REQUEST FOR STATEMENT OF QUALIFICATIONS

This Request for Statement of Qualifications (“RFSQ”) is issued in accordance with State of Utah Procurement Code, Utah Code
Annotated (UCA) Chapter 63G-6a, and applicable Rules found in the Utah Administrative Code (UAC). If any provision of this
RFSQ conflicts with the UCA or UAC, the UCA or UAC will take precedence.
Purpose of this Solicitation
The State of Utah, Division of Purchasing has issued this RFSQ to obtain statements of qualifications from companies to enter
into a contract with a qualified firm to evaluate regional water use practices, recommend future regional water conservation goals,
and provide recommendations to achieve those goals.
2015 water use data is to be used as the base water use for evaluating future planning and conservation goal purposes. In developing
regional conservation goals, contractors may want to consider the climate of the regions, water stressed areas or areas which have
the potential to be water stressed, and additional conservation potential (e.g., high unmetered secondary use, growth of the area
and density of growth).
It is anticipated that this RFSQ/SOIQ will result in a single contract award to the responsive and responsible who is the most
qualified. Evaluations will be conducted according to the State of Utah Procurement Code 63G-6a-1503.5 and awarded according
to 63G-6a-1505:
63G-6a-1503.5 Evaluation of statements of qualifications.

(1) An evaluation committee appointed under Section 63G-6a-1503 shall evaluate and score each responsive statement of
qualifications that has not been eliminated from consideration under this chapter, using the criteria described in the request for
statement of qualifications.
(2) Criteria not described in the request for statement of qualifications may not be used to evaluate a statement of qualifications.
(3) An evaluation committee may enter into discussions or conduct interviews with, or attend presentations by, the design
professionals whose statements of qualifications are under consideration.
(4) An evaluation committee shall rank the top three highest scoring design professionals, in order of their scores, for the
purpose of entering into fee negotiations as provided in Section 63G-6a-1505.
(5) If fewer than three responsible design professionals submit statements of qualifications that are determined to be responsive,
the chief procurement officer or head of a procurement unit with independent procurement authority shall issue a written
determination explaining why it is in the best interest of the procurement unit to continue the fee negotiation and the contracting
process with less than three design professionals.
(6)
(a) The deliberations of an evaluation committee may be held in private.
(b) If the evaluation committee is a public body, as defined in Section 52-4-103, the evaluation committee shall comply with
Section 52-4-205 in closing a meeting for its deliberations.
63G-6a-1505. Determination of compensation for design professional services.
(1) The procurement officer shall award a contract to the qualified design professional whose statement of qualifications was
awarded the highest score under Subsection 63G-6a-1503(4) by the evaluation committee, at compensation that the procurement
officer determines, in writing, to be fair and reasonable to the procurement unit.
(2) In making the determination described in Subsection (1), the procurement officer shall take into account:
(a) the estimated value, scope, and professional nature of the services; and
(b) the complexity of the project or services.
(3) If the procurement officer is unable to agree to a satisfactory contract with the highest scoring design professional, at a price
the procurement officer determines to be fair and reasonable to the procurement unit, the procurement officer shall:
(a) formally terminate discussions with that design professional; and
(b) undertake discussions with the second highest scoring, qualified design professional.
(4) If the procurement officer is unable to agree to a satisfactory contract with the second highest scoring design professional, at
a price the procurement officer determines to be fair and reasonable to the procurement unit, the procurement officer shall:
(a) formally terminate discussions with that design professional; and
(b) undertake discussions with the third highest scoring, qualified design professional.
(5) If the procurement officer is unable to award a contract at a fair and reasonable price to any of the highest scoring design
professionals, the procurement officer shall:
(a) select additional design professionals; and
(b) continue discussions in accordance with this part until an agreement is reached.
Contract Time Frame:
Completion of the study must be 4 months from the signing of the contract.
Background
In their Report to the Utah Legislature Number 2015-01, A Performance Audit of Projections of Utah’s Water Needs, chapter 3,
the Legislative Auditor General’s office recommended that the Division of Water Resources establish regional water
conservation goals to supersede the statewide conservation goal. The purpose of this contract is to obtain regional water
conservation goals developed by an independent consultant for regions throughout Utah, in compliance with the Legislative
Auditor’s recommendation.
Issuing Procurement Unit, Conducting Procurement Unit, and Solicitation Number
The State of Utah Division of Purchasing is the issuing procurement unit and the Division of Water Resources is the conducting
procurement unit for this RFSQ. The reference number for this RFSQ is Solicitation #AS17189. This solicitation number must
be referred to on all bids, correspondence, and documentation submitted to the State relating to this RFSQ.
Evaluation of Statements of Qualifications
Each Statement of Qualifications received shall be evaluated for responsiveness in as outlined in the Utah Procurement Code.
Pursuant to Section 63G-6a-1503(4) of the Utah Procurement Code this RFSQ shall be evaluated by the objective criteria
described in this RFSQ. Statements of Qualifications submitted must comply with the prerequisites and questions sections of
this RFSQ. Any Statement of Qualification that does not comply with the prerequisite and questions sections will be deemed
non-responsive and will be rejected.

Any exceptions to the content of this RFSQ, including the prerequisites, must be protested in writing to the Division of
Purchasing prior to the closing date.
To be responsive and responsible Vendors must review and respond to the following sections of this RFSQ: Prerequisites,
Buyer Attachments, and Questions.
• The Prerequisites Section contains the objective criteria that will be used to evaluate the RFSQ, including the mandatory
minimum requirements and general requirements that Vendors must certify that they have read, understand, and agree in
order to submit a Statement of Qualifications.
• The Buyer Attachments Section contains the required State of Utah Terms and Conditions of the RFSQ, which are non-
negotiable, the General Provisions which apply to this RFSQ, and any additional required forms.
• The Questions Section contains the questions that Vendors are required to answer in order to submit their Statement of
Qualifications.

Utah Procurement Code, Administrative Rules, policies and the evaluation criteria in this RFSQ. Vendors
