Improvement
Sealed proposals will be received in the Procurement Division, Wednesday, February
24, 2021 prior to 2:00p.m.
Attached are important instructions and specifications regarding responses to this
Request for Proposal (the “RFP”). The failure of a responding proposer (a “Proposer”) to
follow these instructions could result in Proposer disqualification from consideration for a
contract to be awarded pursuant to this RFP.
This document is issued by Polk County (the “County”) which is the sole distributor of this
RFP and all addenda and changes to the RFP documents. The County shall record its
responses to inquiries and provide any supplemental instructions or additional documents
pertaining to this RFP in the form of written addenda to the RFP. The County shall post all
such addenda, together with any other information pertaining to this RFP, on the County’s
website at http://www.polk-county.net/procurement/procurement-bids It is the sole
responsibility of each Proposer to review the website prior to submitting a responsive
proposal (a “Proposal”) to this RFP to ensure that that the Proposer has obtained all
available instructions, addenda, changes, supporting documents, and any other
information pertaining to this RFP.
The County is not responsible for any solicitations issued through subscriber, publications,
or other sources not connected with the County and the Proposer should not rely on such
sources for information regarding the RFP solicitation.

Proposers and any prospective Proposers shall not contact, communicate with or
discuss any matter relating in any way to this RFP with any member of the Polk
County Board of County Commissioners or any employee of Polk County other than
the County Procurement Director or the individual designated above. This
prohibition begins with the issuance of the Request for Proposal and ends upon
execution of a contract. Any such communication initiated by a Proposer or
prospective proposer shall be grounds for disqualifying the offender from
consideration for a contract to be awarded pursuant to this RFP and for contracts
to be awarded pursuant to RFPs or Requests for Bid that the County may issue in
the future.

INTRODUCTION
Polk County, a political subdivision of the State of Florida seeks professional engineering
services for Jan Phyl Village Drainage Improvement Project, the Project.
Polk County’s Selection Process for consultants’ services is in accordance with Section
287.055, Florida Statutes, the Consultants’ Competitive Negotiations Act (“CCNA”). The
Professional Services Selection Committee will review the qualifications of all
submitting firms.
It is the intent of the County to select and negotiate a Consulting Agreement with one (1)
firm.
The County will negotiate a fee schedule and or overall lump sum price as part of
“Selection Process”, Elevation Level 4, Contract Negotiations.
Services under this contract will be in compliance with Section 287.055 of the Florida
Statutes referred to as the “Consultants’ Competitive Negotiation Act” (CCNA). Polk
County’s Procurement Procedure’s Manual outlines the Procedures for Contracting for
Professional Services Covered by CCNA. These procedures outline the process used for
the selection of a consulting firm awarded through this RFP process.
In accordance with Section 287.055(10), Florida Statutes, or any applicable amending or
replacement statute, this provision of the RFP shall serve as the County’s public notice
that any plans, drawings or designs developed by the successful Proposer(s) on behalf of
the County pursuant to this RFP or any agreement, authorization, purchase order or other
contract resulting therefrom, are subject to be reused by the County at some future time in
accordance with the aforementioned statute.
All services must be performed in accordance with applicable Federal, State and Local
regulations.
BACKGROUND, PURPOSE AND SCOPE
Background & Purpose:
The purpose of this Scope of Work (SOW) is to improve drainage in the storm-water
system of Jan Phyl Village in Winter Haven, Polk County, Florida, funded through the
Hazard Mitigation Grant Program (HMGP) DR-4337-0275-R, as approved by the Florida
Division of Emergency Management (Division) and the Federal Emergency Management
Agency (FEMA).
The Sub-Recipient, Polk County BOCC, shall conduct Phase I of this project, which
includes the preliminary engineering designs and calculations, surveys, permitting, and
notices. No construction activities are approved at this time. The Sub-Recipient shall
complete the Phase I work in accordance with all applicable federal, state and local laws,
regulations and codes.
SCOPE OF SERVICES
As a Hazard Mitigation Grant Program project, the Sub-Recipient proposes to
improve the storm-water system of Jan Phyl Village, in Winter Haven, Florida,
33880. Specifically, the project is located primarily along Maggie Circle and Fern
Road and extends to the intersection of Sidney Circle and Fern Road.

This scope is for Phase I activities only, which includes but is not limited to
surveying, engineering, design, plans preparation, permitting and bidding for the
proposed project, for Phase II approval. No construction activities for this
project have been approved.
When completed, the Sub-Recipient shall provide deliverables for Phase II
review of the following proposed activities.
The Phase II proposed Scope of Work (SOW) shall include the replacement of
the existing undersized storm sewer system for a new trunkline of 30”, 36” and
42” Reinforced Concrete Pipe (RCP) under Fern Road and Maggie Circle, to
drain into the 60” line that was added in 2015. County studies have indicated
that 108 homes would be flooded in a 100-year event and this project shall
lower the number of homes affected to 15, reducing potentially catastrophic
damages and the street flooding experienced by residents due to regular
storms.
The project shall be designed to provide protection against a 100-year storm
event. Activities shall be completed in strict compliance with Federal, State and
Local applicable Rules and Regulations.

TASKS & DELIVERABLES:
A) Tasks:
1. The Sub-Recipient shall procure the services of a qualified and licensed
Florida contractor and execute a contract with the selected bidder to
complete the Phase I scope of work as approved by the Division and FEMA.
The Sub-Recipient shall select the qualified, licensed Florida contractor in
accordance with the Sub-Recipient’s procurement policy as well as all federal
and state laws and regulations.
All procurement activities shall contain sufficient source documentation and
be in accordance with all applicable regulations.
The Sub-Recipient and contractor shall be responsible for maintaining a safe
and secure worksite for the duration of the work. The contractor shall
maintain all areas in a neat and presentable condition.
The Sub-Recipient shall ensure that no contractors or subcontractors are
debarred or suspended from participating in federally funded projects.
The selected contractor shall have a current and valid occupational
license/business tax receipt issued for the type of services being performed.
The Sub-Recipient shall provide documentation demonstrating the results of
the procurement process. This shall include a rationale for the method of
procurement and selection of contract type, contractor selection and/or
rejection and bid tabulation and listing, and the basis of contract price.
