Notice & Invitation to Bid
Christiana River Force Main, Phase 1 Bypass,
Heald Street Bridge
Sealed bids are invited for the installation of approximately 2,000 linear feet (LF) of new 84 inch
wastewater force main bypass piping. The project includes force main installation, concrete
structures, valve installation, dewatering, utility relocation, and maintenance of traffic.
The work is located in the Southbridge area of the City of Wilmington, just south of the
Norfolk Southern railroad at the Townsend Street off-ramp of Heald Street.
Sealed bids addressed to the New Castle County Purchasing Division will be received by
the Purchasing Division, New Castle County Government Center, 87 Reads Way, New
Castle, DE, 19720, telephone (302)395-5250 until 2:00 p.m. on April 28, 2026 when they
will be opened and read publicly.
Bid envelopes shall carry a clear notation " Christiana River Force Main, Phase 1
Bypass" Contract 2026-02, Bid #25-2529. Contractors proposing to submit a bid must
acquire the Bid Package (Plans, Specifications, Qualification application) and register with
Johnson, Mirmiran & Thompson, Inc. by contacting Olivia Sylvester, osylvester@jmt.com;
Once registered, bidders will receive an a link to download the documents at no charge.
Bids shall be accompanied by a bidder’s bond, certified or cashiers' check in an amount
equal to 10% of the bid price, payable to New Castle County and conditioned to be forfeited
to said County for failure to enter into a contract, if awarded. The bid bond shall be an
original document containing original signatures and original seals shall be attached if the
corporate surety and/or bidder have corporate seals.
Awards, if any, will be made to the lowest and best responsible bidder. The County reserves
the right to reject all bids and to waive minor irregularities. The successful Bidder will be
required to give bond of a surety company, acceptable to the County, and licensed to do
business in the State of Delaware, in the amount of the contract price.
QUALIFICATION
New Castle County will only accept bids from contractors qualified to bid on this project.
Qualification forms are included in the project specification and are available separately by
contacting Anthony Schiavi, P.E., anthony.schiavi@newcastlede.gov or John Wolos,
john.wolos@newcastlede.gov. Qualification forms will be received by the Department of
Public Works until March 6, 2026. Qualification applications will be evaluated on the basis
of experience information contained within the completed qualification application. Current
New Castle County qualifications held by potential bidders will not be considered in the
review of qualification for this bid. Applicants will be notified of approval or denial of the
application in accordance with Item #6 of the General Rules and Regulations of
Qualification.
CONTRACTOR RESPONSIBILITY CERTIFICATION
Contractors proposing to submit a bid to New Castle County for a Public Works contract expected
to exceed $500,000.00 are required to complete and submit a signed original Contractor
Responsibility Certification (CRC) form. The New Castle County Department of Public Works
Contracts Officer must receive this executed form no later than the advertised deadline for bid
submittals. Failure to submit the form by that time shall result in the County’s inability to consider
your bid for award. CRC forms submitted by facsimile will not be accepted. Bidders are encouraged to
submit the form in advance of the Bid. The form is included in the project specification and is also
available from the Contracts Officer and at: http://nccde.org/documentcenter/view/46791.

MANDATORY PREBID MEETING
There will be a mandatory pre-bid meeting for prime bidders at 10:00 a.m. on February 12, 2026 in the
William J. Conner Building, 187-A Old Churchmans Road, New Castle DE 19720. Interested bidders may

ALCOHOL & DRUG TESTING
New Castle County Code, Section 2.05.305 requires contractors and subcontractors who work pursuant
to a Public Works contract to implement a mandatory alcohol & drug testing program for their employees.
Included in the specifications for this project is an affidavit for certifying compliance with the Code
requirements. This affidavit must be executed and submitted with the bid. Failure to submit the affidavit by
that time shall result in the County’s inability to consider your bid for award. Forms submitted by facsimile
will not be accepted.
SMALL BUSINESS ENTERPRISE PROGRAM
This contract will be awarded pursuant to New Castle County’s Small Business Enterprise (“SBE”)
Program. All bidders must comply with the SBE Program by either (i) satisfying the Project Goal through
utilization of an SBE to perform work under the contract; or (ii) demonstrate their good faith effort to obtain
SBE participation in the contract. SBE Program forms are available on New Castle County’s website and
are included in the specification. These forms must be included with your bid. Further information
regarding the SBE Program, including guidance for compliance with the Project Goal, can be found by

5198. The SBE participation goal for this contract is 2%.
DELAWARE WATER POLLUTION CONTROL REVOLVING LOAN FUND
This project is funded in part by the Delaware Water Pollution Control Revolving Loan Fund. Contractors
and subcontractors must comply with the related Program requirements, which include but are not limited
to the payment of Davis-Bacon prevailing wages, American Iron & Steel requirements, Alcohol & Drug
testing of employees, Equal Opportunity and non-discrimination in employment.
WATER INFRASTRUCTURE FINANCING AND INNOVATION ACT (“WIFIA”) FUNDING
This project is funded in part through assistance provided under the Water Infrastructure Finance and
Innovation Act (“WIFIA”), 33 U.S.C. § 3901 et. seq. as administered by the U.S. Environmental Protection
Agency. The contractor agrees to comply with all requirements applicable to contracts funded with WIFIA
assistance including the requirements set forth by Uniform Administrative Requirements, Cost Principles,
and Audit Requirements for Federal Awards, 2 CFR Part 200, other than such provisions as the federal
administrative authority (Treasury) may determine are inapplicable to a WIFIA funded project or to the
extent to which the assistance may be subject to such exceptions. A non-exhaustive list of federal
contract requirements is included with the Bid Package. It is the contractor’s responsibility to ensure
compliance with all applicable Federal, State and County requirements. Contractor is responsible for
ensuring that any applicable requirements are included in any subcontract it may enter. Please be
advised that Executive Order 14173 revoked Executive Order 11246, Equal Employment Opportunity.
However, the Department of Labor issued regulations implementing certain sections of the EO 11246 at
41 CFR part 60. Until the U.S. Department of Labor revokes these regulations, they remain effective law
and compliance is required. Federal goals are currently unavailable. Federal goals will be provided to
the Contractor if they become available.
PREVAILING WAGES
The payment of prevailing wages as determined by the State of Delaware Department of Labor and/or the
Davis-Bacon Act to all mechanics and laborers working on the project is required. Contractors are
required to pay the higher of the rates to mechanics and laborers working on the project and to report
sworn certified payroll information to New Castle County and the State of Delaware Department of Labor.
The rate schedules applicable to this project are included in the specification.
