CODE ENFORCEMENT SPECIAL MAGISTRATE

The Magistrate:

• Shall comply with all laws, ordinances, and regulations applicable to the services contemplated herein, especially those applicable to conflicts of interest and collusion.
• May undertake concurrent employment, where permissible, but shall not represent a person or entity before the City Commission or any City Board, including but not limited to a person subject to a Special Magistrate Hearing in any year during which he or she serves as a Special Magistrate.
• Shall ensure that, if awarded a position as Special Magistrate, no person under his or her employ exercises any functions or responsibilities on behalf of the City or has any personal financial interest, directly or indirectly, with the City, except as fully disclosed and approved by the City.
• Shall accurately and completely preserve all testimony and include findings of facts and conclusions of law.
• Shall conduct code compliance hearings.
• Shall prepare, in writing, his or her findings of fact and conclusions of law using the forms approved by the City. To the extent reasonably practicable, the Special Magistrate will render his or her findings within seventy-two (72) hours, but in no event, more than seven (7) business days after the hearing.
• Understands and agrees to abide by any and all services conducted under this Agreement.
