4-1. LIQUIDATED DAMAGES
DELETE: Delete Information to Bidders Article 21 Time for Commencement and Completion in
its entirety.
INSERT: Replace Article 21 with the following.
21. TIME FOR COMMENCEMENT AND COMPLETION
The Contractor shall commence work under this Contract within ten (10) days of the date
of “Notice to Proceed” issued by the Town of Litchfield and shall fully complete all work stipulated
in these Contract Documents within forty-five (45) consecutive calendar days thereafter.
It is mutually agreed that, if the Contractor fails to complete all or a portion of its work
within the time stipulated in the Contract Documents, the Owner will be damaged; and because
the amount of the Owner’s damages is difficult, if not impossible, to definitely ascertain and
prove, it is hereby agreed that the amount of such damages shall be as follows: (1) One Thousand
– Five Hundred Dollars ($1,500.00) per day as liquidated damages for each and every day of delay
in the completion of the work in accordance with the Contract Documents.
The Contractor agrees that said liquidated damages shall be deducted from monies due
the Contractor under the Contract, or, if no money is due the Contractor, the Contractor hereby
agrees to pay to the Owner as liquidated damages, and not by way of penalty, such total sum as
shall be due for such delay.
