RFP for Labor Relations Services
1. Introduction
This Request for Proposal (RFP) has been prepared by Washington County to secure services for labor
relations and arbitration support. The County is seeking a five-year contract. These services will go through
the RFP solicitation process every five (5) years at minimum.
1.1. Background Information
The County was established in 1849 and has the powers, duties, and privileges granted counties by state
law, codified in Minn. Stat. § 373. The County serves an area of 423 square miles, with an estimated
population of 262,748. The County’s fiscal year begins on January 1 and ends on December 31. The County is
governed by a five-member board of County commissioners representing separate districts within the
County. In addition, the offices of County attorney and sheriff are elected on a County-wide basis.
The County offers a full range of services including courts, property tax administration, law enforcement and
corrections, public works, human services, parks, solid waste management, library, community health,
County extension, and general administration. The County employs approximately 1400 employees.
At present, the County has eleven collective bargaining agreements with five different unions: AFSCME
Council 5, MNPEA, TEAMSTERS Local 320, IUOE Local 49, and LELS (Locals 214, 215 and 372). In addition,
there are two in-house associations made up of an essential Supervisor’s Association and an essential
Attorney’s Association of attorneys from the County Attorney’s office. Seven of these unions are considered
essential and accordingly, do not have the right to legally strike. Instead these units are provided interest
arbitration as codified under Minn. Stat. § 179A.16.
Typically, the County conducts negotiations with these labor unions every other year; however under Minn.
Stat. § 179A.20 Subd. 3 the duration of contracts may extend up to three years. These contracts typically
run in concert with the County’s fiscal year.
At present, all bargaining agreements are negotiated by in-house staff from the Human Resources
Department. However, there may be times that the selected external law firm is contacted to assist with
negotiation information or to provide guidance to staff regarding labor strategy. Also, when new legislation
is enacted, it is often necessary to secure legal guidance from external law firms when drafting policies
and/or when responding to union inquiries.
On the occasion that essential units are unable to reach agreement with the County during contract
negotiations, it may be necessary to for the selected law firm to support and guide County staff in
preparation of strategy, exhibits, and testimony for interest arbitration proceedings. The County would also
require the law firm to represent its interests at the actual arbitration.

2. Scope of Services
The successful Contractor will have the abilities to perform all the functions below. Contractors who cannot
provide the full range of requested services may submit a proposal but must clearly note any services listed
in this request which would not be provided. Contractors are also encouraged to highlight any services for
which they possess particularly notable qualifications.
2.1. Scope of Work to be Performed
Respond to questions regarding various facets of labor relations and or legal questions through
written requests or phone calls.
Act as a County representative in grievance hearings arising pursuant to collective bargaining
agreements. Assist in the analysis and preparation and prepare grievance responses on behalf of
the County.
Prepare and present the County’s position grievance arbitration and other employee/class action
grievances as requested by the County.
Prepare and present the County’s position in impasse, interest arbitration, unit determination and
other clarification hearings such as Bureau of Mediation Services administrative hearings, binding
arbitration, grievance arbitration, strike planning, and employee relations training and other special
projects as requested by the County.
Preparation for labor relations and labor negotiations litigation and representation of the County in
litigation matter as requested by the Human Resources Director.
3. Proposal Content
The following will be considered minimum contents of the proposal and must be submitted:
3.1. Cover Letter
Introduction of the contractor submitting the proposal and state understanding of the services. Include
name, address, telephone number, and email address of the contact person(s), as well as the names of any
others participating in the proposal.
3.2. Qualifications and Experience
Provide demonstrated qualifications and experience that proves the ability to perform the work.

3.3. References
Provide three references for organizations or companies currently utilizing your services that are similar in
size and with similar needs as Washington County. Include company, contact name, email address, phone
number, and a brief description of the services you provide.
3.4. Cost and Fee Schedule
Provide all fees associated with the proposed contract for services.
3.5. Appendix A
Provide a signed Appendix A – County’s Standard Terms and Conditions as the contractor to whom the
contract is awarded shall be required to comply with the terms and conditions contained therein.
4. Proposal Submittal
All proposals must include Proposal Content set forth in Section 3 and will be limited to no more than ten
(10) pages in length, excluding a cover sheet, a cover letter, table of contents, and appendices. The proposal
must be combined as one document and the font shall be no smaller than 11-point. Appendices are
anticipated to contain preprepared marketing materials and/or full resumes or other supporting documents.
Reviewers may or may not review material contained in appendices. and be sent electronically to the County

Contractors must submit to the e-mail address above with a subject line clearly marked as RFP for Labor
Relations Services, no later than January 24, 2024, 2:00 PM CST. Late submittals will not be considered.
All proposals, once submitted, become the property of the County. They will not be returned to the
contractor. Submission of a proposal indicates acceptance by the contractor of the conditions contained in
this RFP unless clearly and specifically noted in the proposal submitted and confirmed in the contract
between the County and the selected contractor.
5. Proposal Evaluation and Selection
5.1. Evaluation Committee
Representatives of Washington County will evaluate all proposals received by the deadline. All responses
will be evaluated based on the evaluation criteria below.
