LEGAL NOTICE - ADVERTISEMENT FOR BIDS

Notice is hereby given that the TRUMBULL COUNTY BOARD OF COMMISSIONERS will receive sealed bid documents at the office of the Clerk, 5th Floor, 160 High Street NW, Warren, Ohio, until 10:00 AM Eastern Standard Time (EST), Friday, April 26, 2024 for construction of the STATE ROAD WATER REGIONALIZATION PROJECT (Trumbull County Project No. 2-W-23), partially funded with grant and loans from the Ohio EPA Water Supply Revolving Loan Account, at which time and place all bids will be publicly opened and read aloud.

The Project is located in Southington Township and Champion Township, Trumbull County, Ohio, and consists of the installation of new 8-inch and 10-inch PVC waterline along SR 305/State Rd. NW from Barclay-Messerly Rd. to Glenn Ave., along Alva Ave. NW, and along SR 305-Center St. The project also includes a new water booster station.

Contract A – Waterline Extensions includes all labor and materials for the installation of approximately 16,500 lineal feet of 10” PVC waterline and 3,000 lineal feet of 8” waterline installed primarily via horizontal directional drilling, valves, hydrants, service connections, restoration and all other appurtenances whether specifically mentioned or not.

Contract B – Booster Station includes all labor and materials for the installation of a new package water booster station, electrical and SCADA, utility piping, fencing, asphalt driveway, site work, and restoration and all other appurtenances whether specifically mentioned or not.

This description is a partial summary of quantities contained in the Bids, therefore, Bidders should review Bid forms for a complete itemization of all quantities of work. The engineer’s opinion of probable construction cost for Contract A and Contract B, individually, is as follows:

• Contract A: $2,572,600

• Contract B: $909,000

The Contractor shall substantially complete the work within the below listed calendar days of the “Notice to Proceed” date. The Contractor shall pay liquidated damages in the amount of $750 for each consecutive calendar day of delay beyond substantial completion.

• Contract A:

o Substantial Completion – 205 calendar days

o Final Completion - 325 calendar days

• Contract B:

o Substantial Completion – 450 calendar days

o Final Completion - 480 calendar days

Plans, Specifications, Blank Bid Forms, and other Contract Documents may be EXAMINED AND/OR OBTAINED, at the office of Northeast Blueprint & Supply Company, http://www.northeastblueprint.com, East 286th Street, Euclid, Ohio 44132-2138, (216) 261-7500, upon advance payment of two hundred fifty dollars ($250), NONE OF WHICH WILL BE REFUNDED. Additional fees may be incurred for postage and handling, as applicable. Northeast Blueprint & Supply will maintain the official plan holder’s list. All bidders must be registered on the official plan holder’s list in order to submit an official bid for consideration.

Bids must be submitted using only the forms contained in the bound Project Bid Documents and Specifications and must be sealed in individual envelopes addressed to Lisa Blair, Interim Clerk, Trumbull County Commissioner’s office, 5th Floor, 160 High Street N.W., Warren, Ohio 44481, with the bidder's name, address, and the project name “STATE ROAD WATER REGIONALIZATION PROJECT”, clearly shown on the envelope. The full name and address of the party or parties making the Bid and all persons interested therein shall be named in the Bid Documents. Each Bidder must also submit evidence of experience on projects of similar size and complexity, along with verifiable reference for such work.

Each Bidder must furnish a Bid Bond, signed by a Surety Company authorized to do business in the State of Ohio in the sum of one hundred percent (100%) of the amount bid, or a Certified Check, Cashier’s Check or Letter of Credit revocable only by the Treasurer of Trumbull County equal to ten percent (10%) of the amount bid. Such Bid Bond or Check is a guarantee that if the bid is accepted, a contract will be entered into and the performance of it properly secured by a performance and payment bond in the amount of one hundred percent (100%) of the contract in accordance with the provisions of Ohio Revised Code Section 153.54.

All contractors and sub-contractors involved with the project will, to the extent practicable, use Ohio products, materials, services, and labor in the implementation of their project. Additionally, Domestic Steel Use Requirements, as specified in Section 153.011 of the Ohio Revised Code and the American Iron and Steel provisions of P.L. 113-76, Consolidated Appropriations Act, 2014 apply to this project. DOMESTIC STEEL USE REQUIREMENTS AS SPECIFIED IN OHIO REVISED CODE SECTION 153.011 APPLY TO THIS PROJECT. COPIES OF OHIO REVISED CODE SECTION 153.011 CAN BE OBTAINED FROM ANY OF THE OFFICES OF THE OHIO FACILITIES CONSTRUCTION COMMISSION. Contractors and Sub-Contractors shall be required to comply with Equal Employment Opportunity requirements of Ohio Administrative Code Chapter 123, The Governor’s Executive Order of 1972 and the Governor’s Executive Order 84-9.

This project is subject to the requirements of the Affirmative Action in Employment, Presidential Order 11246 “Equal Employment Opportunity” as amended and as supplemented in Department of Labor regulations 41 CFR 60, title VI of the Civil Rights Act of 1964, Section 3 of the Housing and Community Development Act of 1968, Section 109 of the Housing and Community Development Act of 1974, The Copeland "Anti-Kickback" Act (18 U.S.C. 874) as supplemented in Department of Labor regulations (29 CFR part 3), Sections 103 and 107 of the Contract Work Hours and Safety Standards Act (40 U.S.C. 327A 330) as supplemented by Department of Labor regulations (29 CFR part 5) and Davis Bacon and Related Acts requiring the payment of federal prevailing wages.

Attention is directed to all Bidders a “Non-Collusion Affidavit” must be signed. The successful Bidder must sign a statement concerning Personal Property Taxes, in accordance with Ohio Revised Code, Section 5719.042.

Attention is directed to all bidders Trumbull County adopted a "Drug and Alcohol-Free Workplace Policy" on July 21, 2004, Amended September 7, 2016 and terms of this Policy also apply to any Contractor[s] directly reimbursed for services through the County; that a copy of this Policy is to be part of the Bid; and that each Bid be accompanied by a "Sign-Off Sheet" duly signed by the Bidder.

Attention is also directed to all bidders pursuant to Ohio Revised Code Sections 307.86 and 307.87, effective September 26, 2003, this notice of bid will be published one-time only, with the condition that this notice has been posted on the County’s Internet Site on the world wide web and found at http://www.demandstar.com. (This notice may also be found at the Commissioners’ website at www.commissioners.co.trumbull.oh.us.)

No bidder may withdraw his bid for a period of sixty (60) days after the time of opening bids. The County reserves the right to reject any and all proposals, to waive any informalities or irregularities in the bid received, and to accept any proposal deemed most favorable to the County at the time and under the conditions stipulated. Trumbull County may increase, decrease or omit any Item in the Contract Documents, and/or to accept the Bid deemed most favorable to the County by the lowest responsive responsible bidder in compliance with the Trumbull County Uniform Guidance Policy and the 2 CFR Addendum contained within the bidding documents. If, in the opinion of Trumbull County or a delegated representative thereof, the lowest Bid is not deemed favorable and in the best interest of the County, the County may accept another Bid so opened or reject all Bids and re-advertise for other Bids. Bidders must be listed on the list of bidders who requested bid packets at the Trumbull County Sanitary Engineers in order to be considered for award of a contract.

A Contract shall be awarded to the lowest responsive responsible Bidder as soon as practical after Bid opening, subject to the reservation of the preceding paragraph. The successful Bidder must enter into a Contract with Trumbull County within 10 days after receipt of the formal “Notice of Award”, in compliance with “Instructions to Bidders”.

A Pre-Bid Conference on this Project has been scheduled on, Tuesday, April 16, 2024, at 1:30 PM at the office of the Trumbull County Sanitary Engineer, 842 Youngstown Kingsville Road, Vienna, Ohio 44473. This project is subject to funding by the Ohio EPA Drinking Water Assistance Fund and all program requirements must be satisfied.
