NOTICE IS HEREBY GIVEN that sealed bids will be received at the Office of the Procurement and Contracting
Manager of the City of Palm Springs, California, 3200 East Tahquitz Canyon Way, Palm Springs, California 92262
until, 3:00 P.M. on TUESDAY, APRIL 9, 2019 at which time they will be opened and read aloud. Bids must be
submitted in sealed envelopes marked on the outside: "IFB 19-03 TICKETING HALL EXPANSION - PHASE 2:
BP2 TICKETING HALL”. THE CITY WILL RECEIVE BIDS FROM ONLY THE FOUR (4) GENERAL
CONTRACTORS THAT HAVE BEEN PRE-QUALIFIED BY THE CITY IN ACCORDANCE WITH THE
CITY COUNCIL’S ACTION TAKEN JANUARY 23, 2019, AS LISTED BELOW. Note that trade sub-
contractor bids to the Pre-Qualified General Contractors are sought for this project. Please submit trade

DELIVERY OF BIDS - It is the responsibility of the contractor to see that any bid that is hand delivered,
sent through the mail, or by any other delivery method, shall have sufficient time to be received by the
Office of Procurement & Contracting by the due date and time. Late bids will not be accepted and shall
be returned unopened.
BID SECURITY - Each bid shall be accompanied by either cash, certified cashier's check, or Bid Bond in the
amount of ten (10) percent of the total bid price (all schedules, as applicable), payable to the City of Palm
Springs, as a guarantee that the Bidder, if its Bid is accepted, will promptly obtain the required Bonds and
Insurance and will prepare the required submittal document and execute the Agreement
LOCATION OF WORK - The Work to be performed hereunder is located at the Palm Springs International
Airport, 3400 E. Tahquitz Canyon Way, Palm Springs, California.
DESCRIPTION OF WORK: The Work to be done consists of the Ticketing Hall Expansion Base Bid in
three phases and two Bid Alternates.
Phase 2A - Baggage Screening Room and North Ticketing Hall entails; installation and commissioning of
new BHS serving north section of the North Ticketing Hall. Construction of the North ATO and ticket
counters, and construction of public spaces.
Phase 2B North Central Ticketing entails; installation and commissioning of new BHS serving south
section of the North Ticketing Hall. Construction of the North Central ATO and Ticket Counters, and
construction of public spaces.
Phase 2C South Ticketing Hall entails; installation and commissioning of new BHS serving the South
Ticketing Hall. Construction of the South ATO and Ticket Counters, and construction of public spaces.
Bid Alternate 1 Baggage Make-up (West) Carousel C entails; deleting all work associated with the
construction of Baggage Make-up (West) Carousel C (SN 14 on Drawing A904).

Bid Alternate 2 Ramp Building entails; deleting all work associated with the construction of the Ramp
Building shown on drawing A906.
The Engineer’s Estimate falls with a range of $26 to $28.2 million.
The City has not yet received FAA grant funding. However, a pre-application has been made and there is
sufficient Airport Improvement Program entitlement funding allocated for this project, but the FAA will not
issue final grant offer without final bid price amount.

Inviting Bids, which includes the contract information above for the 4 Pre-Qualified General Contractors
bidding on this project, and any Addenda issued can be found on-line at the City’s webpage at

PRE-BID CONFERENCE AND VISIT TO WORK SITE - All 4 pre-qualified General Contractors that have
been approved for this project must attend the Mandatory Pre-Bid Conference that will be held on
THURSDAY, FEBRUARY 28, 2019 AT 10:00 A.M. at the Palm Springs International Airport, 3400 E.
Tahquitz Canyon Way, Palm Springs, CA, in the 2nd floor conference room. Failure of a pre-qualified
General Contractor to attend this mandatory pre-bid conference shall disqualify them from bidding. Sub-
Contractors that are interested in the project are encouraged and welcome to attend, however it is NOT
Mandatory for Sub Contractors. A tour of the site will occur immediately following the conclusion of the
pre-bid conference.
CONTRACTOR'S LICENSE CLASSIFICATION - In accordance with the provisions of California Public Contract
Code Section 3300, the City has determined that the Contractor shall possess a valid California Class A
Contractors License at the time the Contract is awarded. Failure to possess the specified license shall render
the bid as non-responsive and shall act as a bar to award of the Contract to any bidder not possessing said
license at the time of award.
The Contractor must be licensed to do business in the City of Palm Springs in accordance with the provisions of
Chapter 9, Division 3, of the Business and Professions Code, and will be required to obtain a City Construction
Permit No Fee from the Building Department and/or the Public Works Inspection Supervisor, City Hall, Palm
Springs, California.
STATEMENT OF QUALIFICATIONS - Each proposal must be accompanied by a statement of the bidder's
qualifications to perform the work contemplated. The Statement of Qualifications shall be prepared on the form
attached hereto.
CONTRACTORS REGISTRATION REQUIREMENTS - As a condition of award, the contractor and any
subcontractor listed on the bid must be registered with the Department of Industrial Relations pursuant to
Section 1725.5 of the California Labor Code.
COMPLETION OF WORK - Time is of the essence. All field work must be completed within 452
consecutive calendar days after commencement date stated in the Notice to Proceed.
AWARD OF CONTRACT - The contract will be awarded to the lowest responsible bidder on the basis of
the Base Bid without the deductive alternates. The City reserves the right, after opening, to reject any
and all bids, or to waive any minor informality in a bid. The award of the contract is subject to the
approval of the Federal Aviation Administration.
As a condition of award, the successful bidder will be required to submit bonds and insurance, prior to the

execution of the contract by the City. Failure to meet this requirement shall constitute abandonment of
the Bid by the Bidder and forfeiture of the Bid Bond. If this occurs the contract will then be awarded to the
next lowest bidder.
BIDS TO REMAIN OPEN - The Bidder shall guarantee the Total Bid Price for a period of one-hundred
twenty (120) calendar days from the date of Bid Opening.
TITLE VI NOTICE The City of Palm Springs, in accordance with the provisions of Title VI of the Civil
Rights Act of 1964 (78 Stat. 252, 42 U.S.C. §§ 2000d to 2000d-4) and the Regulations, hereby notifies all
bidders that it will affirmatively ensure that any contract entered into pursuant to this advertisement,
disadvantaged business enterprises will be afforded full and fair opportunity to submit bids in response to this
invitation and will not be discriminated against on the grounds of race, color, or national origin in
consideration for an award.
DAVIS-BACON REQUIREMENTS The Bidder shall comply with all Davis-Bacon and Related Act
Requirements. All rulings and interpretations of the Davis-Bacon and Related Acts contained in 19 CFR
Parts 1 and 5 are herein incorporated by reference in the Contract.
WAGE RATE REQUIREMENTS -
(a) State - In accordance with the provisions of California Labor Code Section 1770, 1773,
1773.1,1773.6 and 1773.7, as amended, the Director of the Department of Industrial Relations has
determined the general prevailing rate of per diem wages in accordance with the standards set forth in
Section 1773 for the locality in which the Work is to be performed. A copy of said wage rates is on file at the
Department of Building and Safety, City Hall, Palm Springs, California. It shall be mandatory upon the
Contractor to whom the Work is awarded and upon any subcontractor under the Contractor to pay not less
than said specified rates to all workers employed by them in the execution of the Work, and shall post a
copy of said wage rates at the project site.

(b) Federal - The general prevailing rate of wages, as determined by the Secretary of Labor are
included hereinafter as part of the Contract Documents; provided, that if there is any difference between the State or
Federal wage rate for any given craft or mechanic needed to execute the work, it shall be mandatory upon the
Contractor and any subcontractor to pay the higher of the two rates.
The City will not accept lower State wage rates not specifically included in the Federal minimum wage
determinations. This includes “helper” (or other classifications based on hours of experience) or any other
classification not appearing in the Federal wage determinations. Where Federal wage determinations do not
contain the State wage rate determination otherwise available e for use by the Contractor and subcontractors,
the Contractor and subcontractors shall pay not less than the Federal subcontractors, the Contractor and
subcontractors shall pay not less than the Federal minimum wage rate, which most closely approximates the
duties of the employees in question.
The Contractor and any subcontractors shall pay not less than said specified rates and shall post a copy of said
wage rates and other notices prescribed by regulation at the project site.
All contracts and subcontracts that result from this solicitation incorporate by reference the provisions of 29 CFR
part 201, the Federal Fair Labor Standards Act (FLSA), with the same force and effect as if given in full text.
The FLSA sets minimum wage, overtime pay, recordkeeping, and child/labor standards for full and part-time
workers.
The Contractor has full responsibility to monitor compliance to the referenced statute or regulation. The
Contractor must address any claims or disputes that arise from the requirement directly with the U.S.
Department of Labor - Wage and Hour Division.
FOREIGN TRADE RESTRICTION - The Bidder agrees that, if awarded a contract resulting from this

solicitation, it will incorporate this provision for certification without modification in all lower tier
subcontracts. The Contractor may rely on the certification of a prospective subcontractor that it is not a
firm from a foreign country included on the list of countries that discriminate against U.S. firms as
published by USTR, unless the Offeror has knowledge that the certification is erroneous.
BUY AMERICA - The Aviation Safety and Capacity Expansion Act of 1990 provides that preference be
given to steel and manufactured products produced in the United States when funds are expended pursuant to a
grant issued under the Airport Improvement Program.
DEBARMENT AND SUSPENSION - By submitting a bid/proposal under this solicitation, the bidder or
offeror certifies that neither it nor its principals are presently debarred or suspended by any Federal
department or agency from participation in this transaction
DISADVANTAGED BUSINESS ENTERPRISE - The requirements of 49 CFR part 26 apply to this
contract. It is the policy of the City of Palm Springs to practice nondiscrimination based on race, color,
sex, or national origin in the award or performance of this contract. The Owner encourages participation
by all firms qualifying under this solicitation regardless of business size or ownership.
LOBBYING AND INFLUENCING FEDERAL EMPLOYEES - Contractors that apply or bid for an award of
$100,000 or more must certify that it will not and has not used Federal appropriated funds to pay any
person or organization for influencing or attempting to influence an officer or employee of any agency, a
member of Congress, officer or employee of Congress, or an employee of a member of Congress in
connection with obtaining any Federal contract, grant, or another award covered by 31 USC 1352. Each
tier must also disclose any lobbying with non-Federal funds that takes place in connection with obtaining
any Federal award
PROCUREMENT OF RECOVERED MATERIALS - Contractor and subcontractor agree to comply with
Section 6002 of the Solid Waste Disposal Act, as amended by the Resource Conservation and Recovery
Act, and the regulatory provisions of 40 CFR Part 247.
NOTICE OF REQUIREMENT FOR AFFIRMATIVE ACTION
1. The Offeror’s or Bidder’s attention is called to the “Equal Opportunity Clause” and the “Standard
Federal Equal Employment Opportunity Construction Contract Specifications” set forth herein.
2. The goals and timetables for minority and female participation, expressed in percentage terms for the
Contractor’s aggregate workforce in each trade on all construction work in the covered area, are as
follows:

These goals are applicable to all of the Contractor’s construction work (whether or not it is Federal or
federally assisted) performed in the covered area. If the Contractor performs construction work in a
geographical area located outside of the covered area, it shall apply the goals established for such
geographical area where the work is actually performed. With regard to this second area, the Contractor
also is subject to the goals for both its federally involved and non-federally involved construction.
The Contractor’s compliance with the Executive Order and the regulations in 41 CFR Part 60-4 shall be
based on its implementation of the Equal Opportunity Clause, specific affirmative action obligations
required by the specifications set forth in 41 CFR 60-4.3(a) and its efforts to meet the goals. The hours of
minority and female employment and training must be substantially uniform throughout the length of the
contract, and in each trade, and the Contractor shall make a good faith effort to employ minorities and
women evenly on each of its projects. The transfer of minority or female employees or trainees from
Contractor to Contractor or from project to project for the sole purpose of meeting the Contractor’s goals

shall be a violation of the contract, the Executive Order, and the regulations in 41 CFR Part 60-4.
Compliance with the goals will be measured against the total work hours performed.
3. The Contractor shall provide written notification to the Director of the Office of Federal Contract
Compliance Programs (OFCCP) within 10 working days of award of any construction subcontract in
excess of $10,000 at any tier for construction work under the contract resulting from this solicitation. The
notification shall list the name, address, and telephone number of the subcontractor; employer
identification number of the subcontractor; estimated dollar amount of the subcontract; estimated starting
and completion dates of the subcontract; and the geographical area in which the subcontract is to be
performed.
4. As used in this notice and in the contract resulting from this solicitation, the “covered area” is State of
California, County of Riverside, City of Palm Springs.
RETAINAGE FROM PAYMENT - The Contractor may elect to receive 100 percent payments due under
the Contract Documents from time to time, without retention of any portion of the payment by the City, by
depositing securities of equivalent value with the City in accordance with the provisions of Section 22300
of the Public Contract Code. Such securities, if deposited by the Contractor, shall be valued by the City,
whose decision on valuation of the securities shall be final. Securities eligible for investment under this
provision shall be limited to those listed in Section 6430 of the Government Code or bank or savings and
loan certificates of deposit.
ADDRESS AND MARKING OF BIDS - The envelope enclosing the Bid shall be sealed and addressed to
the City of Palm Springs, and shall be delivered or mailed to Craig L. Gladders, C.P.M., Procurement and
Contracting Manager, at 3200 East Tahquitz Canyon Way, Palm Springs, CA 92262. The envelope shall
be plainly marked in the upper left hand corner with the name and address of the Bidder and shall bear
the words IFB 19-03 TICKETING HALL EXPANSION - PHASE 2: BP2 TICKETING HALLfor the
"PALM SPRINGS INTERNATIONAL AIRPORT", followed by the date and hour of opening Bids. The
certified or cashier's check or Bid Bond shall be enclosed in the same envelope with the Bid.
