The City of Tega Cay (“City”) is soliciting sealed proposals from qualified consulting firms to conduct a comprehensive Classification and Compensation Study. This Request for Proposal (RFP) is issued in accordance with procurement procedures for the City. The City of Tega Cay ("City") is soliciting sealed proposals from qualified consulting firms to
conduct a comprehensive Classification and Compensation Study. This Request for Proposal
(RFP) is issued in accordance with procurement procedures for the City. The City reserves the
right to reject any or all proposals, waive informalities, and negotiate with one or more Offerors
if deemed in the City's best interest.
SCHEDULE AND PROCUREMENT PROCESS

Questions shall be submitted in writing via email to the Contact listed above. Responses will be
issued by written addendum only. Proposals received after the submission deadline will not be
opened or considered.
BACKGROUND AND PURPOSE
The City of Tega Cay employs approximately (one hundred thirty-five)135 full-time employees
and provides a full range of municipal services. The City seeks to engage a qualified consultant
to evaluate and update its existing classification and compensation system to ensure:
* Internal equity and logical job classification
* External market competitiveness within relevant labor markets
* Compliance with applicable federal and South Carolina employment laws
* Alignment with current organizational structure and service delivery models

Departments included in this study include general Government Administration, Municipal
Court, Finance, Development Services, Police, Fire, Public Works, Parks & Recreation, and
Utilities.
SCOPE OF SERVICES
The selected consultant shall perform, at a minimum, the following services:
1. Classification Review
a. Review and validate all existing job descriptions
b. Conduct job analysis through interviews, questionnaires, or audits
c. Recommend appropriate job classifications based on duties, responsibilities, and
required qualifications
d. Ensure proper alignment with Fair Labor Standards Act (FLSA) requirements
2. Compensation Analysis
a. Conduct an internal equity analysis
b. Identify appropriate peer and comparator markets (with City approval)
c. Perform external salary and total compensation benchmarking
d. Assess pay ranges, progression, and differentials
3. Organizational and Staffing Review
a. Evaluate current staffing levels by department
b. Provide benchmark-based staffing recommendations considering service demand,
population, and workload indicators
4. Deliverables
a. Draft and final written report detailing methodology, findings, and recommendations
b. Updated classification plan and compensation structure
c. Implementation options with fiscal impact scenarios
d. Executive-level presentation to City leadership
PROPOSAL REQUIREMENTS
Proposals shall be concise yet sufficiently detailed and must include the following sections:
1. Firm Qualifications and Experience
Experience conducting classification and compensation studies for South Carolina
municipalities or similar public sector entities.
2. Project Team
Identification of project manager and key staff, including resumes and relevant experience.
3. Proposed Methodology and Work Plan
Detailed approach, project phases, stakeholder engagement, and timeline.
4. Relevant Experience and References
Minimum of three references for comparable projects, including South Carolina
municipalities where possible.

5. Cost Proposal
Itemized, fixed-fee cost proposal identifying all anticipated expenses.

Submit one (1) digital copy (USB flash drive) and three (3) bound hard copies clearly labeled:
"City of Tega Cay Classification and Compensation Study RFP"
The City is not responsible for delivery delays. It is the offeror's responsibility to ensure timely
receipt.
EVALUATION CRITERIA
1) Minimum Qualifications (Required)
a. Minimum three (3) years of experience conducting classification and compensation
studies
b. Completion of at least three (3) similar studies
c. Demonstrated knowledge of applicable federal and South Carolina employment laws
d. Ability to commence work within thirty (30) days of notice to proceed
2) Comparative Evaluation Factors
Proposals meeting minimum requirements will be evaluated based on:
a. Relevant experience and past performance
b. Quality and clarity of proposed methodology and work plan
c. Qualifications of assigned personnel
d. Cost reasonableness and value
Price shall not be the sole determining factor. The City Manager reserves discretion to select the
proposal deemed most advantageous to the City to present to City Council for consideration of
award.
CONTRACTURAL AND LEGAL REQUIREMENTS
1. Indemnification
The successful Consultant agrees to protect, defend, indemnify, and hold the City of
Tega Cay, its officers, employees, and agents free and harmless from and against all
losses, penalties, damages, settlements, costs charges, professional fees or other
expenses or liabilities of every kind and character arising out of or relating to any and all
claims, liens, demands, obligations, actions, proceedings or cause of action of every kind
and character in connection with or arising directly or indirectly out of this agreement

and/or the performance hereof, without limiting the generality of the foregoing, any and
all such claims, relating to personal injury, infringement of any patent, trademark,
copyright, (or application for any thereof) or of any other tangible or intangible personal
or property right, or actual or alleged violation of any applicable statute, ordinance,
administrative order, rule or regulation, or decree of any court will be included in the
indemnity hereunder. The contractor further agrees to investigate, handle, respond to
provide defense for and defend any such claims, at his/her sole expense and agrees to
bear all other costs and expenses related thereto, even if such claim is groundless, false,
or fraudulent.
2. Compliance with Law
The selected consultant and its agents and employees shall be bound by and comply
with all federal, state and local laws, ordinance rules and regulations, as well as all
other governing bodies having legal jurisdiction with respect to the area where such
work is performed.
3. Proprietary/Vendor Disclosure - Notice of SC Freedom of Information Act
The parties acknowledge that all material submitted may be subject to release under the
South Carolina Freedom of Information Act (FOIA) and will be released to the public
unless exempt from disclosure under FOIA. We discourage you from including any
information you consider proprietary or a trade secret, as this material is subject to the
FOIA once it is in the City's possession. If you must include such information in your
submission, please identify it by color, labeling, and/or bold font so that it can be
readily identified. In the event the City receives a request for this material, the City will
notify those parties who have identified information they believe is proprietary or trade
secret of the request. The City has a ten (10) day deadline to produce the material. This
is your window to file an action with the City challenging the release. Please be aware
that if the City is not provided such an action, the information will be released.
4. Disqualification, Rejection of Quotations and Cancelation
The City of Tega Cay reserves the right to reject any consultant who has failed to
perform satisfactorily, or complete on time, or in a manner consistent with the proposal
documents, contract of similar nature, or to reject the RFP of a consultant who is not able
to perform such contract satisfactorily. The City expressly reserves the right to award the
contract to the consultant that best meets the requirements as set forth herein and is, in
the sole discretion of the City, the most advantageous for the City.
5. Insurance
Consultant agrees that Consultant shall keep and maintain general automobile
liability insurance in the amount of $ 1,000,000 per occurrence for each vehicle and
$1,000,000 in aggregate for all vehicles which Consultant brings onto City property
or use in any manner in the provision of services, including transportation to and
from the site(s) where the services are rendered; and Consultant further agrees that
Consultant shall maintain general liability insurance in the amount of at least

$1,000,000 per incident/occurrence and $1,000,000 in aggregate for all
incidents/occurrence during the contract period; and Consultant agrees that
Consultant shall maintain Worker's Compensation Insurance in accordance with
State and Federal laws on all the Consultant's employees. In no event shall the
Consultant serve as self-insurer for Workers Compensation Insurance. The
Consultant also agrees that the Consultant shall provide, in a form acceptable to the
City, certificates of Worker's Compensation Insurance, Automobile Liability
Insurance and General Liability Insurance prior to the "Notice to Proceed" being
issued.
6. City Business License
The successful consultant, prior to execution of the contract, must possess or
obtain a City of Tega Cay Business License. Such license must be maintained
throughout the duration of the contract. The fee for such license is based on the
amount of the contract with the City if the Consultant is not currently doing any
other business within the City Limits. If the Consultant is currently doing other
business within the City Limits of Tega Cay, and does not possess a business
license, then the fee for the license is based on the total gross receipts from
customers within the City Limits. Contact the City Business License Office at
803-548-3513 to determine the exact amount or to ask other pertinent questions
regarding doing business in the City of Tega Cay.
RESERVATION OF RIGHTS
This solicitation does not commit the City of Tega Cay to award a contract, to pay any cost
incurred in the preparation of a proposal, or to produce a contract for services. The City of
Tega Cay reserves the right to accept or reject any or all proposals received, or to cancel it
in part or in its entirety if it is in the best interest of the City. The City reserves the right to
change the solicitation schedule or issue amendments to the solicitation at any time.
GENERAL TERMS AND CONDITIONS
1. RECEIPT AND OPENING OF SEALED PROPOSALS:
a. Sealed proposals will be received as specified in this RFP document.
b. The City will consider as non-responsive any proposal not prepared and submitted in
accordance with the provisions hereof and may waive any informality or reject any
and all proposals. Any proposal may be withdrawn prior to the above scheduled time
for the opening of proposals or authorized postponement thereof. Any proposal
received after the time and date specified shall not be considered.
2. PREPARATION OF PROPOSALS:
a. All proposals will be evaluated in accordance with the responsiveness to same
determined in accordance with the instructions and criteria in this document. Any
proposal not providing sufficient information and documentation to comply with the

RFP Evaluation requirements will be considered non-responsive and removed from
further consideration.
b. Proposals shall be made in the official name of the firm or individual under which
business is conducted (showing the official business address) and must be signed in
ink by a person duly authorized to legally bind the person, partnership, company, or
corporation submitting the proposal.
c. All information shall be typewritten.
d. One (1) electronic copy and three (3) bound copies of each proposal must be
submitted in a sealed envelope. The submitted offeror is required to have printed on
the envelope or wrapping containing their proposal: offeror business name and
address and the proposal title. If forwarded by mail, the sealed envelope containing
the proposal must be enclosed in the outer envelope. The City shall not be responsible
for unidentified proposals.
e. Offerors mailing their proposals must allow a sufficient mail delivery period to ensure
timely receipt of their proposal. The City is not responsible for proposals delayed by
mail and/or delivery services of any nature. It is the offeror's sole responsibility to
ensure that all documents are received by person (or office) at the time indicated in
this RFP document. No facsimile or email submissions will be accepted.
f. Each offeror shall acknowledge receipt of all addenda by its submission of a proposal.
It shall be each offeror's responsibility to assure that all addenda have been received.
Addenda, if there is any, will be posted on the RFP/Bid page of the City's website.
No claim for failure to receive addenda will be considered.
3. OFFEROR QUALIFICATIONS:
To be acceptable to the City, offerors must be skilled and/or licensed, if applicable, in the
class of work on which they respond, and no proposal will be considered from any offeror
who is unable to show that he/she has actually performed considerable work of similar
character to that on which he is responding.
4. EXECUTION OF CONTRACT:
The offeror to whom an award is made shall deliver to the City a Certificate of Insurance,
listing the City of Tega Cay as additional insured, prior to execution of the contract.
5. TERM OF CONTRACT AND CONTRACT DOCUMENTS:
a. The contract documents that will form the contract shall include:
i. The Complete Request for Proposals
ii. All Addenda
iii. The Successful Offeror's Submitted Proposal Packet
iv. Notice of Award (Verbal or Written)
v. Executed Contract
b. Proposals must be submitted must be in a form suitable for incorporation, verbatim,
into the contract.

c. No written contract may be assigned, sublet, or transferred without the written
consent of the City.
6. RIGHT TO INCREASE OR DECREASE THE AMOUNT OF WORK:
The City reserves the right to increase or decrease the amount of work under the Contract at
the unit prices quoted in the proposal received from the successful offeror (if applicable).
7. LAW AND REGULATIONS:
The offeror's attention is directed to the fact that all applicable Federal, State and Local laws,
statutes, ordinances, and the rules and regulations of all authorities having jurisdiction over
the project shall apply to the contract and the project throughout, and they will be deemed to
be included in the contract the same as though herein written out in full.
8. METHOD OF AWARD:
a. Contracts will be awarded to the offeror whose proposal appears to serve the best
interest of the City. The successful offeror will be determined as prescribed herein
this document.
b. The City reserves the right to accept or reject, in whole, in part, together or
separately, any and all responses as they appear in its sole judgment to be in the best
interests of the City, or to waive any and all technicalities and informalities in
determining the action of each proposal.
9. OBLIGATION OF OFFEROR:
At the time of the delivery of the proposal, each offeror will be presumed to have read and to
be thoroughly familiar with the RFP Documents (including all addenda). The failure or
omission of any offeror to examine any form, instruction or document shall in no way relieve
any offeror from any obligation in respect to this RFP.
VENDOR AGREEMENTS
1. STATEMENT OF RIGHTS:
The City reserves the right to obtain clarification or additional information necessary to
properly evaluate a proposal. Vendors may be asked to give a verbal presentation of their
proposal after submission. Failure of vendor to respond to a request for additional
information or clarification could result in rejection of that vendor's proposal. The City
reserves the right to accept or reject any and all proposals, in whole or in part, separately or
together, with or without cause; to waive technicalities in submissions, to secure a project
that is deemed to be in the best interest of the City. The City also reserves the right to make
purchases outside of the awarded contracts where it is deemed in the best interest of the City.
2. GENERAL TERMS:
Each offeror by submitting a response to the City as a result of this RFP, agrees to and
acknowledges its acceptance of and agreement with the procedures outlined below and the
terms, conditions and requirements of the applicable the City RFP document. Agreement is
evident by the submission of a response to the City. If a vendor cannot agree to these terms,
or violates these procedures, the response will be judged non-responsive and not considered.

If the procedures are violated during the evaluation process or prior to the issuance of a
contract by the City, the offer of the firm in question will be void and the City will procure
the goods/services in question from other eligible vendors.
3. SPECIFIC TERMS:
a. Any deviation from specifications in the proposal solicitation must be clearly pointed
out; otherwise, it will be considered that the items offered are in strict compliance
with these specifications, and the successful offeror will be held responsible,
therefore.
b. Any attempt by a vendor to influence the opinion of the City staff, or City Council, by
discussion, promotion, advertising or any procedure to promote their offer, will
constitute grounds to judge such a proposal as non-responsive. All proposals
presented to the City will be evaluated based on the current City Code and the offer as
presented to the City on the date/time specified in the given solicitation.
c. All vendors are informed that the City Manager may exercise the City's option to
extend the contract and/or purchase order under the provisions of City Code should
such extension be mutually agreeable between the City and the selected vendor.
d. The Offeror agrees to secure at Offeror's own expense all personnel necessary to
carry out Offeror's obligations under this Proposal. Such personnel shall not be
deemed to be employees of the City nor shall they or any of them have or is deemed
to have any direct contractual relationship with the City. The City shall not be
responsible for withholding taxes with respect to the Offeror's compensation
hereunder. Offeror shall not hold himself out as an employee of the City and shall
have no power or authority to bind or obligate the City in any manner, except City
shall make payment to Offeror for services as herein provided. Offeror shall obtain
and maintain all licenses and permits required by law for performance of this contract
by him. The Offeror shall have no claim against the City hereunder or otherwise for
vacation pay, sick leave, retirement benefits, social security, worker's compensation,
health or disability benefits, unemployment insurance benefits, or employee benefits
of any kind. State or Federal governments, including but not limited to Social
Security, workmen's compensation, Employment Security, sales or use tax and any
other taxes and licenses or insurance premiums required by law. The City shall pay
no employee benefits or insurance premiums of any kind to or for the benefit of
Offeror or his employees, agents, and servants by reason of this contract.
e. The vendor will act in an independent capacity and not as officers or employees of
the City. The vendor shall indemnify, defend and hold harmless the City, its officers,
agents and employees from liability and any claims, suits, judgments, and damages of
any nature brought because of, arising out of, or due to breach of the agreement by
Vendor, its subcontractors, suppliers, agents, or employees or due to any negligent act
or occurrence or any omission or commission of Vendor, its subcontractors, suppliers,
agents, or employees.

f. The successful vendor shall indemnify and hold harmless the City, its officers, agents
and employees from all suits or claims of any character resulting from patent,
trademark or copyright infringement or accidents/injury at any point in the delivery of
goods/services.
g. It is the responsibility of the prospective offeror to review the entire request for
proposals packet and to notify the City Manager's Office if the specifications are
formulated in a manner that would unnecessarily restrict competition. Any such
protest or question regarding the specifications or responding procedures must be
received by the City Manager's Office not less than fifteen (15) days prior to the time
set for proposal opening. These requirements also apply to specifications or
instructions that are ambiguous.
h. Should any vendor fail to perform or comply with any provision or terms and
conditions of any documents referenced and made part hereof, the City may terminate
this contract, in whole or in part, and may consider such failure or non-compliance a
breach/default of contract. The City reserves the right to purchase any/all items or
service in default on the open market. By submitting a response, all vendors agree to
this provision. No additional responses will be considered from a firm in default until
the default expenses are paid. No principals of a defaulting firm may submit a
response under another organization or individual name until their previous default is
settled.
i. The City may terminate this agreement with or without cause at any time. In the event
of termination by either party, uncontested fees due for services satisfactorily
performed or goods accepted prior to the termination shall be paid.
j. Submit three (3) bound copies and one (1) digital copy of your response.
k. All submittals become the property of the City.
l. All proposals (and supporting documents) will be retained by the City for a period of
three (3) years from the date the proposals are opened after the opening hour
commences.
m. S.C. LAW CLAUSE: Upon award of a contract under this proposal, the person,
partnership, association, or corporation to whom the award is made must comply with
the laws of South Carolina, which require such person or entity to be authorized
and/or licensed to do business in this state. Notwithstanding the fact that applicable
statutes may exempt or exclude the successful offeror from requirements that it be
authorized and/or licensed to do business in this state, by submission of this signed
proposal, the offeror agrees to subject itself to the jurisdiction and process of the
courts of the State of South Carolina, to all matters and disputes arising or to arise
under the contract and performance thereof, including any questions as to the liability
for taxes, licenses, or fees levied by the State.
