NOTICE OF INTENT TO NEGOTIATE A SOLE-SOURCE CONTRACT

National Oceanic and Atmospheric Administration (NOAA), National Marine Fisheries Service (NMFS) hereby gives public notice of the intent to negotiate a sole-source contract pursuant to the statutory authority permitting other than full and open competition of 15 U.S.C. 637(m) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-5(b)(7) entitled, Sole source awards under the WOSB Program-15 U.S.C. 637(m).


This requirement provides supports to sub- and intertidal abalone surveys and research conducted by biologists in southern California. This research supports NOAA's mission to implement recovery actions for white and black abalone under the U.S. Endangered Species Act (1973) and to monitor pinto abalone status in Southern California under the NOAA Species of Concern program and the California Abalone Recovery and Management Plan. In addition, this work will apply existing NOAA monitoring protocols and further refine them for all species. Option years are included because longitudinal assessment and analysis are required to develop reliable methods for recovering and conserving protected abalone. The information obtained from these studies is required for designing the lowest risk recovery program that yields the highest recovery potential for white, black, and pinto abalone.


The Government intends to negotiate a logical follow-on contract with Paua Marine Research Group for the National Oceanic and Atmospheric Administration (NOAA), National Marine Fisheries Service, Alaska Fisheries Science Center (AFSC), located in Seattle, WA, who has a requirement for non-personal services associated with the following expertise:


? The recovery actions listed in our ESA Recovery Plan require: permission from NOAA to conduct scientific activities with Endangered Species Act-listed abalone;
? Expertise in abalone and habitat;
? Scientific expertise and certification to use SCUBA equipment; specialized experience to use underwater technology to identify, monitor, restore, and observe the behavior of wild abalone and their habitats; and
? Skills to analyze and interpret data collected from the proprietary time lapse cameras.


Small Business Act 15 U.S.C. 637(m), FAR Subpart 6.302-5(b)(7) & 19.1506(b)(1), establishes the authority whereby an agency may issue a sole-source (WOSB) award provided the following five (5) conditions are met:


1. The acquisition is assigned a NAICS code in which SBA has determined that WOSB concerns are substantially underrepresented in Federal procurement
2. The contracting officer does not have a reasonable expectation that offers would be received from two or more WOSB concerns (including EDWOSB concerns)
3. The anticipated award price will not exceed $4 million for a non-manufacturing NAICS code.
4. The WOSB has been determined responsible with respect to performance.
5. Award can be made at fair reasonable price.



Responses to this notice must be provided within fifteen (15) calendar days from the date of this notice. Vendors who believe they can meet this requirement are required to submit in writing an affirmative response demonstrating a comprehensive understanding of the requirement. All written responses must include proof of possessing permits and a written narrative statement of capability, including detailed technical information demonstrating their ability to meet the requirement. The response must be sufficient to permit agency analysis to establish a bona fide capability to meet the requirement. Failure to submit such documentation will result in the Government proceeding as previously stated. A determination by the Government not to open the requirement to competition based upon responses to this notice is solely within the discretion of the Government. Affirmative written responses must be received no later than 5:00 P.M. Pacific Standard Time, Thursday, June 29 2017.
