Overview
Summary

Lea County, on behalf of the Public Works Department, seeks bids from qualified companies that can do business in the State of New Mexico to provide all materials, labor, machinery, equipment, tools, etc., necessary to furnish and install miscellaneous construction projects throughout Lea County consisting of any or all of the bid items listed in the Unit Price Bid.

The resulting contracts will be indefinite quantity price agreement, per State Statute 13-1-63, and "awardees will furnish an indeterminate quantity of specified services, items of tangible personal property or constructions during a prescribed period of time (the life of any agreement) at definite unit price or at a specified discount from list or catalogue prices." Price escalations may be considered. Refer to specifications for more information.

Submitting a bid for this project implies agreement by the Bidder to these terms.

Use of a brand name is for the purpose of describing the standard of quality, performance and characteristics desired and is not intended to limit or restrict competition. When bidding an "or equal" the burden of persuasion is on the supplier or manufacturer who has not been specified to convince the procurement officer that their product is, in fact, equal to the one specified. The procurement officer is given the responsibility and judgment for making a final determination on whether a proposed substitution is an "or equal" (NMAC 1.4.24., subsection D).
