Effective immediately, all Federal Highway Administration (FHWA) funded construction projects solicited by the City of Tucson will include
a pre-qualification requirement. The City will only accept bids from prime contractors who are pre-qualified through the Arizona
Department of Transportation (ADOT) pre-qualification process. A solicitation will clearly indicate if a project is funded with FHWA funds.
Documentation of certification must be submitted with the bid to be considered for award. Bids received from firms who
are not pre-qualified on the solicitation due date shall be rejected. For information on the ADOT Pre-Qualification

Notice Inviting Sealed Bids
NOTE – THIS IS A FEDERALLY FUNDED PROJECT
Pursuant to the Davis-Bacon Act of 1931, as amended, the City of Tucson has obtained from the U.S. Department of Labor the wage rates applicable to each
craft or type of laborer or workman needed to execute the contract. A copy of the applicable wage rates is included in each set of specifications and contract
documents. It shall be mandatory upon the contractor to whom the contract is awarded, and upon each subcontractor under him, to pay all laborers and
workmen employed in the execution of the contract not less than the applicable wage rates for each craft or type of laborer or workman so employed.
Bids submitted shall be accompanied by a certified check, cashier’s check or surety bond in the amount of not less than ten per cent (10%) of the bid amount,
as a guarantee that the contractor will enter into a contract to perform the work in accordance with the plans and specifications or as liquidated damages in
the event of failure or refusal of the contractor to enter into the contract. The certified check or cashier’s check shall be returned to the contractors whose
proposals are not accepted and to the successful contractor upon execution of the contract and delivery to the City of satisfactory Statutory Payment Bond
and Performance Bond. As required by Section 3 of the Housing and Urban Development Act of 1968, bidders must submit with the bid an
affirmative action plan assuring the bidder’s fullest efforts to utilize lower income project area residents and project area businesses.
No bid may be withdrawn within a period of sixty (60) days after the date fixed for bid opening.
For any reason deemed in the best interests of the City of Tucson, the Director of Procurement of the City of Tucson reserves the right to reject any or all
bids, or any part thereof, or to accept any bid or any part thereof, or to waive any informalities in the bid, or to withhold the award.
The Contract will be awarded to the lowest responsive responsible bidder.

The goals and timetable for minority and female participation, expressed in percentage terms for the Contractor’s aggregate workforce in each
trade on all construction work in the covered area, are as follows:

These goals are applicable to all the Contractor’s construction work (whether or not is Federal assisted) performed in the covered area.
The Contractor’s compliance with the Executive Order and the regulations in 41 CFR Part 60-4 shall be based on its implementation of the Equal
Opportunity Clause, specific affirmative action obligations required by the specifications set forth in 41 CFR 60-4.3(a), and its efforts to meet the
goals established for the geographical area where the contract resulting from this solicitation is to be performed. The hours of minority and female
employment and training must be substantially uniform throughout the length of the contract, and in each trade, and the contractor shall make a
good faith effort to employ minorities and women evenly on each of its projects. The transfer of minority or female employee’s or trainees from
Contractor to Contractor or from project to project for the sole purpose of meeting the Contractor’s goals shall be a violation of the contract, the
Executive Order and the regulations in 41 CFR Part 60-4. Compliance with the goals will be measured against the total work hours performed.
The Contractor shall provide written notification to the Director of the Office of Federal Contract Compliance Programs within 10 working days of
award of any construction subcontract in excess of $10,000 at any tier for construction work under the contract resulting from this solicitation. The
notification shall list the name, address and telephone number of the subcontractor; employer identification number; estimated dollar amount of the
subcontract; estimated starting and completion dates of the subcontract; and the geographical area in which the contract is to be performed.
As used in this Notice, and in the contract resulting from this solicitation, the “covered area” is Tucson, Pima County, State of Arizona.
Bidders on this work will be required to comply with the President’s Executive Order Number 11246. The requirement for bidders and contractors
under this order are explained in the specifications.
