Bid Opening will be held at: 3331 North First Street, Building A, Room 106 San Jose, California 95134-1906 on October 5, 2017 at 2:00 p.m. Bids received after the date and time stated above will be rejected as nonresponsive. It is highly recommended that all Bids be hand-delivered. Contract documents (herein referred to as Contract Documents) specifying the requirements of the work to be performed (Work), the terms of the contract between VTA and the successful Bidder, and the details of the bidding procedure can be found at the VTAs website. Go to www.vta.org/procurement and select General Information which will lead you through the registration process. Once registered, Bidders can view and download information regarding this procurement, including the Contract Documents. There is no charge for downloading these documents. It is highly recommended that prospective Bidders acquire the Contract Documents directly from the VTAs website in order to bid on this project and be assured that their Bids include all addenda. Bids that do not acknowledge receipt of addenda may be considered nonresponsive. By registering as a VTA vendor, Bidder will automatically receive notifications by email of upcoming VTA bidding opportunities. The time of completion of the Work will be 580 calendar days, commencing on the 35th calendar day following issuance of the Notice of Award (as defined in Section 2.3) by VTA. The Bidder to whom the Contract will be awarded (Contractor) must, at the time of Contract award, possess current licenses in the following classifications issued by the California Department of Consumer Affairs, Contractors State License Board: Class A. Contractors subcontractors must also be properly licensed for their respective scopes of work. Contractor and all subcontractors used for this Work shall be registered, pursuant to Section 1725.5 of the California Labor Code, at the time of award, with the California State Department of Industrial Relations (DIR) and shall pay their employees the general prevailing rate of per diem wages as incorporated herein by reference. These wage rates are available through the DIR, http://www.dir.ca.gov/DLSR/PWD/ (Labor Code Section 1770. et seq.) and the Contracts Office of VTA at the above address. This project is subject to compliance monitoring and enforcement by the DIR. This Contract is also subject to federal requirements for payment of prevailing wages as determined by the Secretary of Labor. Federal wage rates are available at the Department of Labor website https://www.wdol.gov/dba.aspx and at the Contracts Office of VTA at the above address. When accessing the website, under Davis-Bacon Act select Archived WDs and enter CA29 for the DBA WD Number. The Federal Wage Determination will be based upon the last modification published no less than 10 calendar days prior to Bid Opening date. Where there are differences in the rates, the higher shall apply. This project obtained a financial assistance grant from the Federal Highway Administration (FHWA) during the Engineering Design phase. Contractor shall insert in each subcontract all of the stipulations contained in the federal contract provisions, Appendix D, Federal Requirements (the Required Contract Provisions), and further require their inclusion in any lower-tier subcontract or purchase order that may in turn be made. The Required Contract Provisions may not be simply incorporated by reference but must be stated verbatim. Contractor is responsible for ensuring all of its subcontractors and lower-tier subcontractors comply with these Required Contract Provisions. VTA is an Equal Opportunity employer. In the performance of this Contract, Contractor and its subcontractors shall not unlawfully discriminate, harass or allow harassment, against any employee or applicant for employment because of sex, gender, gender identity, gender expression, race, color, ancestry, religious creed, national origin, physical disability (including HIV and AIDS), mental disability, medical condition (cancer), genetic information, marital status, age (over 40), sexual orientation, or military and veteran status. In addition, Contractors and subcontractors shall not unlawfully deny any of their employees family care leave or discriminate against them on the basis of having to use family care leave. VTA affirms that in any contract entered into pursuant to this Invitation for Bid, disadvantaged and small business enterprises will be afforded full opportunity to submit Bids. A 12.00% participation goal for Disadvantaged Business Enterprises (DBEs) has been established for this Contract. All DBE firms listed on Bid Form #4 must be certified by the California Unified Certification Program (CUCP) at the time of Bid to be counted toward the above-stated DBE goal. Bidders must comply with VTA's Policy on Utilization of Disadvantaged Business Enterprises (DBEs), as set out in Section 7.0, GC-13. A Bidder who fails to achieve the DBE goal and who fails to demonstrate sufficient good-faith efforts to meet such goal shall be deemed non-responsive and therefore ineligible for award of the Contract. Bid Form #4, #4a, and Good Faith Efforts (if the DBE goal is not achieved) must be submitted as set out in Section 3.0, Instruction to Bidders, 7.10 DBE Documentation. It is the Bidders sole responsibility to verify each subcontractors certification as a DBE to VTA. The list of available DBEs is available at http://www.dot.ca.gov/hq/bep/find_certified.htm. The DBE application is available at http://www.vta.org/osdb. Bidders security in the form of cash, a cashiers check made payable to VTA, a certified check made payable to VTA or a Bidders Bond executed by an admitted surety insurer made payable to VTA, is required on all Bids. Bids shall be submitted on the forms provided in these Contract Documents in signed original. In accordance with California Public Contract Code Section 22300, Contractor may substitute securities for any money withheld under GC-59, Progress Payments of Section 7.0 General Conditions. At Contractors request and expense, securities equivalent to the amount withheld shall be deposited with VTA, or with a state or federally chartered bank as the escrow agent, who shall pay such monies to Contractor. Upon satisfactory completion of the Contract, the securities shall be returned to Contractor. VTA has designated this project as archaeologically sensitive. VTA reserves the right to reject any or all Bids, to waive any informality in Bids, and/or to accept or reject any items of the Bid.
