit is contingent upon the Town
selecting additional services beyond Community Power consulting.
10. Supplier Market Access. List the licensed competitive suppliers the proposer has engaged
for municipal aggregation or similar solicitations in New England during the past twenty-four
months. Disclose any affiliations, financial relationships, exclusivity arrangements, or referral
arrangements with suppliers.

11. Compensation Proposal. Provide the proposed management fee or compensation structure,
including any per-kWh fee, supplier-paid fee, municipal-paid fee, implementation fee, ongoing
management fee, or other charges. The proposal must clearly state whether any costs would be
paid directly by the Town.
12. References. Provide at least three municipal references for similar Community Power, CCA,
or municipal energy advisory engagements, including contact name, title, municipality, email,
phone, scope of services, and program status.
13. Conflicts and Disclosures. Disclose any actual or potential conflicts of interest, pending
litigation, regulatory actions, material contract terminations, or supplier relationships relevant to
the services requested in this RFP.
5. MINIMUM QUALIFICATIONS
1. Demonstrated experience advising municipalities on Community Power, Community Choice
Aggregation, municipal aggregation, or comparable public-sector electric supply programs.
2. Ability to provide supplier-agnostic procurement advice and demonstrate access to multiple
licensed competitive suppliers.
3. Knowledge of New Hampshire Community Power requirements, including municipal plan
development, public approval processes, regulatory filings, utility coordination, and customer
notification requirements.
4. Capacity to provide public education, customer communications, supplier procurement,
contract review, launch management, and ongoing reporting.
5. Named project personnel with relevant experience and sufficient firm staffing to support
Derry through implementation and ongoing operations.

7. SUBMISSION INSTRUCTIONS
Proposals must be received by July 24, 2026 at 4pm. Submit three (3) hard copies and one electronic
copy, or submit electronically as directed by the Town, to Michael Fowler, mikefowler@derrynh.gov.
Questions regarding this RFP must be submitted in writing by July 15, 2026 at 4pm. Responses will be
issued via the Town website. Proposals shall remain valid for at least ninety days unless a longer period is
stated by the proposer.
8. GENERAL CONDITIONS
1. The Town may request clarifications, conduct interviews, negotiate scope or compensation,
and request best and final offers.
2. The Town may reject any or all proposals, waive technical or legal deficiencies, and select the
proposal deemed most advantageous to the Town.
3. Selection of a consultant does not obligate the Town to execute a supply agreement, launch a
Community Power program, or maintain a program after launch.
4. Any consultant agreement shall not require the Town to execute any contract with a
competitive supplier unless approved by the Town in its sole discretion.
5. The consultant shall be independent of any competitive supplier unless fully disclosed and
accepted by the Town in writing.
6. All work product prepared for the Town shall become the property of the Town, subject to any
mutually agreed confidentiality or proprietary limitations.
