The 2013 Wisconsin Act 20 created a mandatory pre-bid contractor certification program and required that all projects over $185,000 (increased to $300,000) are let through Single Prime Bidding and Contracting. All potential bidders must become certified by the Wisconsin Department of Administration (DOA) prior to submitting bids. All bids received from contractors who are not certified will be rejected. The 2017 Wisconsin Act 237 made numerous changes to project thresholds and bidding requirements for state construction projects. Effective April 5, 2018, the threshold for small projects and projects requiring single prime bidding and contracting, have increased to $300,000. In addition, effective July 1, 2018, this law creates an exception to single prime contracting for certain construction projects. Under the new law, if 85% or more of the estimated construction cost of a project could be completed by a single trade MEP (mechanical, electrical, plumbing, or fire protection) contractor, the DOA may bid and contract all work for that construction project directly to a single trade MEP contractor. The changes for single trade contracting take effect for projects advertised for bid after July 1, 2018.

In certain instances, these threshold increases may impact contractor certification levels. Contractors who are currently certified for $300,000 or more in any division of work may bid on small projects up to the new threshold of $300,000. Contractors who are currently certified under $300,000 may only bid on a project up to their current certification level. Beginning July 1, 2018, single trade MEP contractors may bid all work on single trade projects up to their current division of work certification level for that trade. Please note, 2015 Wisconsin Act 55 repealed Wisconsin¡¯s prevailing wage laws on state building projects, effective September 23, 2017. This change does not affect the Federal Davis Bacon Act requirements.

Please be aware that 2017 Wisconsin Act 59 made changes to the applicability of the sale/use tax exemption under Wis. Stat. 77.54(9m) to state construction projects for the University of Wisconsin System and Extension. Please direct questions to the Department of Revenue.

11 BID OPENING for MEP BIDDERS: 2:00 P.M., March 7, 2019
14 OWNER: State of Wisconsin, Department of Administration (DOA), Division of Facilities Development,
15 hereinafter termed DFD.
17 NOTICE: Effective January 1, 2014, all potential bidders must be certified by DOA prior to submitting
18 bids on state construction projects over $50,000. All bids received from contractors who are not certified

24 This project is being let using a new single prime bidding and contracting process. DFD will publicly
25 bid the applicable mechanical, electrical, plumbing, and fire protection (MEP) divisions of work first. Within
26 5 days of the MEP bid opening, DFD will identify a lowest, qualified, responsible, certified bidder in each
27 applicable MEP division of work. These successful MEP bids must be included in all general prime contractor
28 bids received. No later than 5 days after DFD identifies the successful MEP bids, DFD will publicly open
29 general prime contractor bids. General prime contractor bids that do not include the successful MEP
30 bids will be rejected. The state will enter into a single contract with the lowest, qualified, responsible,
31 certified general prime contractor and this general prime contractor will enter into subcontracts with the
32 successful MEP bidders.
34 Sealed bids will be received at the State of Wisconsin Administration Building, 7th Floor, 101 East Wilson
35 Street, Madison, Wisconsin 53703, before the time indicated above. The bidder is responsible for the sealed
36 bid being delivered to the indicated location for receipt stamping before the time specified for the bid opening.
37 Third party delivery is entirely at the bidder's risk.
39 In general, the work consists of completely replacing the existing 6200 sq. ft. asphalt roofing system.
40 Project includes removal and disposal of the asphalt roofing materials and all flashing down to bare concrete
41 deck and installation of new insulation, roofing materials, roof drains, and metal flashings as specified in the
42 design manual.
