INVITATION TO BID
The Frederick County Procurement & Contracting Department, Winchester Hall, 12 East
Church Street, Frederick, Maryland 21701, will receive sealed proposals for:
SLOPE FAILURE REPAIRS ALONG
POFFENBERGER ROAD AND ROY SHAFER ROAD
FREDERICK COUNTY CONTRACT NO. 19-535-CP
BID NO. 19-535-CP
Description of Work: The project is located in Frederick County, Maryland. The project will be
bid as roadway improvements to Poffenberger Road and Roy Shafer Road. The work will include
the installation of a modular block retaining wall and soldier pile retaining wall along Poffenberger
Road, the installation of a reinforced soil slope along Roy Shafer Road, installing new traffic
barriers and end treatments, installing an 18” reinforced concrete pipe and headwalls, re-grading
an existing ditch, placing driving surface aggregate along Poffenberger Road, placing full depth
pavement along Roy Shafer Road and tying grading into existing topography. A temporary stream
diversion will be used.
Pre-Bid Conference: A non-mandatory Prebid Conference will be held on July 31, 2019,
at 2:00 PM, local time in the Winchester Room, Winchester Hall, 12 East Church Street, Frederick,
Maryland 21701.
PROJECT CLASSIFICATION C
Date of Bid Opening: Sealed Bids for the above will be received by the Frederick County
Procurement & Contracting Department, Winchester Hall, 12 East Church Street, Frederick,
Maryland, until 2:00 PM., local time, on August 20, 2019 at which time and place they will be
opened publicly and read in the Procurement & Contracting Conference Room, 2nd Floor,
Winchester Hall, 12 East Church Street, Frederick, Maryland.
Bids must be made in accordance with the requirements in the Bid Documents.
Disadvantaged Business Enterprises (DBE): Pursuant to 2 CFR §200.321 prime contractors are
required to take the following 5 affirmative steps to assure that minority businesses, women’s
business enterprises and labor surplus area firms are used when possible in the performance of this
contract:
(1) Placing qualified small and minority businesses and women's business enterprises on
solicitation lists;
(2) Assuring that small and minority businesses, and women's business enterprises are
solicited whenever they are potential sources;

(3) Dividing total requirements, when economically feasible, into smaller tasks or quantities
to permit maximum participation by small and minority businesses, and women's
business enterprises;
(4) Establishing delivery schedules, where the requirement permits, which encourage
participation by small and minority businesses, and women's business enterprises;
(5) Using the services and assistance, as appropriate, of such organizations as the Small
Business Administration and the Minority Business Development Agency of the
Department of Commerce.
A separate contract goal for participation of such firms has not been identified for this procurement.

locating qualified DBE firms. The directory may be found at:

Prevailing Wage Requirements: It shall be mandatory upon the Contractor to whom the Work is
awarded and upon any subcontractors under the Contractor to pay not less than the general
prevailing rate of wages as determined by the Secretary of Labor. The requirements of the Davis-
Bacon and Related Acts apply to this procurement.
The most recent applicable wage determination (General Decision No. MD190055 dated 1/4/2019
MD55, State: Maryland, Construction Type: Highway, County: Frederick County in Maryland) is
provided in Appendix G of the bidding documents. Bidders must use the most recent
determination in preparing their bid proposal and are advised to check the website identified below
for the most current wage determination prior to submitting their bids:

Supplier registration in Frederick County’s new procurement system is strongly
encouraged and is now required in order to be awarded a bid. At a yet to be determined
future date bid announcements will only be made by the new system. In order to register

NOTICE: CONTRACTORS, SUBCONTRACTORS AND SUPPLIERS THAT DO
NOT REGISTER WILL NOT RECEIVE NOTIFICATION OF ADDENDA,
THEREFORE, THE COUNTY ASSUMES NO RESPONSIBILITY FOR THE FAILURE
OF NON-REGISTERED ENTITIES TO RECEIVE ADDENDA.
No bids will be considered unless accompanied by a certified check, cashier's check, or a
treasurer's check drawn upon a bank or bid bond payable to the Frederick County, Maryland, in
the amount of 5 percent of the total bid price.
The successful bidder shall furnish a Payment Bond and a Performance Bond in the full
amount of the Contract Award. The successful bidder shall give bond, and comply with the Acts
of the General Assembly of Maryland respecting contracts.
Frederick County reserves the right to accept and/or reject any bids and to waive any
informalities or irregularities in the bidding.
