NOTICE INVITING BIDS FOR
17-07 EAST 5TH & VECINO STREET PEDESTRIAN IMPROVEMENTS
PROJECT
FEDERAL PROJECT NO. HSIP 5003(030)
RECEIPT OF BIDS: Sealed bids will be received at the office of the CITY of Benicia, PUBLIC
WORKS DEPARTMENT, City Hall, 250 East "L" Street, Benicia, California 94510, until June
20, 2019, AT 2:00 P.M. , for the construction of the 17-07 EAST 5TH & VECINO STREET
PEDESTRIAN IMPROVEMENTS PROJECT.
GENERAL STATEMENT OF WORK: The work consists of furnishing all labor, materials,
tools, equipment, transportation, and services necessary to perform the construction and
installation of the following: removal of existing striping, markings, and pavement markers;
installation of new striping, markings, and pavement markers; removal and reconstruction of curb
ramps; construct a bulb-out and crosswalk with flashing beacons; construct two new roadway
lights; jobsite cleanliness; and other items not specifically mentioned herein, and doing all
appurtenant work in place and ready for use, all as shown in the Specifications, Technical
Specifications, and other Contract Documents entitles as show above, now on file in the office of
the Public Works Director, to which reference is hereby made for further particulars. The
Contractor shall do whatever else is required by the Technical Specifications or that may be
necessary to be done in order to perform a complete job in all respects as specified herein and as
directed by the Engineer. The bidder is required to carefully examine the sites and the proposal,
plans, specifications, and contract forms for the work contemplated and it will be assumed the
bidder has investigated and is satisfied as to the conditions to be encountered, as to the character,
quality, and quantities of work to be performed and materials to be furnished, and as to the
requirement of the specifications, the special provisions, and the contract. Engineers estimate for
the project is $462,000 - $564,000.
LOCATION OF WORK: East 5th Street & Vecino Street, Benicia, California 94510.
COMPLETION OF WORK: All work must be completed within 90 working days after the
commencement date stated in the Notice to Proceed.
OPENING OF BIDS: The bids will be publicly opened and read at TBD at the City of Benicia,
in the COMMISSION ROOM at City Hall, located at 250 East “L” Street, Benicia, California
94510.
OBTAINING CONTRACT DOCUMENTS: Copies of the contract document, specifications
and drawings must be obtained at Blue Print Express, 4740 East Second Street #29, Benicia, CA,
94510, (707) 745-3593, upon payment of $50.00 per set, which is non-refundable. Additional
charge will be added for postage and handling if mailing is required. All bidders must purchase a
complete bid set from BPXpress Reprographics and be on the plan holders list in order to be
considered responsive and to receive addenda notifications. Electronic copies can be viewed at
www.blueprintexpress.com/benicia.
In addition, the Specifications incorporated by this reference, include the Standard Specifications
for State of California, Department of Transportation - CALTRANS, 2015 Edition and
supplements, and are an essential part of the contract documents. Copies are available for review
at the City Engineer's office or for purchase at the following address: State of California,
Department of General Services, Publications Distribution Unit, P.O. Box 1015, North Highlands,
CA 95660.
QUALIFICATION REQUIREMENTS: A contractor or subcontractor shall not be qualified to
bid on, be listed in a bid proposal, subject to the requirements of Section 4104 of the Public
Contract Code, or engage in the performance of any contract for public work, as defined in this
chapter, unless currently registered with the California Department of Industrial Relations and
qualified to perform public work pursuant to Labor Code section 1725.5. The registration period
begins July 1, 2014.
The qualification requirements shall apply to any bid proposal submitted on or after March 1,
2015, and any contract for public work entered into on or after April 1, 2015. Proof of
registration must be submitted with the bid proposal.
The project is subject to compliance monitoring and enforcement by the Department of Industrial
Relations. The contractors required to post job site notices, as prescribed by Department of
Industrial Relations regulations.
Each contractor and subcontractor shall furnish the records specified in Section 1776 directly to
the Labor Commissioner, in the following manner:
(A) At least monthly or more frequently if specified in the contract.
(B) In a format prescribed by the Labor Commissioner.
PROPOSAL GUARANTEE: Each bid shall be accompanied by a certified or cashier's check or
bid bond in the amount of ten percent (10%) of the total bid price payable to the City of Benicia
as a guarantee that the bidder, if his bid is accepted, will promptly execute the Contract, secure
payment of the worker's compensation insurance, and furnish a satisfactory construction
Performance Bond in the amount of one hundred percent (100%) of the Contract price and a Labor
and Materials Bond in the amount of one hundred percent (100%) of the Contract price. Said
bonds shall be obtained from a surety company satisfactory to the City. The above-mentioned
check or bid bond shall be given as a further guarantee that the bidder will enter into a Contract
with the City if awarded the work. The bid bond will be declared forfeited if the successful bidder
refuses to enter into said contract.
SECURITY FOR RETENTION: The Contractor may elect to receive one hundred percent
(100%) of payments due under the Contract without retention by the City by depositing securities
of value equivalent to the retention amount with the City in accordance with Government Code
Section 4590.
LICENSE: The general contractor for the project shall have a Class A license.
BIDS TO REMAIN OPEN: All terms and conditions contained in the contract documents
including the Instructions to Bidders shall become part of the Contract. No bidder may withdraw
his bid for a period of sixty (60) calendar days after the time set for the opening thereof.
WAGE RATES: Pursuant to Section 1770 to 1780 inclusive, of the California Labor Code, the
successful bidder shall pay not less than the prevailing rate of per diem wages as determined by
the Director of the California Department of Industrial Relations. Copies of such prevailing rate
of per diem wages are on file at the office of the City Engineer, which copies shall be made
available to any interested party on request. The successful bidder shall post a copy of such
determination at each job site. All subcontractors employed by the contractor shall pay not less
than the specified prevailing wage rates to all workers employed in the execution of the Contract.
PROJECT ADMINISTRATION: All questions relative to this project prior to the opening of
bids shall be directed to the Project Manager for the project. It shall be understood, however, that
no specification interpretations will be made by telephone, nor will any "or equal" products be
considered for approval prior to award of the Contract. The Project Manager for this project is:

CITY'S RIGHTS RESERVED: The City reserves the right to reject any or all bids, to waive
any informality in a bid, and to make awards in the interest of the City.
No pre-bid meeting is scheduled for this project.
Pursuant to Federal law, Disadvantaged Business Enterprise (DBE) requirements shall include all
DBEs, as described in the Specifications. This project is subject to state contract
nondiscrimination and compliance requirements pursuant to Government Code Section 12990, and
in any contract entered into pursuant to this advertisement, DBEs will be afforded full opportunity
to submit bids in response to this invitation.
The DBE contract goal for this project is 17%.
PREVAILING WAGE REQUIREMENTS: Pursuant to California Labor Code Sections 1770,
1773, 1773.1, 1773.6, and 1773.7, as amended, the applicable prevailing wages for this project
have been determined. It shall be mandatory upon the contractor to whom the contract is awarded
and upon any subcontractor under him to pay not less than the higher of the Federal and the State
prevailing wage rates to all workers employed by them in the execution of the contract. The
applicable Federal prevailing wage rates are those that are in effect ten (10) calendar days prior to
bid opening; they are set forth on the U.S. Department of Labor website:
http://www.wdol.gov/wdol/scafiles/davisbacon/ca33.dvb but are not printed in the Specifications.
Lower State wage rates for work classifications not specifically listed in the Federal wage decision
are not acceptable. The applicable State prevailing wage rates are set forth on the California
Department of Industrial Relations website: http://www.dir.ca.gov/DLSR/PWD but are not printed
in the Specifications; these rates are subject to predetermined increases.
The U.S. Department of Transportation (DOT) provides a toll-free hotline service to report bid
rigging, bidder collusion, or other fraudulent activities. The hotline is available Mondays through
Fridays between 8:00 a.m. and 5:00 p.m. eastern time, at (800) 424-9071. The hotline is part of
the DOT’s continuing effort to identify and investigate highway construction contract fraud and
abuse and is operated under the direction of the DOT Inspector General. All information will be
treated confidentially, and caller anonymity will be respected.
Conflict of Interest: in the procurement of supplies, equipment, construction, and services by sub-
recipients, the conflict of interest provisions in 24 CFR 85.36, OMB Circular A-110, and 24 CFR
570.611 shall apply. No employee, officer, or agent of the sub-recipient shall participate in the
selection, award, or administration of a contract supported by federal funds if a conflict of interest,
real or apparent, would be involved.
This project is subject to the “Buy America” provisions of the Surface Transportation Assistance
Act of 1982 as amended by the Intermodal Surface Transportation Efficiency Act of 1991.
This project is subject to the requirements of the Cargo Preference Act, as described in the
Specifications.
