New Castle County Government Center, 87 Reads Way, New Castle, DE 19720

Bid envelopes will carry a clear notation in the lower left quadrant, “BID FOR Various Grades
of Mineral Aggregates, Bid #20C-048

Bidders can obtain the bid specifications and all addendums from the New Castle County
Purchasing website at www.nccde.org/purchasing.
Fax bids will not be accepted.
New Castle County reserves the right to divide the award unless stated otherwise in the
specifications.
Awards, if any, will be made by the Purchasing Division to the lowest and best responsible
bidder. The County reserves the right to reject all bids and to waive minor irregularities.
NOTE: If required by State of Federal regulations, vendors will provide the M.S.D.S. sheets for
the above projects.
Pursuant to County Ordinance 83-172, 87-105, and Delaware State Law, no contract will be
awarded to any vendor unless before or in conjunction with the actual award of the contract to
such vendor, has submitted proof satisfactory to the County or to the awarding agency, or the
designated representative of the County or the awarding agency, as the case may be, that it and

each and every subcontractor named by it in its bid, if any, will at the time it submits such proof
have valid and effective licenses required by the State and the County, and the political
subdivisions, if any, in which the project is located, and the United States government, in order
for each of them (i) to do business therein; (ii) to comply with all tax laws thereof; and (iii) to
perform the labor and/or supply the material involved in the performance of the contract.

GENERAL
A. This contract is for the furnishing and delivering of certain construction materials as
specified herein, and in accordance with the requirements of New Castle County.
B. Materials in this contract shall be supplied "as required" in accordance with the unit
prices bid for each item. Unit prices are to be provided for materials delivered in
supplier's trucks. Prices will remain firm for the term of the contract year.
C. The quantities that appear on the proposal form are approximate only and are based on
previous usage. New Castle County makes no guarantee as to the total quantity of any
type of material that will be purchased under this contract. Quantities are only an
estimate of the requirements of New Castle County during the period the contract is in
effect.
D. If requested by New Castle County, contractor must deliver a minimum of 500 tons of
material in one day.
E. In the event that the contractor is unable or unwilling, by reason of any circumstance or
combination of circumstances, to supply material or make deliveries upon request of the
quantity or quality of materials as specified within the periods of time hereinafter
specified, New Castle County reserves the right to purchase said materials elsewhere.
F. New Castle County agrees to give notice to the contractors according to the following
schedule for all deliveries made in any one working day:
1. For materials delivered in supplier's trucks:
5 to 50 tons . . . . . . . . . . . . . . . . . . 8 hours
50 to 200 tons . . . . . . . . . . . . . . . . . 24 hours
Over 200 tons . . . . . . . . . . . . . . . . . 48 hours
2. For materials delivered in New Castle County's trucks:
1 to 50 tons . . . . . . . . . . . . . . . . . . 2 hours
50 to 200 tons . . . . . . . . . . . . . . . . . . 8 hours
Over 200 tons . . . . . . . . . . . . . . . . . 24 hours
G. Contractor shall invoice New Castle County immediately upon completion of delivery as
per purchase order. Invoices shall be priced per ton or prorated portions of a ton. Terms
and conditions shall be indicated on the purchase order.

H. Certified weight slips shall be the method of measurement and the basis for payment,
which price and payment shall be full compensation for deliveries accepted as stated
above. No slips will be paid unless they are signed by a representative of New Castle
County.
I. The contractor will be required to load and remove at his cost any materials
supplied or delivered that do not meet the specifications of New Castle County.
J. All materials contracted for through this contract shall conform to the attached
specifications.
K. Over-runs will not be accepted. Deliver only as per purchase order. Verbal orders at job
sites are not valid. CONTRACTOR WILL BE REQUIRED TO LOAD AND REMOVE,
AT HIS COST, ALL OVER-RUNS.
L. Prices requested are for a normal five (5) day operation. Public Workshours are
7:00 a.m. to 2:30 p.m.
M. 24-hoursnotice must be given by contractor prior to delivery. Deliveries must only be
made to the William J. Conner Building between the hours of 7:00 a.m. and 2:30 p.m.,
Monday through Friday.
N. Successful contractor(s) shall be required to deliver on Saturday, Sunday and after
normal working hours in cases of emergency. New Castle County shall define
emergencies. New Castle County shall negotiate a price for this service with the low
bidders in each item. If contractor cannot deliver, Paragraph E shall be invoked.
O. If the successful low bidder in a category cannot deliver material as specified, New
Castle County reserves the right to purchase the same material elsewhere and to charge
the contractor with any difference in cost.
P. On deliveries made at other times than normal working hours and Saturday, the
contractor shall agree to charge New Castle County no more than up to 1-1/2 times his
base rate. On Sundays and holidays, the contractor shall charge New Castle County no
more than up to two times his base rate.
Q. Apparent low bidders may be required to submit a 5-lb. sample of each item bid. Final
award shall be based upon this sample. All deliveries shall be judged on the sample.
R. New Castle County reserves the right to inspect and sample material prior to delivery.

S. This contract may be extended for a period of three (3) years, one (1) year at a time. Any
price adjustments may be considered at that time and shall be by mutual agreement of
both parties.
ADDITIONS
New Castle County may require other related services, products, and/or equipment including, but
not limited to, stone, sand, concrete, topsoil, select borrow, crusher run, stonedust, or other
mineral or construction aggregate not specifically listed. Contractor may be given the
opportunity to provide a quote. Should New Castle County deem the quote to be non-
competitive, New Castle County reserves the right to seek proposals from other sources.
Workers’ Compensation & Employer’s Liability Insurance
Vendor shall purchase and keep in force and effect workers’ compensation insurance that
will provide the applicable statutory benefits for all of the vendor’s employees who may
or do suffer covered injuries or diseases while involved in the performance of their work
for the Vendor; and, even if permitted to do so by statute, Vendor shall not reject any
workers’s compensation insurance option that, in the absence of such a rejection, would
be applicable to any of the said employees. The policy providing the workers’
compensation insurance shall include: (1) broad form all-states coverage; (2) an
endorsement that specifically waives any subrogation rights the insurer would otherwise
have against New Castle County, its officials or employees.
Vendor shall purchase, and keep in force and effect, Employers’ Liability insurance with
minimum limits for each employee of $1,000,000 for each bodily injury by accident, or
occupational disease, and $1,000,000 aggregate minimum limits for all bodily injuries by
accidents and occupational diseases within the coverage period, regardless of the number
of employees who may sustain bodily injuries by accident or occupational disease.
Automobile and General Liability Insurance
Vendor shall purchase: (1) motor vehicle liability coverage, for owned, hired and non-
owned vehicles, covering any and all claims for bodily injury and property damage that
arise out of Vendor’s performance of work for New Castle County, (2) comprehensive
Commercial General Liability (CGL) insurance with limits of no less than $1,000,000
each occurrence and $2,000,000 annual aggregate. The CGL policy shall be extended by
endorsement or otherwise to also include (a) coverage for Contractual Liability assumed
by Vendor, with defense provided in addition to and separate from policy limits for
