Addendums that may have been issued.
Sealed proposals will be received by the City of Bay City at the Purchasing Department, City Hall, 301
Washington Avenue, Room 304, Bay City, MI, until 2:00 p.m. on Wednesday, April 03, 2024
All bids will be publicly opened and read aloud at 2:00 p.m. on Wednesday, April 03, 2024, for the 2024 Cape
Sealing and Pavement Marking Bid #24-0403, all in accordance with the Bidding Documents, and as
otherwise set forth herein.
Attention is called to the fact that not less than the minimum salaries and wages as set forth in the contract
documents must be paid on this project, and the contractor must ensure that employees and applicants for
employment are not discriminated against because of their race, color, religion, sex or national origin.
Due to the funding source of this contract being through the American Rescue Plan Act (ARPA), a contractor
does not have to be deemed a Responsible Contractor, per City Ordinance 2021-14 Chapter II, to submit a bid.
However, the low bid contractor must be deemed a responsible contractor prior to bid award. If the low bidder
has not already been deemed a Responsible Contractor, they must fill out and submit the pre-qualification
questionnaire along with all attachments and be deemed as a “Responsible Contractor” no later than one (1)
week after bid opening in order to be awarded the contract.
The City of Bay City has absolutely reserved the right and prerogative to reject any or all bids as well as to
waive any irregularities and informalities. The award of the contract, if it is awarded, will be to a responsible
and responsive Bidder whom the City Commission, in its sole discretion and judgment, determines will be in
the best interest of the City of Bay City, and which will not exceed the funds available for the project.
