Sealed Bid responses must be submitted and received by 2:00 PM on Thursday August 20, 2026. All Sealed Bids must be clearly marked on the outside of the envelope “Reconstruction of Bayer Road” along with the bidder’s name and return address. Sealed Bid responses received after the deadline will NOT be accepted and must have a notarized non-collusion affidavit and bid bond or will not be accepted.

Sealed bid responses are to be submitted by 2:00 PM on Thursday August 20, 2026, in person or delivered via USPS, UPS, or FedEx to Attn: County Judge Jimmy Sylvia, 404 Washington Ave-2nd Floor/ P.O. Box 939, Anahuac, TX 77514, and will be publicly opened immediately after 2:00 PM. NO EMAILED or FAXED BID’s will be accepted.

1. GENERAL INFORMATION
1.1 BACKGROUND:
Chambers County, Texas is a county adjacent to and part of the greater Houston, Texas metropolitan
area. It is home to a diverse economy and population with a great deal of rural agricultural activity,
scaling up to densely populated residential areas and highly concentrated, high-risk industrial
plants. The population is growing at a fairly significant rate and is projected to accelerate its growth
over the next decade.
Chambers County Commissioners Court is requesting bid proposals for the BAYER ROADWAY
REPAIR. Bid proposal, in duplicate, should be in a sealed envelope, clearly marked
"RECONSTRUCTION OF BAYER ROAD" on the outside and addressed to: Chambers County
Judge Sylvia at P.O. Box 939 / 404 Washington Avenue, Anahuac, TX 77514.
Proposals will be accepted until 2:00 p.m. Thursday August 20, 2026. At that time, all sealed bids
received will be publicly opened and read. Proposals received after this date and time, will be
rejected and returned unopened.
Bid documents may be obtained beginning Tuesday July 28, 2026, from the Chambers County
Purchasing Agent by email to gbarrera@chamberstx.gov. Chambers County reserves the right to
reject any and all bids or to accept any bid deemed advantageous to it.
PURPOSE: This Request for Bids (BIDS) is for a contractor to perform a BAYER ROADWAY
REPAIR.

1.2 DELIVERY METHOD: The delivery method for the project shall be by contractual arrangement with
deliverables and payment schedules.
1.3 PREPARING THE BID: Bids are to be prepared and submitted in accordance with the provisions herein.
Failure to do so may result in rejection of the bid. Bids must be prepared and submitted only on the forms provided
within the solicitation package. Where a signature is required, an authorized representative of the respondent
must do so. Evidence as to such authority may be required.
1.4 ISSUING OFFICE: This BID is issued by Chambers County Purchasing Department on behalf of the
Chambers County Commissioners Court.
1.4.1 RIGHTS RESERVED: Chambers County expressly reserves the right to accept, reject, and waive
any informalities in any and all responding Bids submitted. This BID does not commit Chambers County
to pay any costs incurred prior to execution of a contract. Issuance of this material in no way obligates
Chambers County to award a contract or to pay any costs incurred in the preparation of a response.
Chambers County specifically reserves the right to vary all provisions set forth at any time prior to
execution of a contract where it deems it to be in the best interest of Chambers County.
1.4.2 EVALUATION OF BIDs: Chambers County will base its selection(s) on the following criteria:
demonstrated capabilities relevant work, references, and pricing. See list of weighted criteria in Section
4 of this BID.
1.4.3. Price Inclusive: The final dollar amount of any bid submitted for this BID must include ALL costs
as part of the final price. Price increases will be not be permitted once the bid is awarded.
MANNER OF AWARDING CONTRACTS: If a contract is awarded, Chambers County may
award the contract to that provider which it deems to be the most qualified submitter and is the best
value to the County.
1.5 DATES AND DEADLINES:

1.6 DESCRIPTION OF WORK: See construction plans for description of work and bid items. Please note that
this project will be constructed and inspected as detailed in the 2014 Texas Department of Transportation
Standard Specifications of Highways Streets and Bridges. The Working days for this project will be 45 working
days.
2. RESPONSE TO THE REQUEST FOR BID SUBMITTAL
2.1 NUMBER OF COPIES OF THE RESPONSE to the REQUEST FOR BID NEEDED: Any qualified person
or Contractor wishing to submit a BID shall provide two (2) copies of their BID,. No other distribution of the
BID will be made by the CONTRACTOR On each copy, the CONTRACTOR shall print or type his/her name
and manually sign the BID.
2.2 COUNTY OFFICIALS NOT TO BENEFIT: No County officer or employee shall be admitted to any share
or part, nor any benefit therefrom, of any contract resulting or arising from this BID.
2.3 FEDERAL OR STATE DEBARMENT: No CONTRACTOR, company/corporate principle or Officer,
licensed professional, or corporation involved in the provision of any Chambers County project, current or future,
arising from this BID can be listed on any current State or Federal Debarred Contractor's List.
2.4 REJECTION OF RESPONSES: The County reserves the right to accept or reject any and all BIDS received
as a result of this Request for BIDS to serve the best interest of the County. The County will not pay for any
information solicited or obtained through any response.
2.5 INCURRING COSTS: The County is not liable for any cost incurred by any
CONTRACTOR, arising out of this BID prior to issuance of a "Notice to Proceed" arising out of any contract.
2.6 PUBLIC RECORD: The contents of any BID are exempt from Public Open Records laws prior to the date
that they are publicly opened. Once these BIDs have been publicly opened, all documents within those BIDs are
subject to the public accessibility rights as set forth in Texas Government Code Chapter 552.
2.7 DISADVANTAGED BUSINESS ENTERPRISES (DBE) (formerly referred to as women-owned,
minority-owned and historically underutilized businesses): CONTRACTORS responding to this BID, shall
provide Chambers County with their HUB/DBE certification by the Texas State Comptroller's Office, Statewide
Procurement Division.

Questions and answers that change or substantially clarify the Request for BID will be affirmed in
writing and copies will be provided to all CONTRACTORS on record, of having received a
REQUEST FOR BID. CONTRACTORS receiving the Request for BID via internet download
should be certain to provide appropriate contact information utilizing the interactive form provided
on the Internet site. Any inquiries relating to this BID must be submitted in writing to George
Barrera at gbarrera@chamberstx.gov
ADDENDA TO THE REQUEST FOR BIDS: In the event it becomes necessary to revise any part
of this REQUEST FOR BIDS, addenda will be provided to all CONTRACTORS who received the
REQUEST FOR BIDS prior to the response due date, and who are recorded as having received it.
No addenda will be issued and no questions will be answered after August 17, 2026 @ 2:00PM
2.8.1 RESPONSE DATE: To be considered, BIDS must arrive at the Chambers County Judge's Office
on or before Thursday August 20, 2026, by 2:00 PM
A CONTRACTOR mailing a BID should allow normal mail delivery time to ensure timely receipt
of the BID by the due date and time. Responding CONTRACTORS shall have sole responsibility
for timely delivery of their BID. No faxed submittals will be accepted. NO
LATE SUBMITTALS WILL BE ACCEPTED.
2.9 ACCEPTANCE OF BID RESPONSE CONTENT: To be considered, CONTRACTORS must submit a
complete response to this Request for Proposals. The contents of this BID and the RESPONSE of the selected
CONTRACTOR may become contractual obligations if a contract ensues. BIDS must be signed by an official
authorized to bind the CONTRACTOR(s) to its provisions. The CONTRACTOR will make no other distribution
of their BID RESPONSE.
2.9.1. BID PREPARATION: Each BID shall provide a straightforward, concise description of the
CONTRACTOR'S ability to meet the requirements of the BID. Emphasis should be on completeness
and clarity of content.
2.9.2. WARRANTY: No Warranty after final acceptance by the County.

3.2 LETTER OF TRANSMITTAL: The transmittal letter must include the following:
3.2.1 STATEMENT OF UNDERSTANDING: Brief statement of understanding of the work to be
performed and a positive commitment to perform the work within the schedule included herein.
3.2.2 CONTACT PERSON: Name of the contact person or representative for the CONTRACTOR, title,

I, or we, the Undersigned Company, hereby submit this, our bid for furnishing CHAMBERS
COUNTY BAYER ROADWAY REPAIR according to the specifications for the amount listed.
I, or we, further understand that all prices include delivery to the Chambers County project in
Baytown, TX. This bid sheet must be accompanied by a completed Non-Collusion Affidavit.
3.4 CONTRACTOR INFORMATION: The CONTRACTOR will provide information about the
CONTRACTOR(s) and the personnel to be assigned to this project. Be sure to include:
3.4.1 NAME AND ADDRESS: The name and business address of the CONTRACTOR and principal
who would be responsible for the implementation and maintenance of Chambers County's service.
3.5 PERFORMANCE BOND: The CONTRACTOR will be required to provide a performance bond in the
amount of 100% of the contract price as surety for the successful completion of the project as a condition of
contract award.
3.6 DAMAGES: The contractor will be assessed $500 in damages for every day beyond the allowed working
day the contractor is not complete with the project.
4. EVALUATION AND SELECTION CRITERIA
Commissioners Court discourages unsolicited verbal or written communications from competing
companies which may pertain or relate directly or indirectly to any BID being evaluated by the
selection committee or the Commissioners Court which has been submitted in response to this
REQUEST FOR BID and which contemplates award of a professional contract, unless provided
for in this BID.
4.1 CONTRACT AWARD: Award of the contract will be to the bidder whose BID is most advantageous to the
County. BIDS will be evaluated on the criteria listed below in relation to the needs of the County. The following
criteria are those that will be applied in the evaluation of the BID:
4.1.1 Detailed description of the work to be performed based on the outlined requirements and capability
for commencement of work within required calendar days of award of purchase. (50%)
4.1.2 Pricing (30%)
4.1.3 References and prior customer feedback. (20%)

During the evaluation process (period after public opening of all received qualifying bids), the
County may, at its discretion, request any one or all respondents to make oral presentations. Such
presentations will provide firms with an opportunity to answer any questions the evaluators may
have on a proposal. Not all respondents may be asked to make such oral presentations.
The County reserves the right to conduct personal interviews or view product demonstrations with
respondents prior to selection. The County will not be liable for any costs incurred by the proposer
in connection with such interview (i.e., travel, accommodations, etc.) The County reserves the right,
without prejudice to reject any or all proposals, and in its sole discretion, to accept the proposal it
considers most favorable to the County's interest. The County further reserves the right to reject all
proposals and seek new proposals when such procedures is reasonable and in the best interest of
the County.
Chambers County will select the most appropriately qualified CONTRACTOR for the best price,
at its own determination. The ultimate approval and deciding authority is the Chambers County
Commissioners Court.
5. STATEMENT OF NON-COLLUSION AND OTHER ADMINISTRATIVE FORMS
5.1. CONFLICT OF INTEREST STATEMENT: The selected respondent to this sealed bid shall, as a condition of
acceptance of their qualified response, register with the Texas Ethics Commission (TEC) and submit the State
mandated Form 1295 - located at the following website:
https://www.ethics.state.tx.us/whatsnew/elf_info_form1295.htm; receipt of acknowledgement will be completed
by Chambers County, through the TEC website, as part of the proposal review process, within 30 days of the
submission date.
5.2. Each respondent to this BID shall, as a condition of acceptance of their qualified response, submit the
attached NON-COLLUSION AFFIDAVIT, in 12pt Times New Roman font, signed and notarized as part
of their submission. Failure to submit the signed and notarized NON- COLLUSION AFFIDAVIT will invalidate
their submission and cause.
