De Soto #73 School District is requesting competitive quotes from vendors for Pour-in-Place
Playground Surfacing. Enclosed is a Request for Proposal (RFP), responsive Proposal will
comply with all federal, state and local regulations. Information regarding the services to be
provided, information which must be submitted as part of the Proposal, and related details are
included in the accompanying RFP.
Proposals will be accepted no later than 11:00 a.m., Tuesday, March 17, 2026. No late submittals
will be accepted. The Board of Education reserves the right to accept or reject any or all
Proposals, to waive any irregularities, and to accept the Proposal that is in the best interest of
the District.

Request for Proposal Specifications
The De Soto #73 School District is seeking competitive bids for Pour-in-Place Playground Surfacing.
Below are the Minimum Specifications:
Specifications
Product Specification:
The type of material to be used for the project is pour-in-place surfacing with a minimum
requirement of the project to consist of at least 40% Missouri generated scrap tires. The materials
for the project must use at least 40% Missouri generated scrap tires to be eligible. All bids must
specify the minimum percentage of Missouri generated scrap tires used in their product
documented by dated copies on company letterhead along with the bid documents.
Project Description:
The intention of the district is to have the vendor complete all site prep and required underlayment
once the district has removed all wood chips from the identified locations. The underlayment
should be an approved material other than concrete to reduce costs unless concrete is less
expensive than the alternative being presented by the vendor. The district would like to add the
pour-in-place surfacing to three (3) specific areas on the Athena Elementary playground located
at 3775 Athena School Road in De Soto, Missouri. The surfacing material color should be color
matched as close as possible with the current pour-in-place surfacing at the existing Athena
Elementary School playground. The district knows it may be cost prohibitive to complete all areas
and thus reserves the right to select one area, two areas, or all three areas from a single vendor
depending on the cost. Area A is approximately 2,567 Sq. Feet, Area B is approximately 1,721
Sq. Feet, and Area C is approximately 1,767 Sq. Feet. The total Square footage is 6,055 for the
total project.

The De Soto School District reserves the rights to reject and approve individual options without a
cost variance on an individual option.

MATERIALS:
There shall be no asbestos containing building materials used within the scope of this
project.
Bid proposals shall be part of the contract and failure to comply with requirements of this
proposal will be a breach of contract.
In order to better comply with the goals of the Missouri Safe Schools Legislation, the District
requires the following of all Contractors and Subcontractors: All Contractors and Subcontractors
shall provide a written statement that all employees under their employ who would have any
presence on the District’s property have been checked against all State and Federal registries and
have no record of offenses that would in any way be in conflict with the Safe Schools objectives
or other objectives of the De Soto School District in providing all reasonable measures to insure
the safety and well being of the District’s staff and student population.
Before submitting their proposals, bidders shall carefully examine the specifications and drawings
and fully inform themselves of the existing conditions.
For Duration of Construction Project
Requirements:
*Work on lots must be coordinated with District representative
*Have a responsible Construction Manager (foreman or supervisor) on site at all times
* Apply for and acquire any and all permits required to begin and complete this construction
project
* Contact and accompany the Fire Marshall for any and all inspections
* Contact and accompany County Building Inspector for any and all inspections
* Make arrangements for trash removal from construction site
* Ensure the security of building staff and contents each day by keeping doors locked and
windows closed before leaving construction site
* Use only asbestos free building materials
* Ensure all employees will conduct themselves in a professional manner consistent with that of a
public education environment
* Achieve substantial completion of this project
* Provide lien waiver from all suppliers and subcontractors
* Provide prevailing wage determination for all employees and subcontractor employees working
within the scope of this project (unless project is less than $75,000.00)
* Provide a statement guaranteeing the use of only asbestos free materials in the scope of this
project
* Provide a written warranty/guarantee ensuring the quality of all materials and craftsmanship for
one full year
* Correct any discrepancies discovered by a District representative (punch list)
* Accompany a District representative on final walk through
The contractor guarantees all work performed under this contract against defects in materials and
workmanship for a period of one year from and after final acceptance of the completed work by

the owner.
The contractor agrees that at their expense, and without extra cost to the owner, remove, repair or
replace all defective materials, equipment, apparatus and work, and pay for all damages resulting
from defects.
Bidders attention is directed to the fact that all applicable Federal and State laws, Municipal
Ordinances, Codes and Rules and Regulations of all authorities having jurisdiction over
construction of the Project shall apply to the contract. They will be deemed to be included in the
contract the same as though written therein in full.
The contractor shall obtain all permits as required. Costs of permits and any associated fees must
be included in the bid. The District will not reimburse contractors for permit fees.
By submitting a bid, contractors agree to consult with appropriate local and county agencies
during the development and final planning process for this job. Through these consultations the
contractor will assure that all bid specifications meet with local codes and regulations and any
local agencies interpretation thereof. Contractors agree to procure all applicable State of Missouri
and Jefferson County permits and licenses before beginning any work on school property.
This is a tax-exempt project and the owner will provide a Missouri StateTax Exemption
Certificate. The contractor shall make all material purchases for this particular project with the
Tax Exemption Certificate and, therefore will not incur Missouri State Sales Tax. The owner will
not reimburse the contractor for sales tax under any circumstance.
There is a NO SMOKING policy as adopted by the De Soto #73 School District Board of
Education. This policy prohibits smoking anywhere within the boundaries of De Soto #73 School
District property, to include buildings, facilities, grounds, parking lots, etc. The policy covers De
Soto #73 School District Employees, as well as contractors.
