Separate written sealed BIDS for a General Contract for the furnishing of labor and
equipment for the construction of:
BRANDON GENERAL CONSTRUCTION TERM BID -
VARIOUS PUBLIC WORKS ITEMS
will be received by the Mayor and Board of Aldermen of the CITY OF BRANDON herein
after called the OWNER at the office of the:

Until _________ pm local time on __________________, 2026, and then at said office
publicly opened and read aloud for supplying all labor and equipment for the construction
of that certain project designated as:
BRANDON GENERAL CONSTRUCTION TERM BID -
VARIOUS PUBLIC WORKS ITEMS
Bidders must be qualified under Mississippi State Law and show Certificate of
Responsibility issued by the Mississippi State Board of Public Contractors.
The bid items include the Bidder furnishing all labor and equipment as required to
accomplish any one or more of the following work as needed by the City of Brandon:
sewer bypassing, waste water system installation and/or repairs, water system
installation and/or repairs, pavement removal and replacement, excavation, concrete
work, dewatering, cleaning, sewer point repairs, sod, grassing and other items as
shown on the Proposal Form.
The DRAWINGS, SPECIFICATIONS, AND CONTRACT DOCUMENTS may be
examined at the following location:

No partial documents will be issued.
A Bid Bond will not be required on this project.
Contractor(s) will be required to post a $250,000.00 Payment and Performance Bond for
the contract time period.

Minority and Woman Owned Business Enterprises are solicited to bid on this contract as
prime contractors and are encouraged to make inquiries regarding potential
subcontracting opportunities, equipment, material and/or supply needs.
The City of Brandon is an Equal Opportunity Employer, and hereby notifies all bidders will
be afforded the full opportunity to submit bids in response to this invitation and will not be
discriminated against on the grounds of race, color, religion, sex, national origin, age,
disability, sexual preference, marital or veteran status, or any other legally protected
status in consideration for an award.
No prospective CONTRACTOR may withdraw his proposal within SIXTY (60) DAYS after
the actual date of the opening thereof.
Each bidder shall write the Certificate of Responsibility number and Mississippi
Contractors License number on the outside of the sealed envelope containing his
proposal. Proposals shall be submitted in duplicate, sealed and deposited with the City
Clerk prior to the hour and date designated above. Bid Number ___________ should be
marked in the lower left corner of the envelope.
The City of Brandon now offers Electronic Bidding submissions. All documents may be
downloaded from Central Bidding at www.centralbidding.com. For any questions relating

The CITY OF BRANDON reserves the right to waive any information or irregularities, to
accept any bid deemed to be in the best interest of the City, or to reject any or all bids.
The intent of bids received by Owner is to establish unit prices for anticipated work that
may be necessary to repair City Owned infrastructure in emergency or certain other
situations. Bids will be compared and awarded at the time services are needed on the
basis of the required pay items, quantity, unit price for the work that is required and the
availability of the Bidder. None of the unit prices received include material costs, with
the exception of two items, sod and grassing. The City will provide materials for all the
other unit prices.

SECTION 00200
INSTRUCTIONS TO BIDDERS
1. DEFINED TERMS
Owner - City of Brandon, 1000 Municipal Drive, Brandon, MS 39042
Engineer - Consulting firm who was hired by the Owner to prepare project
plans and specifications
Bidder - one who submits a Bid directly to Owner
Sub-bidder - one who submits a Bid to the Bidder
Successful Bidder - The lowest, qualified, responsible, and/or responsive
Bidder to whom Owner (on the basis of Owner's evaluation as hereinafter
provided) proposes to make an award.
Bidding Documents - Includes the Notice for Bids (if applicable),
Instructions to Bidders, the Bid Form, and the proposed Contract
Documents (including all Addenda issued prior to receipt of Bids.)
2. QUALIFICATIONS OF BIDDERS
2.01 Bidders on projects in excess of fifty thousand dollars ($50,000) shall be
required to have Certificate of Responsibility from the Mississippi State
Board of Public Contractors establishing his classification as to the value
and type of construction on which he is authorized to bid.
2.02 The OWNER may make such investigation as he deems necessary to
determine the ability of the Bidder to perform the work. The Bidder shall
furnish, to the OWNER, all such information and data for this purpose as
the OWNER may request. The OWNER reserves the right to reject any Bid
if the evidence submitted by or investigation of such Bidder fails to satisfy
the OWNER that such Bidder is qualified to complete the obligations and
the work as required in the Contract Documents.
3. NON-RESIDENT CONTRACTORS
When a non-resident contractor submits a bid for a Mississippi public project, he
shall attach thereto a copy of his resident state's current law pertaining to such
state's treatment of non-resident contractors as required by House Bill Number
8580, Chapter Number 527, Laws of 1988.
4. COPIES OF BIDDING DOCUMENTS
4.01 Complete sets of Bidding Documents must be used in preparing Bids;
neither Owner nor Engineer assume any responsibility for errors or

misinterpretations resulting from the use of incomplete sets of Bidding
Documents by Bidders and their Sub-bidders.
4.02 Owner and Engineer in making copies of Bidding Documents available on
the above terms do so only for the purpose of obtaining Bids on the work
and do not confer a license or grant for any other use.
5. PRE-BID CONFERENCE
5.01 A Pre-Bid Conference is not being held for this project.
6. FORM OF PROPOSALS
6.01 All proposals must be submitted along with additional forms as required (not
entire booklet), in duplicate, on the forms furnished by the Owner inside a
sealed envelope addressed to:

7. EXAMINATION OF CONTRACT DOCUMENTS AND SITE
7.01 It is the responsibility of each Bidder, before submitting a Bid, to (a) examine
the Contract Documents thoroughly, (b) consider federal, state and local
laws, ordinances, rules and regulations that may in any manner affect cost,
progress, performance or furnishing of the Work; (c) study and carefully
correlate Bidder's observations with the Contract Documents, and (d) notify
Owner of all conflicts, errors, omissions or discrepancies in the Contract
Documents requiring correction, clarification, or interpretation.
7.02 Work required shall be performed on existing right-of-ways, easements, or
properties in which the Owner has authority to access for required work.

Owner shall be responsible for obtaining permission to work on any
properties that do not fit such description.
7.03 At the time of the submission of Bids, each Bidder will be presumed to have
read and be thoroughly familiar with the Contract Documents (including all
Addenda). The failure of the Bidder to examine any form, instrument or
document shall in no way relieve the Bidder from obligation in respect to his
Bid.
7.04 Provisions concerning responsibilities for the adequacy of data furnished to
prospective Bidders on subsurface conditions, underground facilities and
other physical conditions, and possible changes in the Contract Documents
due to differing conditions appear in Paragraphs 4.2 and 4.3 of the General
Conditions.
8. INTERPRETATIONS AND ADDENDA
8.01 All questions about the meaning or intent of the Contract Documents are to
be directed in writing or via email to Alex Wade - Public Works Director
(awade@brandonms.org). Interpretations or clarifications will be issued by
Addenda mailed or emailed to all parties recorded by Owner as having
received the Bidding Documents. Only answers to questions by formal
written addenda will be binding. Oral and other interpretations or
clarifications will be without legal effect.
8.02 Addenda may also be issued to modify the Bidding Documents as deemed
advisable by Owner or Engineer.
8.03 No addenda will be issued within forty-eight (48) hours of the advertised bid
time, exclusive of Saturdays, Sundays, and legal holidays.
9. SUBSTITUTE MATERIALS OR PRODUCTS
9.01 Where the Proposal Form or Specifications identify a product by a specific
brand, make, manufacturer, or definite specification, it is to establish the
required quality standard for the product regarding style, type, character,
materials of construction, function, accessories, dimensions, appearance,
and durability. Products which are determined to be equivalent by the
Owner or Engineer will be acceptable. Products which are specified by a
specific brand, make, or manufacturer's name may also be specified by its
applicable model or catalog number of other product designation.
9.02 It is understood that no alternate supplier or manufacturer shall be approved
prior to the bid date.

9.03 After the receipt of Bids, the Contract, if awarded, will be on the basis of
materials and products described in the Contract Documents or specified in
the Specifications without consideration of possible substitute of "or equal"
items except as specified. Whenever it is indicated in the Contract
Documents or specified in the specifications that a substitute or "or equal"
item of material or product may be furnished or used by Contractor if
acceptable to the Owner or Engineer, application for such acceptance will
not be considered by Owner until after the "effective date of the Agreement".
The submittal data shall include a comparison of cost of the specified
product and the proposed substitution along with product specifications.
When the cost comparison shows a reduction in cost of the equipment, the
submittal shall also include a request by the Contractor for a change order
to reduce the contract bid price offering the Owner an appropriate credit
should the substitution be accepted.
9.03 The intent of the specifications is, to the greatest extent, to list materials and
products of predominant origin within the United States. The Contractor is
encouraged, but not required, to acquire materials and products of
predominant origin within the United States.
10. SUBCONTRACTORS
10.01 If requested by the Owner or Engineer, the apparent Successful Bidder, and
any other Bidder so requested, shall, within twenty-four (24) hours after the
date of the request, submit to Owner an experience statement with pertinent
information as to similar projects and other evidence of qualifications for
each such Subcontractor, person, and organization as set forth in Article
14.
10.02 If Owner or Engineer, after due investigation, has reasonable objection to
any proposed subcontractor, supplier, other person or organization, either
may, before giving the Notice of Award, request the apparent Successful
Bidder to submit an acceptable substitute without an increase in Contract
Price or Contract Time. If the apparent Successful Bidder declines to make
any such substitution, Owner may award the contract to the next lowest
responsible and responsive Bidder that proposes to use acceptable
subcontractors, suppliers, and other persons and organizations. Any
subcontractor, supplier, other person, or organization listed and to whom
Owner or Engineer does not make written objection prior to the giving of the
Notice of Award will be deemed acceptable to Owner and Engineer subject
to revocation of such acceptance after the "effective date of the Agreement".
10.03 No Contractor shall be required to employ any Subcontractor, Supplier,
other person, or organization against whom he has reasonable objection.

10.04 The Owner is an equal opportunity employer. The Contractor is therefore
encouraged to utilize minority participation in this contract to the extent
possible through the use of small, disadvantaged and women-owned
businesses as suppliers or subcontractors.
11. BID FORM (PROPOSAL FORM)
11.01 The Bid Form is included with the Bidding Documents.
11.02 Bid Form shall be completed in ink or by typewriter (alternate bid forms are
not allowed). Bid Form must be completed and signed by a representative
of the company.
11.03 Bids by corporations must be executed in the corporate name by a
corporate officer accompanied by evidence of authority to sign. The
corporate address and state of incorporation must be shown below the
signature.
11.04 Bids by partnerships must be executed in the partnership name and signed
by a partner whose title must appear under the signature, and the official
address of the partnership must be shown below the signature.
11.05 All names must be typed or printed below the signature.
11.06 The Bid shall contain an acknowledgment of receipt of all Addenda (the
numbers of which shall be filled in on the Bid Form).
11.07 The address, email address, and telephone number for communications
regarding the Bid must be shown.
12. SUBMISSION OF BIDS
12.01 Bids shall be submitted in duplicate to the OWNER on the date, at the time
and at the place as set forth in the published "Advertisement for Bids" and
shall be submitted as required in Article 4 of this section.
13. MODIFICATION AND WITHDRAWAL OF BIDS
13.01 Bids may be modified or withdrawn by an appropriate document duly
executed (in the manner that a Bid must be executed) and delivered to the
place where Bids are to be submitted at any time prior to the deadline for
submitting Bids. A request for withdrawal or a modification must be in
writing and signed by a person duly authorized to do so; and, in case signed
by a deputy or subordinate, the principal's proper written authority to such

deputy or subordinate must accompany the request for withdrawal or
modifications. Withdrawal of a Bid will not prejudice the rights of a Bidder
to submit a new Bid prior to the Bid Date and Time. After expiration of the
period for receiving Bids, no Bid may be withdrawn or modified.
13.02 If, within forty-eight (48) hours of the Bid opening, exclusive of Saturdays,
Sundays, and legal holidays, any Bidder files a duly signed, and sworn
written notice with Owner to the satisfaction of Owner that there was a
patently obvious mechanical, clerical, or mathematical error in its Bid, that
Bidder may withdraw its Bid. Thereafter, the Bidder will be disqualified from
future bidding on the Contract.
14. OPENING OF BIDS
14.01 Bids opening will be public and may be attended by Plan Holders/Bidders.
The Bids will be opened and the total of the proposal form will be read aloud
immediately following the submittal deadline. Owner will tabulate and
provide each CONTRACTOR with a copy of each individual Bid Form upon
request with the OWNER's permission.
15. AWARD OF CONTRACT
15.01 The intent of the Bids received by the Owner is to establish unit prices for
anticipated work that may be necessary to repair City owned infrastructure
in emergency or certain other situations. Bids will be compared and
awarded at the time services are needed on the basis of the required pay
items, quantities, and unit price for the work that is required and the
availability of the Bidder. None of the unit prices received include material

15.02 The Owner reserves the right to reject any and all Bids, to waive any and
all informalities not involving price or changes in the Work with the selected
Contractor, and the right to disregard all nonconforming, nonresponsive,
unbalanced or conditional Bids. Also, Owner reserves the right to reject
the Bid of any Bidder if Owner believes that it would not be in their best
interest to make an award to the Bidder, whether because the Bid is not
responsive or the Bidder is unqualified or of doubtful financial ability or fails
to meet any other pertinent standard or criteria established by Owner.
Owner reserves the right to reject any and all bids for any reason.
Discrepancies in the multiplication of units of Work and unit prices will be
resolved in favor of the unit prices. Discrepancies between the indicated
sum of any column of figures and the correct sum thereof will be resolved
in favor of the correct sum.
