GENERAL CONDITIONS OF BIDDING - READ CAREFULLY
1. Quote on alternates if unable to furnish items listed. State on face of bid exactly what you are furnishing. (Brand or Manufacturer’s Name).
2. Any catalog, or manufacturer’s reference in this proposal is descriptive, but not restrictive, and is used only to indicate type and grade.
3. Furnish specifications on all items bid.
4. The City of Phenix City is exempt from all Federal Excise Taxes. DO NOT include tax in your bid price or invoice.
5. PRICE MUST BE ITEMIZED. The City of Phenix City reserves the right to award item or total bid.
6. In case of a discrepancy between the unit price and the extension, the unit price will be taken.
7. The successful bidder will be required to have all applicable state and city business licenses.

AND PROPERTY IMPROVEMENTS”
PHENIX CITY, ALABAMA
The City of Phenix City will receive sealed bids at 601 12th Street, 2nd floor, for Hot Mix
Asphalt Paving, Roadway, Drainage and City Facility and Property Improvements Bid
until 9:00 A.M. EST on February 5, 2026 and the official bid opening will be at 10:00
A.M. EST, Thursday, February 5, 2026 in the City Council Chambers located in the
Phenix City Public Safety Building, 1111 Broad Street, Phenix City, Alabama. Copies of
the bid documents can be obtained by requesting bid number E26-01 at the Phenix City
Engineering Department, 1206 7th Avenue, Phenix City, Alabama. Mailed bids shall
arrive 1 day before the official bid opening. Hand delivered bids shall be submitted one
(1) hour before the bid opening. For additional information contact Angel Moore, City

ADVERTISEMENT FOR BIDS
Notice is hereby given that the City of Phenix City, Alabama will receive sealed bids for “Bid
Number E26--01. Hot Mix Asphalt Paving, Roadway, Drainage, City Facility and Property
Improvements until 9:00A.M. E.S.T on Thursday February 5, 2026. The official bid opening will
be at 10:00 A.M. E.S.T in the City Council Chambers located in the Phenix City Public Safety
Building at 1111 Broad Street Phenix City, Alabama 36867. The following specifications shall
apply:
GENERAL SPECIFICATIONS
1. All bids must be submitted on the attached bid form and sealed in an envelope. All bids
shall have clearly marked on the outside of the envelope the following: “Bid Number
E26--01 Hot Mix Asphalt Paving, Roadway, Drainage, City Facility and Property
Improvements”, the bidders name and state license number for general
contracting. Bids should be mailed or hand delivered to the City of Phenix City Finance
Department, Attn: Purchasing Agent, 601 12th St., 2nd Floor, Phenix City, Alabama
36867. Mailed bids shall arrive one (1) day before the official bid opening. Hand
delivered bids shall be submitted at 9:00 AM E.S.T, one (1) hour before the official bid
opening.
2. The bid shall be effective for one (1) year from the date of award. This contract can be
extended for a period of up to three (3) years if agreed upon by both parties and allowing
for rate increases for year 2027 and 2028
3. All items are to be completed in-place and shall be in accordance with current City of
Phenix City Public Works Manual. If not specified by the City of Phenix City, all material,
construction, and quality requirements shall be in accordance with the current Alabama
Department of Transportation Standards and Specifications, if applicable. The bidder
shall furnish all materials, equipment and labor for the transporting and placement of the
bid items.
4. All work performed for the City of Phenix City will be done so within the Corporate Limits
of Phenix City, Alabama. Minimum quantities (if any) required for each mobilization and
pay item should be provided with the bid on an attached sheet.
5. This bid may be utilized by any other governmental agency located in Russell County,
Alabama
6. The award will be to the lowest responsible bidder meeting specifications. The City of
Phenix City reserves the right to reject any and all bids. Quality, conformity to
specifications, past service and experience of bidders will be considered.
7. A bid bond or certified check in the amount of 5% of the total bid up to a maximum of ten
thousand dollars ($10,000) must accompany the submitted bid. Failure to furnish bid
bond or certified check will cause the bid to be rejected.
8. A performance bond in the amount of fifty thousand dollars ($50,000) valid for as long as
the contract is in effect, shall be submitted prior to beginning work.
9. Proof of Liability Insurance and Workman’s Compensation Insurance shall be submitted
before any work is started. The General Liability Insurance shall be a minimum of five
hundred thousand dollars ($500,000.00).
10. Any exceptions and/or substitutions to the specifications and/or items of work should be
listed in a detailed description on a separate sheet attached to the bid
11. No errors shall be corrected after the bids are opened. In the event of a discrepancy unit

12. Bids must be submitted on this form printed in ink or typed, signed in ink, and notarized.
13. Work shall begin within twenty-one (21) days after a Notice to Proceed is issued.
14. The City Engineering Department shall be notified no later than 48 hours prior to
beginning work and 24 hours prior to resuming work when suspended more than 48
hours. Failure to notify may result in work being rejected
15. The Contractor shall perform work deemed “Emergency Work” including, but not limited
to slope failures, storm pipe failures, sink holes, river walk repairs, and other work
considered critical infrastructure. The Contractor shall mobilize to perform “Emergency
Work” within 48 hours of notification of failure.
16. Pay estimates shall be submitted for each “Notice to Proceed” after the work is
completed and accepted by the City.
17. Traffic control devices shall conform to the Manual on Uniform Traffic Control Devices,
11th Edition and shall be furnished and installed by the bidder at no additional cost.
18. Bituminous Material Price Adjustments will apply to the items in this bid according to
ALDOT Section 109.03, Article (e) of the Standard Specifications. The base index will be
the index for the month of the award of this bid.
19. If requested by the City, test reports shall be submitted on all materials before final
payment will be made.

20. A maximum gross vehicle weight (GVW) of 66,000 lbs is required. No Tri-axle trucks will
be allowed as loads exceeding 66,000 lbs GVW will be rejected
21. The bidder shall indemnify and hold harmless the City of Phenix City, its agents and
employees from all claims and suits relating to damages or injuries sustained by any
persons or property as a result of the work to be performed. The bidder is responsible for
conforming to all applicable laws and ordinances and obtaining any necessary license
and permits.
22. Except otherwise provided in this Agreement, any claim, dispute or other matter in
question arising out of or related to this agreement shall be subject to informal mediation
between the parties, which will be non-binding to resolve any dispute. If said matter
cannot be resolved through informal mediation, then in that event, either party in this
agreement can request formal non-binding mediation. If the parties do not resolve a
dispute through mediation, the method of binding dispute resolution should be the
following: Litigation in a court of competent jurisdiction in Russell County, Alabama or in
the United States District Court for the Middle District of Alabama. Dispute shall be
interpreted by laws of the State of Alabama.
23. The Contractor warrants to the City that all materials furnished under the Contract will be
of good quality, except such materials as may be expressly provided or allowed in the
Contract Documents to be otherwise, and that none of the Work will be Defective Work.
Contractor shall employ a sufficient amount of skilled employees and equipment to
perform the work in a quality and timely manner.
24. The Contractor shall provide a one-year warranty for all work performed under this bid.
25. If any of the Work is found to be Defective Work before the one year expiration from the
date of Substantial completion or each designated portion of the Work, the Contractor
shall promptly upon receipt of written notice from the Owner or Engineer, and without
expense to either, replace or correct the Defective Work to conform to the requirements
of the Contract Documents, and repair all damage to the site and its contents which is
the result of Defective Work or its replacement or correction.
