NOTICE TO BIDDERS
A N O T I C E I S H E R E B Y G I V E N that sealed Bid Packets will be received by the Municipal
Clerk for the Borough of Seaside Park, County of Ocean, State of New Jersey on May 28, 2026, at
10:00 AM prevailing time at the Borough of Seaside Park, Municipal Building, located at 1701 N.
Ocean Avenue, Seaside Park, NJ 08752 at which time and place the Bid Packets will be publicly
unsealed and its contents announced in public for Reconstruction of Boardwalk Phase 2 F Street to
Island Avenue.
The Scope of Work contemplated for the abovenamed project includes the removal and
replacement of the existing boardwalk, sidewalk, and curb reconstruction; SESC; handicap ramps and
handrails, dune enhancement and roadway striping; as well as all other work of any type or description
necessary for contemplation of the Project, whether or not specifically described in these Contract
Documents. All Work on this Contract shall be completed within one hundred and seventy (170)
Calendar Days from the Notice to Proceed and no later than March 1, 2027.
Contract Documents and Plans for the proposed work, which have been prepared by Jason Worth,
PE, of the firm of T&M Associates, are available at the T&M Associates Office, 1144 Hooper Avenue,
Suite 202, Toms River, New Jersey 08753, and may be inspected by prospective Bidders during
normal business hours.
Bidders will be furnished with a copy of the Contract Documents upon proper notice and payment
of a non-refundable charge of One Hundred and Fifty Dollars ($150.00) payable to “T&M Associates”
(Toms River Office) to defray the cost thereof.
The provided Bid Packet must be completed in the manner designated in the Contract Documents,
must be enclosed in a sealed envelope bearing the name and address of the Bidder and the name of
the Project on the outside and must be addressed to the Borough of Seaside Park, Jenna Jankowski,
Municipal Clerk. Also, Bid Packets must be accompanied by a Statement of Consent of Surety from a
surety company holding a Certificate of Authorization to do business in the State of New Jersey and
either a Bid Bond or a Certified Check drawn to the order of “Borough of Seaside Park” for not less
than ten percent (10%) of the total bid price amount, except that the check shall not exceed
$20,000.00. The successful Bidder is hereby notified that a Performance and Payment Bonds for the
full amount of this Project is required.
The award of the Contract for this Project will not be made unless and until the necessary funds
have been provided by Borough of Seaside Park in a lawful manner. Please be advised that this Project
is being funded through the Borough of Seaside Park. By virtue of Executive Order #34 (1976), vendors
currently suspended, debarred or disqualified are excluded from participating on this Project.
The successful Bidder shall be required to comply with the applicable statutory requirements of
the Contract Documents and Plans which include all of the following: (i) N.J.A.C. 17:27; (ii) N.J.S.A. 10:5-
31 et seq.; (iii) Business Registrations (N.J.S.A. 52:32-44); (iv) Prevailing Wage Act (N.J.S.A. 34:11-56.25, et
seq.); (v) Public Work Contractor Registration (N.J.S.A. 34:11-56.48); and (vi) Affirmative Action
Requirements (N.J.S.A. 10:5-1, et seq.); and any other legal requirements applicable to this Project.
The Borough of Seaside Park intends to award this Project to the lowest responsible and
responsive Bidder in accordance with applicable law. The Borough of Seaside Park reserves the right
to reject any and all Bid Packets to the extent permitted by law. An award will be made or Bid Packets
will be rejected within sixty (60) Calendar Days after the opening of the Bid Packets, during which time
the Bid Packets shall be irrevocable and unavailable to withdraw by Bidders, unless otherwise
extended in the Contract Documents.
The Borough of Seaside Park further reserves the right to modify this Contract through the
distribution of Addenda to plan holders of record without further publication. Bids will be evaluated
on the basis of this Advertisement plus any Addenda issued by Borough of Seaside Park prior to the
opening of the Proposal.
This procurement will be subject to regulations contained in applicable sections of the New Jersey
Local Public Contracts Law in effect on the date of the assistance award for this project.
Under the terms of any contract awarded under this invitation for bids, the successful bidder shall
fully comply with the requirements, terms, and conditions of the NJDOT's Disadvantaged Business
Enterprises (DBEs) as well as Small Business Enterprises (SBEs). This contract includes a goal of
awarding 2% of the total contract price to subcontractors qualifying as SBEs.
All applicable surety bonds required in connection with the advertisement and award of building
contracts or sub agreements must be written by a surety company listed on the Federal Treasury List
(Department Circular 570 Surety Companies Acceptable on Federal bonds), incorporated herein by
reference. Copies of this document may be obtained from the Department.
This contract or subcontract is expected to be funded in part with funds from the New Jersey
Department of Transportation and the New Jersey Environmental Infrastructure Trust. Neither the
State of New Jersey, the New Jersey Environmental Infrastructure Trust nor any of their departments,
agencies or employees is, or will be, a party to this contract or subcontract or any lower tier contract
or subcontract. This contract or subcontract is subject to the provisions of Local Public Contract,
Department of Labor Current Wage Rate Determination, Prevailing Wage Act, Contract Works Hours
and Safety Standard Act, Copland Act, Davis Bacon Act, Buy American Clause, Debarment and
Suspension, and Disadvantaged Business Enterprises.
Funds for this project are to be provided by the New Jersey Environmental Infrastructure Financing
Program. Therefore, the successful bidder shall be required to comply with the provisions of the New
Jersey prevailing Wage Act, Chapter 150 of the Laws of 1963, effective January 1, 1964, and the
Public Works Contractor Registration Act (NJSA 34:11-56.48).
