1.0 INFORMATION FOR BIDDERS
1.1 INTENT/SUMMARY OF SCOPE:
This Request for Qualifications/Proposals (RFQ/P) is issued by the New Jersey Economic
Development Authority (“Authority” or “EDA”) for Title Services on an as-needed basis,
including Title Insurance and Closing Services.
The purpose of this RFQ/P is to solicit proposals to engage up to five (5) title agents to
provide Title Services, on an as-needed rotating basis for real property located in the State
of New Jersey, as projects come up. Acquisitions may occur by purchase and/or
condemnation through the exercise of the Authority’s power of eminent domain. The
Authority may also require services related to its leasehold interest in real property. The
required services are described more specifically in the Scope of Services, Section 3.0 of
this RFQ/P.
Neither the number nor the identification of properties for which Title Services will be
required is known at this time. The Authority makes no representation as to: (i) the actual
number or identity of the parcels for which Title Services will be required, or (ii) the timing
and sequence of the need for title services.
Additionally, other Authority departments who handle various types of loan programs may
have a need for non-policy and/or policy Title Services, which can also include Out of State
searches, on occasion. Therefore, the Authority is seeking individual pricing for a menu of
various Title Services and/or Title Insurance/Closing Services, per the RFQ/P and the Fee
Schedule.
The RFQ/P requires Proposers to submit all licensing and any other standard industry
certifications that are required to provide these services.
The intent of this RFQ/P is to award a three (3) year contract with two (2), one (1) year
extension options, per Section 3.0, Scope of Work to those respondent(s) whose
proposal(s), conforming to the requirements of this RFQ/P, are most advantageous to the
Authority, price and other factors considered.
The Authority reserves the right to award in total or in part, and reject any and all proposals
when it is determined to be in its best interest, price and other factors considered.
The Authority's Contract For Professional Services, Attachment A, contract terms are in
addition to the terms and conditions set forth in this RFQ/P and should be read in
conjunction with them unless the RFQ/P specifically indicates otherwise.
1.2 BACKGROUND
The EDA was established to promote economic and urban development in the State, as
an independent instrumentality of the State of New Jersey. The Authority is a state
financing and economic development agency that offers financing assistance to for-profit
businesses and non-profit organizations, access to Small Business services, real estate
development assistance and incentives to attract and retain businesses in New Jersey. In
addition, it plays a key role in implementing major development projects, by providing site
selection services, as well as a full range of real estate development services, from
assembling land and structuring financing to overseeing building construction. This full-
service approach produces considerable financing advantages and cost benefits that make

it easier and more affordable for companies to locate and stay in New Jersey. The
Authority can assist credit-worthy businesses that need facilities for manufacturing,
distribution or research; developers of projects involving office, retail, entertainment and
hotel uses; and governmental entities requiring new or renovated facilities.
Since its inception in 1974, the New Jersey Economic Development Authority has provided
just over $26.5 billion dollars in assistance, to over 13,000 projects. These projects have
created an estimated 352,987 jobs within the State. In 2016, the Authority provided over
$1.5 billion dollars in assistance to five hundred seventy one (571) projects and created
more than 10,200 new full-time jobs and 9,100 construction jobs. In fact, since 1979, we’ve
developed over 10 million square feet of new and renovated space, valued at more than
$1.5 billion dollars.
1.3 KEY EVENTS
1.3.1 ELECTRONIC QUESTION AND ANSWER PERIOD
The Authority will electronically accept written questions and inquiries from all
potential Proposers via the web at EDAProcurementQA@njeda.com, per the
cut-off date listed on the front cover of this RFQ/P. Phone calls/faxes shall not be
accepted.
The subject line of the e-mail should state:
QUESTIONS-2018-RFQ/P-078-TITLE SERVICES-On an as needed basis
Questions should be directly tied to the RFQ/P and asked in consecutive
order, from beginning to end, following the organization of the RFQ/P.
Each question should begin by referencing the RFQ/P page number and
section number to which it relates.
Note: Questions regarding the Authority’s Contract for Professional
Services, Attachment A and exceptions to mandatory requirements must be
posed during this Electronic Question and Answer Period and should contain
the Bidder’s suggested changes. The Authority shall be under no obligation
to grant or accept any requested changes (i.e. exceptions taken) to the
specimen form of the Contract.
All Questions received, and Answers given in response to this RFQ/P will be
answered in the form of an Addendum. (See RFQ/P Section 1.4.1 for further
information.)
1.3.2 SUBMISSION OF PROPOSAL
In order to be considered for award, a sealed proposal must be delivered by the
required date and time indicated on the cover sheet to the following:
