NOTICE INVITING BIDS
PICKLEBALL & TENNIS COURT RESURFACING
CITY PROJECT NO. 20-11
N-1 NOTICE IS HEREBY GIVEN that sealed bids for the PICKLEBALL & TENNIS
COURT RESURFACING, CITY PROJECT NO. 20-11, will be received by the Office of the
Procurement and Contracting Manager of the City of Palm Springs, California, until 3:00
P.M. on Tuesday, March 3, 2020, at which time they will be opened and read aloud. The
Engineer’s estimate is $50,000 to $100,000.
N-2 DESCRIPTION OF THE WORK: The Work comprises resurfacing of eight pickleball
courts located on the westerly two tennis courts at Demuth Park, and resurfacing of eight
tennis courts at Ruth Hardy Park, consisting of: removal of existing surfacing; preparation
of existing surfaces (patching, grinding, sand finish); surfacing playing areas with new acrylic
systems, re-striping court areas, and all appurtenant work.
The work shall be diligently prosecuted to completion before the expiration of: 30 calendar
N-3 AWARD OF CONTRACT:
a) The City reserves the right after opening bids to reject any or all bids, to waive any
informality (non-responsiveness) in a bid, or to make award to the lowest responsive,
responsible bidder, on the basis of the Total Sum of Bid Schedules A and B, and reject
all other bids, as it may best serve the interest of the City. Bidders are required to
complete and submit a bid on all Bid Schedules. The City reserves the right to award a
contract in the best interests of the City.
b) As a condition of award, the successful bidder will be required to submit payment and
performance bonds and insurance.
c) As a condition of award or after April 1, 2015, the contractor and any subcontractor listed
on the bid must be registered with the Department of Industrial Relations pursuant to
Section 1725.5 of the California Labor Code.
N-4 BID SECURITY: each bid shall be accompanied by a certified or cashier's check or
Bid Bond in the amount of 10 percent of the total bid price payable to the City of Palm
N-5 BIDS TO REMAIN OPEN: The Bidder shall guarantee the Total Bid Price for a period
of 120 calendar days from the date of bid opening.
N-6 CONTRACTOR'S LICENSE CLASSIFICATION: The Contractor shall possess a
valid Class A or C-33 Contractor license at the time of submitting bids.
N-7 CALIFORNIA WAGE RATE REQUIREMENTS: The Contractor shall pay the
general prevailing rate of per diem wages as determined by the Director of the Department
of Industrial Relations of the State of California for the locality where the work is to be
performed. All contractors and subcontractors must furnish electronic certified payroll
records directly to the Labor Commissioner (via the Division of Labor Standards
Enforcement) as further described in Article 5 of the Construction Contract (Mutual

The Contractor and any subcontractors shall pay not less than said specified rates and shall
post a copy of said wage rates and other notices prescribed by regulation at the project site.
N-8 RETAINAGE FROM PAYMENTS: The Contractor may elect to receive 100 percent
of payments due under the Contract Documents from time to time, without retention of any
portion of the payment by the City, by depositing securities of equivalent value with the City
in accordance with the provisions of Section 22300 of the Public Contract Code.

N-10 LOCAL BUSINESS PROMOTION – In accordance with the provisions of Palm
Springs Ordinance No. 1756, and Section 7.09.030 of the Palm Springs Municipal Code,
“Local Business Preference Program”, subsection (5) “Local Preference in Public Works
Contracts (Sub-Contracting)”, the prime contractor shall use good faith efforts to sub-
contract the supply of materials and equipment to local business enterprises and to sub-
contract services to businesses whose work force resides within the Coachella Valley.
N-11 PUBLIC INTEGRITY DISCLOSURE FORM – The City of Palm Springs Public
Integrity Ordinance advances transparency in municipal government and assists public
officials in avoiding conflicts of interest. The City’s Public Integrity Ordinance, codified in
Chapter 2.60 of the municipal code, reflects the City’s interest in ensuring that companies
(and other legal entities that are not natural people) doing business in the community are
transparent and make disclosure as to their ownership and management, and further that
those companies disclose the identity of any person, with an beneficial ownership interest
of five percent (5%) or more.
a) You must file this form with your bid.
b) The names of all natural persons who are officers, directors, members, managers,
trustees, and other fiduciaries serving trusts or other types of organizations
(attorneys, accountants, etc.). You must make these disclosures in relation to the
applicant entity, and also in relation to any related entity that owns a part of, or
makes a profit based upon the business of the applicant entity. Disclosures may
include parent, subsidiary or affiliated entities of the applicant entity; if any entity
that is not a natural person serves the applicant entity (e.g., as a member of an
applicant LLC), then all officers, directors, members, managers, trustees, etc., of
the second entity must be disclosed).
c) The names of persons owning a beneficial interest of five percent (5%) or more in
your entity, Owners/investors who have such an interest hold either investment
power or voting power, i.e., they can (i) sell or transfer their interest, or (i) vote their
interest in management decisions.
N-12 ADDRESS AND MARKING OF BIDS: The envelope enclosing the Bid shall be
sealed and addressed to the City of Palm Springs, and shall be delivered or mailed to the
Procurement and Contracting Division, City of Palm Springs, 3200 East Tahquitz
Canyon Way, Palm Springs, CA 92262. The envelope shall be plainly marked in the upper
left hand corner with the name and address of the Bidder and shall bear the words “Do Not
Open in Regular Mail – This is a Sealed Bid For” followed by the title of the Project and the
date and hour of opening Bids. The certified or cashier's check or Bid Bond shall be enclosed
in the same envelope with the Bid.
