NOTICE OF FINDING OF NO SIGNIFICANT IMPACT AND NOTICE OF INTENT TO REQUEST RELEASE FOR FUNDS July 5, 2016 Hudson County Division of Housing and Community Development 830 Bergen Avenue, 5B Jersey City, NJ 07306 Thee notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the Hudson County Division of Housing and Community Development. REQUEST FOR RELEASE OF FUNDS On or about July 26, 2016, the Hudson County Division of Housing and Community Development will submit a request to HUD for the release of funds under Title I of the Housing and Community Development Act of 1974, as amended, to undertake the following projects; Terzetto NJ, LLC- Veterans Affordable Housing and Commercial, 524 Ocean Avenue, Jersey City, NJ 07305 Funding provided for Terzetto NJ, LLC to newly construct 20 units of affordable housing with a preference for veterans. The project additionally includes first floor commercial space. The project will utilize HOME funding in the amount of $800,000. FINDING OF NO SIGNIFICANT IMPACT The Hudson County Division of Housing and Community Development has determined that the projects will have no significant impact on the human environment. Therefore, Environment Impact Statements under the National Environmental Policy Act of 1969 (NEPA) are not required. Additional project information is contained in the Environmental Review Records (ERRs) on file at the Hudson County Division of Housing and Community Development at 830 Bergen Avenue, Jersey City, New Jersey 07306 and may be examined or copied weekdays from 9am to 5pm. PUBLIC COMMENTS Any individual, group or agency disagreeing with this determination or wishing to comment on the project may submit written comments to the Hudson County Division of Housing and Community Development at 830 Bergen Avenue, Jersey City, New Jersey 07306. All comments received by July 26th, 2016 will be considered by the Hudson County Division of Housing and Community Development prior to authorizing submission of release for release of funds. RELEASE OF FUNDS The Hudson County Division of Housing and Community Development certifies to HUD that Thomas A. DeGise in his capacity as County Executive consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows the Hudson County Division of Housing and Community Development to use Program Funds. OBJECTIONS TO RELEASE OF FUNDS HUD will accept objections to its release of funds and the Hudson County Division of Housing and Community Development's certification for a period of fifteen (15) days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of Hudson County, Thomas A. DeGise; (b) the Hudson County Division of Housing and Community Development has omitted a step of failed to make the decision of finding required by HUD regulations by 24 CFR Part 58; (c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by HUD, One Newark Center, 13th Floor, Newark, New Jersey 07102.
