ADVERTISEMENT AND NOTICE TO BIDDERS

Notice is hereby given that sealed bids addressed to the Business Administrator of the Township of Marlboro will be received up to 10:00 AM prevailing time on WEDNESDAY, JULY 9, 2025 at which time and place bids will be opened and read aloud in Meeting Room 1 of the Marlboro Township Administration Building, 1979 Township Drive, Marlboro, New Jersey 07746 for the following:

WYNCREST ROAD IMPROVEMENTS, PHASE II

The project generally consists of the resurfacing of Wyncrest Road from Route 18 to County Road 520. The improvements include excavation, milling and the overlaying of roadways with hot mix asphalt 9.5M64 surface course, hot mix asphalt base repair where necessary, removal and replacement of deteriorated concrete curb and concrete curb and gutter, installation of ADA curb ramps and detectable warning surfaces, traffic striping, and the reconstruction of inlets and the installation of bicycle safe grates and Type ‘N’ ECO inlet castings as required by the Tier “A” Municipal Stormwater Regulations, and stormwater management improvements as required.

This contract or subcontract is expected to be funded in part with funds from the New Jersey Department of Environmental Protection and the New Jersey Environmental Infrastructure Trust. Neither the State of New Jersey, the New Jersey Environmental Infrastructure Trust nor any of their departments, agencies or employees is, or will be, a party to this contract or subcontract or any lower tier contract or subcontract. This contract or subcontract is subject to the provisions of N.J.A.C. 7:22-3, 4, 5, 9 and 10.

In accordance with the provisions of N.J.S.A. 58:11B-26, N.J.A.C. 7:22-3.17(a)24 and 4.17(a)24, the contractor (subcontractor) shall comply with all of the provisions of N.J.A.C. 7:22-9.

“N.J.A.C. 7:22 3.17(a)24, 4.17(a)24, 6.17(a)24 and 7:22A-2.4(a) provide that a goal of not less than 10 percent be established for the award of contracts to small business concerns owned and controlled by one or more socially and economically disadvantaged individuals. The goal of 10 percent applies to the total amount of all contracts for building, materials and equipment, or services (including planning, design and building related activities) for a construction project.”

The project sponsor has identified that the SBE utilization goal for this project is 10 percent.

The 10 percent SBE utilization requirement shall be accomplished by the following:

1. Bids shall be solicited on an unrestricted basis. The bid documents, however, shall include a statement to the effect that the successful bidder must fulfill the SBE utilization requirements by subcontracting

portions or the work to SBEs; or

2. Contractors also have the option of establishing unrestricted bidding procedures to fulfill the 10 percent SBE utilization requirement for the project.

Awards will be made only to socially and economically disadvantaged business concerns that are certified by the New Jersey Commerce, Economic Growth and Tourism Commission, the New Jersey Department of Transportation, the Port Authority of New York and New Jersey, New Jersey Transit or other agencies deemed appropriate by the Office as eligible minority businesses or female businesses.

The invitation to bid is on an unrestricted basis whereby the successful bidder must fulfill the SED utilization

requirements.

Plans, Specifications and Proposal Sheets may be obtained free of charge online at https://www.marlboronj.gov/Notices or from the Office of the Township Engineer, Trevor J. Taylor, P.E., CME Associates, 1460 Route 9 South, Howell, New Jersey until 48 hours prior to the time set for the opening of bids upon payment of $100.00 per set during regular business hours, 8:30 AM to 4:00 PM, Monday through Friday excluding holidays by calling (732) 462-7400. No refunds will be made. It is the responsibility of prospective bidders who obtain bid documents to check the Marlboro Township website for any addenda issued prior to the bid opening. Failure to do so could result in the rejection of your submission. The said Contract Documents and Proposal sheets may also be examined at the office of the Marlboro Township Municipal Clerk, 1979 Township Drive, Marlboro, New Jersey 07746.

All required bidder information can be found in the bid documents. Any reference in the bid specification documents to the terms “Proposal” or “Proposer” shall be construed to have the same meaning as the terms “Bid” or “Bidder” pursuant to the Local Public Contracts Law. All bidders are required to comply with the requirements of P.L. 1975, c. 127 (N.J.A.C. 17:27 et seq.) and all other applicable local, state and federal laws. Bidders are required to comply with the requirements of Equal Opportunity Employment (N.J.S.A.10:5-31 et seq.) and Affirmative Action (N.J.A.C. 17:27) and with the disclosure provisions of N.J.S.A. 19:44A-20.13.

Each bid must be accompanied by a certified check or cashier’s check of not less than ten (10%) percent of the bid, but not more than $20,000.00, payable without any conditional endorsement as a guarantee that in case the contract is awarded to the bidder, he will within twenty-one (21) days thereafter execute such contract and furnish satisfactory performance bonds. Upon failure to do so, he shall forfeit the deposit as liquidated damages and the acceptance of the bid will be contingent upon the fulfillment of this requirement by the bidder. No interest shall be allowed upon any such certified check or cashier’s check. A bid bond in the amount of ten (10%) percent of the bid, but not more than $20,000.00, may be substituted for certified check or cash. Each bid must be accompaniedby a Certificate of Experience and Certificate of Equipment.

Each bid must also be accompanied by a certificate of Consent of Surety from a bonding company licensed to do business in the State of New Jersey guaranteeing that if the proposal of the bidder be accepted they will furnish the bond set forth in the Instructions to Bidders and the acceptance of the bid will be contingent upon the fulfillment of this requirement.

All applicable surety bonds required in connection with the advertisement and award of building contracts or sub agreements must be written by a surety company listed on the Federal Treasury List (Department Circular 570— Surety Companies Acceptable on Federal Bonds), incorporated herein by reference. Copies of this document may be obtained from the Department.

The advertisement shall designate the manner of submitting and the method of receiving the bids and the time and place at which the bids will be received. If the published specifications provide for receipt of bids by mail, those bids which are mailed to the contracting unit shall be sealed and shall only be opened for examination at such time and place as all bids received are unsealed and announced. At such time and place the contracting agent of the contracting unit shall publicly receive the bids, and thereupon immediately proceed to unseal them and publicly announce the contents, which announcement shall be made in the presence of any parties bidding or their agents, who are then and there present, and shall also make proper record of the prices and terms, upon the minutes of the governing body, if the award is to be made by the governing body of the contracting unit, or in a book kept for that purpose, if the award is to be made by other than the governing body, and in such latter case it shall be reported to the governing body of the contracting unit for its action thereon, when such action thereon is required. No bids shall be received after the time designated in the advertisement.

In no case shall the advertisement for bids be published less than 30 days prior to the date fixed for receiving bids on the purchase or contract.

Bidders shall comply with N.J.S.A. 52:32-44 latest revision, regarding Business Registration with the New Jersey Division of Revenue.

During the performance of this Contract, the Contractor agrees to comply with the requirements of P.L. 1975, c 127 (N.J.A.C 17:27), and N.J.S.A 10:5-31 et seq., all requirements of the State of New Jersey Workers Health and Safety Act (N.J.A.C. 12:110 et seq.) as amended and the United States Occupational Safety and Health Act (OSHA)(29 CFR 1910), as amended with regard to worker and jobsite safety.

No bidder may withdraw his bid for a period of sixty (60) days after the date set for the opening thereof. The successful bidder will be required to furnish a surety company bond in the full amount of the contract price indemnifying the Township of Marlboro, New Jersey for all proceedings, suits or actions of any kind of description and conditional for the faithful performance of the work.

If the contracting agency determines that the acceptance of the lowest responsible bid will result either in the payment of an unreasonable price or in a contract otherwise unacceptable pursuant to the statutes and rules governing public contracts, the contracting agency shall reject all bids.

Bidders and the office shall be notified of the rejection of all bids, the reasons for the rejection, and the contracting agency's intent to solicit bids for a second time.

If the contracting agency determines a second time that the acceptance of the lowest responsible bid will result either in the payment of an unreasonable price or in a contract otherwise unacceptable pursuant to the statutes and rules governing public contracts, the contracting agency shall reject all bids and notify the NJDEP Office of Equal Opportunity and Public Contract Assistance and, after receipt of the NJDEP Office of Equal Opportunity and Public Contract Assistance’s approval, shall amend the project plan accordingly.

Bidders shall be notified of the cancellation, the reasons for the cancellation and the contracting agency's intent to resolicit bids on an unrestricted basis. SEDs may participate in the bidding on an unrestricted basis.
