LEGAL NOTICE
Notice is hereby given that pursuant to a resolution of the Town Board of the Town of Grand
Island, Erie County, New York, sealed Proposals will be received and considered by the Town
Board on July 8, 2026 August 12, 2026, at 10:00 a.m. local time at the Town Hall for furnishing
all labor, equipment and other facilities required for the collection, hauling and disposal of
garbage, refuse, waste materials, bulk items and/or single stream recyclable materials from all
single family residential units, including duplexes, triples and townhouses within the Town of
Grand Island Refuse and Garbage District No. 1.
The Proposals will be received in accordance with the Town of Grand Island Bidding Documents
for Collection, Hauling and Disposal of Municipal Solid Waste & Recyclables, all of which are on
file with the Town Clerk at her office in the Town Hall, Grand Island, New York, where the same
may be examined during the usual hours of business.
Copies of the said Specifications may be obtained at the office of the Town Clerk, Town of
Grand Island, 2255 Baseline Road, Grand Island, New York 14072 on or after June 5, 2026,
between the hours of 8:30 a.m. and 4:30 p.m.
The Town will accept written comments and questions submitted to the Town Engineer, Robert
H. Westfall, P.E., rwestfall@grand-island.ny.us until 2:00PM on June 17, 2026, and will answer
questions via an addenda to the extent the Town deems necessary no later than June 24, 2026.
The Town of Grand Island reserves the right to reject any and all Bids, or waive any
informalities.
Each Proposal must be accompanied by a Bid Bond having a surety thereon from a surety
company acceptable to the Town Attorney, in an amount not less than five percent (5%) of the
amount of Contract A, conditioned that if the Proposal is accepted, the Contractor will enter into
a Contract for the same, for the faithful performance of the Contract.
No Bidder may withdraw or modify his Bid within forty-five (45) calendar days after the date set
for the opening thereof but may withdraw same at any time prior to the scheduled time for the
opening of Bids, providing Bidder provides written notice of withdrawal or modification to the
Town Board.
Each Bid Proposal must be submitted in the complete bound Specification Booklet Form with
Bid Bond attached, enclosed in a sealed envelope addressed to the Town of Grand Island. On
the outside of the envelope, clearly label "Collection, Hauling and Disposal of Municipal Solid
Waste & Recyclables" and indicate name and address of Bidder. Proposals not meeting this
format will be unacceptable.

PART A.
INSTRUCTIONS TO BIDDERS
ARTICLE 1
1.1 NOTICE OF INTENT OF THIS INVITATION
The Town hereby invites Bids on a Contract for Garbage Collection and Disposal services on
the forms attached hereto. The work shall include the furnishing of all labor, materials and
equipment to collect and dispose of/process all garbage, refuse, waste materials, bulk items
and/or single stream recyclables from all single-family units, including duplexes, triples and
townhouses within the Town of Grand Island Refuse and Garbage District No. 1. The Board
hereby reserves the right to reject any or all Bids, or to award the Contract to any responsible
Bidder whose Bid is in the best interests of the Town as determined by the Board. It is the
intention of the Board to obtain safe and reliable garbage collection and disposal services.
Except where indicated otherwise by specific reference, all Bids and the above referenced
Contract, during its terms, shall be subject to the following terms and conditions.
1.2 DEFINITIONS
"Town" is the Town of Grand Island.
"Board" is the Town Board of the Town.
"Bidder" is any individual, company or corporation submitting a Bid.
"Bid" is a complete and properly signed proposal to provide residential Garbage Collection and
Disposal services required for the sum stipulated therein supported by data called for by the
Bidding Documents.
"Bidding Documents" include the "Legal Notice," "Instructions to Bidders," all "Terms and
Conditions," the "Bid Proposal Forms" and the "Agreement" including any "Addenda" issued
prior to receipt of Bids.
"Bid Proposal Forms" are all forms and documents to be completed by the Bidder including
the Agreement, which should be executed by the Bidder at the time of submission.
"Terms and Conditions" constitute any description in the Bidding Documents of services,
materials, supplies, and/or equipment required for the performance of the obligations under the
Contract or the circumstances under which such services, materials, supplies, and/or
equipment are to be provided.

"Addenda" are written instruments issued by the Town prior to the opening of Bids which
modify or interpret the Bidding documents by additions, deletions, clarifications or corrections.
"Successful Bidder," also referred to as the "Contractor," is the Bidder to whom the Contract
is awarded.
"Contract" is the Bidding Documents and Notice of Award.
"Garbage, refuse and waste material" shall include, but is not limited to: non-hazardous
domestic household garbage, burnable and non-burnable rubbish, refuse, plastic containers,
glass, bottles, wastepaper, rags, ashes, plaster, stones, bricks and building materials (except
such building materials as may have been left by a contractor working on the premises).
"Single Stream recyclables" shall include, but is not limited to: empty glass containers, empty
plastic containers, empty cans, cardboard, metal and wastepaper. (see Appendix 7)
"Bulk Items" shall include, but is not limited to: furniture, mattresses and box springs, carpets,
Christmas trees in addition to "White Goods" such as hot water tanks, dishwashers, stoves,
washer/dryers, large refrigerators/freezers and other large metal residential appliances. Any
appliances containing refrigerant are to be professionally decommissioned by the resident prior
to collection and be affixed with a label by the professional certifying as such. This term does
not include air conditioners, covered electronic equipment (CEE), microwave-emitting
equipment, microwave ovens and regulated material.
All definitions set forth in the Terms and Conditions are applicable to the Bidding Documents.
All words used in the masculine gender herein also apply in the feminine.
ARTICLE 2
BIDDER'S REPRESENTATION
2.1 Each Bidder by making his Bid represents that:
The Bidder has read and understands the Bidding Documents and his Bid is made in
accordance therewith.
He has visited the Town and has familiarized himself with the local conditions under which the
garbage collection and disposal services are to be provided.
His Bid is based on equipment, services, materials and supplies described in the Bidding
Documents without exception.
He understands that no pleas of ignorance relating to any data, conditions or requirements that
exist or may be encountered under the Contract will be accepted by the Town as an excuse for
any failure or omission on the part of the Contractor to fulfill in every respect all the
requirements of the Bidding Documents, nor will the same be accepted as a basis for any

claim whatsoever for extra charges for Garbage Collection Disposal services, and that the
excuse by the Town of any default on the part of the Contractor hereunder does not mean that
any future default will be so excused.
ARTICLE 3
BIDDING DOCUMENTS
3.1 COMPLETE SETS
Complete sets of Bidding Documents shall be used in preparing Bids; the Town does not
assume any responsibility for errors or misinterpretations resulting from the use of incomplete
sets of Bidding Documents.
The Town in supplying copies of the Bidding Documents does so only to obtain Bids on
Garbage Collection and Disposal and does not confer a license or grant for any other use.
3.2 INTERPRETATION OR CORRECTION OF BIDDING DOCUMENTS
Bidders shall promptly notify the Town of any ambiguity, inconsistency or error which they may
discover upon examination of the Bidding Documents, routing information or local conditions.
Any clarification, interpretation, correction or change of the Bidding Documents will be made by
Addendum. Clarifications, interpretations, corrections or changes of the Bidding Documents
made in any other manner will not be binding, and Bidders shall not rely upon such
clarifications, interpretations, corrections or changes.
3.3 SEVERABILITY
Whenever possible, each provision of the Bidding Documents shall be interpreted in such
manner as to be effective and valid under any applicable law or regulation. If any provision of
the Bidding Documents shall be prohibited by or invalid under any such law or regulation, such
provision shall be ineffective to the extent of such prohibition or invalidity without invalidating
the remainder thereof or any of the remaining provisions of the Bidding Documents.
3.4 APPLICABLE LAW
The Bidding Documents and the Contract shall be governed by and interpreted and construed
in accordance with the laws of the State of New York.
