RFP # 1851 – Purchase of Delinquent Municipal Tax and Sewer Use Liens

Questions received by August 5, 2026 and answers.
1. § 7(a) requires the transmittal letter to include “the information requested in Section 6
herein.” Section 6 is Purchase of Future Assigned Liens; the content list is in Section 7.
Response: See amendment to RFP.
2. Qualification Reference Forms. The “Steps of the qualifying process” list on page P-19 of
the Proposer Qualification Form identifies “Qualification Reference Forms (3)” among
the documents that must be received. No such form appears in the RFP package. Please
provide the form or confirm that the professional and financial reference sections within
the Proposer Qualification Form satisfy this requirement.

3. Future Assigned Liens — mandatory or optional. Section 6 of the RFP states that the
Proposer “shall also purchase all delinquent liens on subsequent Grand Lists for
properties on the Final List,” with payment due within forty-eight (48) days after the City
files the lien continuation certificate. Section 3 of the draft Agreement at Attachment B
states that the Purchaser “shall have the option, but not the obligation, to purchase such
Future Assigned Liens,” on a June 1 notice and June 15 election schedule. Please confirm
which provision governs, and if the Agreement governs, whether Section 6 of the RFP
will be conformed.

4. Foreclosure moratorium scope. Page RFP-4 provides that the Proposer shall not
commence foreclosure with respect to any tax lien arising on an owner-occupied building
for one year from the assignment date. Section 4 of the draft Agreement provides that the
Purchaser shall not institute foreclosure on any Assigned Lien for one year from the date
the Assignment is recorded on the Milford Land Records. Please confirm whether the
moratorium applies to all Assigned Liens or only to owner-occupied properties, and
whether the one-year period runs from the assignment date or the recording date.
Response: The one-year moratorium applies to the commencement of foreclosure
proceedings on all assigned liens and is not limited to liens on owner-occupied properties.
The applicable statute does not distinguish between owner-occupied and non-owner-
occupied properties. The one-year period runs from the date of assignment.
5. Exceptions. Section 7 states that the City will not accept conditional proposals and
requires a statement accepting all terms and conditions contained in the RFP. Please
confirm whether a Proposer that notes a requested modification to the draft Agreement at
Attachment B would be treated as having submitted a conditional proposal.
Response: Minor requested modifications to the draft Agreement will not, by themselves,
cause a proposal to be considered conditional. However, material or substantive
modifications to the terms of the Agreement will not be accepted.
In response to questions 1, 2 and 3, attached as part of this Addendum is a revised
version (Rev 2) of RFP # 1831.

NOTICE OF REQUEST FOR PROPOSALS
FOR THE PURCHASE OF
DELINQUENT MUNICIPAL TAX AND SEWER USE LIENS
RFP # 1851
The City of Milford, Connecticut is requesting written, sealed proposals from interested parties
for the purchase of delinquent municipal property tax and sewer use liens, pursuant to the
provisions of Connecticut General Statutes Sections 12-195h and 7-258. This purchase is
hereinafter referred to as Tax Lien Assignment. The total amount due to the City, through June
30, 2026 on these liens is $4,590,635.31, collectively between the two lists. The sale of the total
of all delinquent tax and sewer use liens on each individual parcel will be conducted as a single,
non-securitized transaction.
The Purchasing Agent must receive proposals not later than 3:00 P.M. EDT, Wednesday,
August 12, 2026. The RFP may be downloaded from the City of Milford’s website,
https://www.milfordct.us/863/Current-Bids. Copies may also be obtained from the Purchasing
Agent’s Office, 70 West River Street, Milford, CT 06460, and telephone (203) 783-3225. All
proposals must be in accordance with the terms of the RFP. Procedural questions on this
