City of Oakley 2023-2031 - 6th Cycle Housing Element Update

Request for Proposals & Qualifications

Background:

The City of Oakley ("the City") is seeking a qualified professional firm to prepare an update of the City's 6th Cycle Housing Element Update.

Incorporated on July 1, 1999, the City of Oakley is located in eastern Contra Costa County along the shore of the Sacramento-San Joaquin Delta near the cities of Brentwood and Antioch. The City of Oakley has a current population of approximately 41,324 (2019 United States Census Bureau).

The City of Oakley adopted its first General Plan in 2002 and Zoning Ordinance in 2005. In 2006, the Housing Element was certified by the California Department of Housing and Community Development ("HCD"). The current 2015 – 2023 Housing Element was adopted on January 28, 2015. The next Housing Element Cycle is due to HCD by January 31, 2023.

The Association of Bay Area Governments ("ABAG") has determined Oakley's fair share of housing as follows:

The final Regional Housing Allocation has not yet been adopted by ABAG, and is estimated to be considered by ABAG's Executive Board in Late 2021. The Draft numbers are subject to change.

II. Scope of Services:

A. Scope of Work

Proposals should follow the format outlined below and all requested information must be supplied. The proposal requirements are as follows:

  1. Develop a schedule for preparation and preliminary City Council approval of the Draft 2023-2031 Housing Element and submittal to the State HCD prior to January 31, 2023. The schedule shall include timelines for responses to HCD review and HCD certification of the Housing Element. The HCD Housing Element Update Guidance and streamlined review process should be taken into account.
  2. Update all required sections of the City's Housing Element.
  3. Prepare preliminary drafts, a final draft, and the final 2023-2031 6th Cycle Housing Element Update, in compliance with the requirements of the State Housing Element law and HCD.
  4. Prepare revisions to the draft 2023-2031 6th Cycle Housing Element Update in response to Staff, the City Council, and the HCD.
  5. Prepare the environment document. (Please see E. Environmental Review section below)
  6. Prepare a public participation program:
    1. One (1) "kick-off" meeting with the City Staff;
    2. One (1) educational and public informational meeting with the public;
    3. Potentially one (1) City Council work session; and
    4. One (1) City Council meeting.
  7. Assist in the preparation of public meeting presentation materials, letters, memos, and other documents as required by City Staff in paper and electronic forms. (City Staff will prepare Staff Reports and Resolutions, and prepare, post, mail, and publish public hearing notices.)
  8. Provide regular e-mail progress reports to Staff, and as necessary to communicate updates.
  9. Coordinate with City Staff and HCD Staff, as necessary, to obtain HCD certification in a timely manner.

B. Content of Proposal and Statement of Qualifications

  1. Please include a detailed description of each appropriate component of the project and how each task will be completed.
  2. Please include a description of the company profile, including the range of the firm's capabilities and services. In addition, please provide the names of the Project Manager as well as all other personnel who will be specifically assigned to this project, including their qualifications, education, previous representative experience and their problem solving capabilities. All contemplated sub-consultants to be used during this assignment are required to provide the above requirements as well.
  3. Please provide references for similar projects. Please include the telephone number and the name of each reference.
  4. Please provide a schedule showing the time required for completion of the project and addressing the State's deadline for submission to HCD.
  5. The City anticipates a total budget of approximately $160,000 to complete the scope of work described herein. If the consultant proposes a fee in excess of this estimate, tasks should be identified that can be undertaken by City Staff to reduce the fee to within the City's anticipated budget.

C. Deliverables and Timeline

Deliverables include the draft(s) and certified 2023-2031 6th Cycle Housing Element, memos, and other materials listed in the "Scope of Work" section. In addition to the original copies of all final documents, the consultant shall provide the following:

  1. Three (3) copies of the project schedule;
  2. Three (3) copies of the Draft Housing Element, including one (1) reproducible original and one (1) digital file; and
  3. Three (3) copies of the Certified Housing Element, including one (1) reproducible original and one (1) digital file.

All documents and materials shall be prepared in Microsoft Office Word format. Regular updates of the documents shall also be provided to City Staff (electronic format is acceptable). All changes from the original draft shall be noted in underscore and strikethrough or "track changes". The City anticipates a 12 month schedule, with HCD certification being received prior to January 31, 2023.

D. State Housing Element Legal Requirements

The Qualification Statement shall demonstrate the following:

  1. The consultant's knowledge of Housing Element state law and how it applies to this project.
  2. The Housing Element certification requirements and process of HCD.
  3. Understanding of the HCD streamlining review process.
  4. Understanding and experience with HCD staff for Housing Element preparation.
  5. A list of California cities and contacts where the consultant has recently prepared a Housing Element and environmental documents.

E. Environmental Review

The Housing Element Update is subject to review under the California Environmental Quality Act (CEQA). The consultant will be responsible for preparation of an Initial Study (IS) to determine the appropriate project environmental review. Options are anticipated to include a Negative Declaration (ND), Mitigated Negative Declaration (MND), or Environmental Impact Report (EIR). The consultant shall demonstrate the ability to prepare the environmental review document in the Qualification Statement to the City of Oakley. Pending determination by the City, the consultant will be responsible for the preparation of the ND, MND, or EIR to evaluate and/or mitigate environmental effects of the Housing Element Update. Consultant should use the most up to date version of the Initial Study Checklist as normally found as Appendix G of the State CEQA Guidelines.

III. Qualifications Statement Requirements:

Statement shall include the following:

  1. Information demonstrating the Consultant's understanding of and approach to the project.
  2. Information which demonstrated the Consultant's experience in Housing Element preparation for cities similar in size and population as Oakley.
  3. Identification of the personnel proposed on this project including the project manager, qualifications and experience on similar projects.
  4. A detailed project schedule for the project including milestones and deliverables.
  5. Specific comments on the City's Standard Consultant Services Agreement proposed for this project, a copy of which is attached. Proposals shall identify any exceptions taken by the Consultant regarding the terms, conditions and requirements of the City's Standard Agreement along with an explanation and suggested language for dealing with the exception. Unless exceptions are noted in the proposal, the selected Consultant will be expected to execute the City of Oakley's Standard Agreement as proposed. The Consultant's proposal will be referenced and included as an exhibit in the final Agreement executed with the City.

IV. Selection Process:

Written proposals with qualification statements will be evaluated by the City of Oakley and may include an interview. Staff will make a recommendation on a Consultant to the Oakley City Council for approval and authorization to negotiate and execute an Agreement to provide the requested services. The City reserves the right to reject any and all proposals, and to negotiate final contract terms with any selected consultant.

V. Background Information:

It is noted that in February 2020, the City of Oakley was awarded the maximum allocation of $160,000 in relation to the Senate Bill 2 Planning Grant Program. $110,000 of that amount has been earmarked for rezoning of land to comply with this Housing Element Update. The City of Oakley has also been awarded $50,000 as part of the Local Early Action Planning (LEAP) Grant for the purposes of preparation of the Housing Element Update and compliance with the 6th Cycle RHNA.

VI. Qualification Statement Deadline:
