a part of the Contract Documents and modifies them as follows:

1. Questions & Answers:
a. Q: Does BGS require commissioning for this project and should we include those services in our bid?
A: The State will hire an independent commissioning agent for this project. The Architect/Engineer will be
responsible for coordination with the commissioning agent.
b. Q: 2.3 BASIC SERVICES, 2.3.2 states "Ensure the project complies with all applicable codes and
guidelines in effect at the time of the design, including but not limited to:" Based on the attached drawings
in the RFP is the period of design 1991?
A: The Architect/Engineer is to follows all current codes and guidelines, (2026) for work outlined in this
RFP.
c. Q: Can you advise if autocad or revit drawings are available for these buildings?
A: AutoCAD drawings exist for the buildings in general (such as floor plans), but with regard to the exhaust
fans, the only applicable drawings available are scans from when the buildings were constructed.
d. Q: On page 26 of 72 (Sample Contract), section 1.1.39, the current language is outside of standard insurance
coverage due to the lack of the word negligence. Can this section be changed to read “The
ARCHITECT/ENGINEER shall be responsible for and shall pay the amount of any increase in the total
Contract Price or the total Change Orders Price, which increase results from a negligent error,
inconsistency, or omission in the Contract Documents or instructions.”
A: The State will not accept proposed changes, exceptions, or modifications to the State’s standard contract
terms and conditions.
e. Q: On Page 32 of 72 of the RFP (Sample Contract) references Attachment C: Standard State Provisions for
Contracts and Grants (rev 10/01/24), however in other locations (as well as the state website) the 2/13/26
revision of Attachment C is the more current version. We assume the 2/13/26 revision of Attachment C
will be applicable?
A: Yes, the 02/13/26 revision of Attachment C is the most current and applicable.
