April 9, 2026, then publicly opened and read aloud. A Mandatory Pre-bid meeting will be held
at 2:00pm, April 2, 2026 to address bid requirements and questions.

Each Bid must be accomNpanied by a PROPOSAL GUARANTY payable to the CITY OF
OWASSO for Five Percent (5%) of the total amount of the BID. As soon as the BID prices have

been compared, the CITY OF OWASSO will return the GUARANTY to all except the three
lowest responsible BIDDERS. When the Agreement is executed, the GUARANTY of the two
remaining unsuccessful BIDDERS will be returned. The GUARANTY of the successful
P
BIDDER will not be returned until the PERFORMANCE AND MAINTENANCE AND
STATUTORY PAYMENT BONDS have bUeen executed and approved, after which it will be
returned. A certified check may be used in lieu of a PROPOSAL GUARANTY.

PERFORMANCE AND MAINTENANCE AND STATUTORY PAYMENT BONDS in the
P
amount of 100 percent (100%) of the Contract Price, with a corporate surety approved by the
CITY OF OWASSO, will be required for the faithful perforOmance of the contract.
Attorneys-in-Fact who sign BID, PERFORMANCE ASND MAINTENANCE AND
STATUTORY PAYMENT BONDS must file with each Bond a certified and effective dated

copy of their power of attorney.

IMPORTANT: SURETY COMPANIES EXECUTING BONDS MUST APPEAR ON THE
TREASURY DEPARTMENT'S MOST CURRENT LIST AND BE AU THORIZED TO
O
TRANSACT BUSINESS IN THE STATE WHERE THE PROJECT IS LOCATED.

All BIDS must be made on the required BID form. ALL blank spaces for BID prices must be
filled in, in ink or typewritten, and BID form must be fully completed and executed when

submitted. BIDS carrying riders, alterations of construction time or qualifications which modify
Y
the amount of the BID as submitted can be rejected as irregular. BIDDER must fill out the BID
form and other required documents for the bid opening.
The CITY OF OWASSO may waive any informalities or minor defects or reject any and all
BIDS. Any BID may be withdrawn prior to the above scheduled time for the opening of BIDS
or authorized postponement thereof. Any BID received after the time and date specified shall
not be considered. No BIDDER may withdraw a BID within thirty (30) calendar days following

the actual date of the opening thereof. Should there be reasons why the contract cannot be
awarded within the specified period, the time may be extended by mutual agreement between the
CITY OF OWASSO and the BIDDER.

time of the BID submittal. All forms are included. BIDDERS are only required to submit all
subsections of Section 00200 (See Section 00110: Requirements for Bidders) at the time of

1. DEFINED TERMS

Terms used in these Instructions to Bidders, which are defined in the Standard General
Cond itions of the Construction Contract, have the meanings assigned to them in the General
ConditVions. The term "Successful Bidder" means the lowest, qualified, responsible Bidder to
whom Owner (on the basis of Owner's evaluation as hereinafter provided) makes an award.

3. QUALIFICATIONS OF BIDDERS

3.1 Bidders shall complete "Statement of Bidder's Qualifications" - Section 00230 of
these specifications, and submit with their bid proposal.

3.3 A mandatory pre-bid conference will be held for this project as advertised. Failure to

4. EXAMINATION OF CONTRACT DOCUMENTS AND SITE
4.1 Before submitting bid, each Bidder must: (a) Examine the Contract Documents
thoroughly; (b) Visit the site to familiarize himself/herself with local conditions that

may in any manner affect cost, progress or performance of the work; (c) Familiarize
himself/herself with federal, state and local laws, ordinances, rules and regulations
that may in any manner affect cost, progress, or performance of the Work; and (d)

4.2 Before submitting a bid, each Bidder may, at Bidder's own expense, make such
additional investigations and tests as the Bidder may deem necessary to determine the

Bid for performance of work in accordance with the time, price and other terms and
conditions of the Contract Documents.

4.3 Copies of documents pertaining to exploration and tests of subsurface conditions at

the site, used by the Engineer or Consultant in preparing the Contract Documents, are

available upon written request to the Engineer. The Bidder shall be held solely
responsWible for any interpretation or conclusion drawn from this technical data.
4.4 The submissiIon of a Bid will constitute an incontrovertible representation by the
Bidder that he/sNhe has complied with every requirement and the Contract Documents
are sufficient in scope and detail to indicate and convey understanding of all terms

and conditions for performance of the Work. No conditional bids are to be
accepted.

5. INTERPRETATIONS

5.1 All questions about the meaning or intent of the Contract Documents shall be

submitted to Krystal Amberg, Contract Administrator, by
email engineering@cityofowasso.com by 11:30am on April 3, 2026. Replies
P
will be issued by Addenda posted to the city website and delivered, no later than
two days before the bid opening date, to all pOarties recorded by Owner on the plan
holder's list.
5.2 Only questions answered by formal written AddendaS will be binding. Oral and other
interpretations or clarifications will be without legal effect.

5.3 Each Bidder shall be responsible for determining that (s)he has received all Addenda

issued.

6. PROPOSAL SECURITY
N
6.1 Proposal Guaranty shall be made payable to Owner in an amount of five percent (5%)
of the Bidder's maximum Bid price and in the form of a certified or bank check or a

Bid Bond (the form in Section 00210 of these documents or the bond form issued
Y
by your Surety) issued by a Surety meeting the requirements of the General
Conditions.
6.2 The Proposal Guaranty of the successful bidder will be retained until such Bidder has
executed the Agreement and furnished the required Bonds, whereupon it will be
returned. If the successful Bidder fails to execute and deliver the Agreement and
furnish the required Bonds within ten (10) days of the Notice of Award, Owner may
